Godard, ASLA Godard Design Associates, Inc 1825-A 3rd Street N Jacksonville Beach, FL 32250 SUBJECT: TREE 08-00100038 / Permit Amendment 2405 Mayport Road (Walgreens) Dear Mr. Godard: I am writing in response to an inquiry recently made by you regarding a potential amendment to Tree Removal Permit TREE 08-00100038, issued on July 17, 2009 by the City of Atlantic Beach, in conjunction with planned redevelopment of the property located at 2405 Mayport Road, otherwise known as the Walgreens site. In particular, during a phone call on November 20, you relayed that the client wished to install a sidewalk along the southern right-of-way of Fleet Landing Drive, with probable impact to the following trees that were designated for preservation according to the previously approved landscape plan (revision 10/31/2008): TREE ID SPECIES DBH LOCATION 1 OAK 18” private, within 3’ of property line 2 LIVE OAK 18” private, within 3’ of property line 5 LIVE OAK 20” public, Fleet Landing right-of-way 9 OAK 20” public, Fleet Landing right-of-way 17 OAK 12” private, within 3’ of property line After conferral with City Engineer and Public Works Director Rick Carper, PE, I informed you that, while the City’s Land Development Regulations do not require installation of a sidewalk in conjunction with this project, we would support the additional improvement and we encouraged the use of innovative design and alternative products so as to continue preservation of those trees. We also looked briefly at the Fleet Landing right-of-way, and I reiterated the City’s support of a sidewalk adjacent to the project, provided there would be no impact to the public trees. Then, on December 8, you informed me that your client had since expressed desired to remove those trees noted above and you asked for direction as to Tree Removal Permit Amendment procedure. I have now re-reviewed the approved landscape plan (revision 10/31/2008), together with the minor changes discussed with you on December 4, 2009, and I have again conferred with Mr. Carper as well as Community Development Director Sonya Doerr, AICP, and we are in unanimous agreement that the City cannot support removal of the two mature live oaks (#5 & #9) from the public right-of-way, for the installation of a non-required sidewalk. These “public” trees do not inhibit the redevelopment of this site, nor did they interfere with any previous owner/tenant’s accessibility to or use of the property. Furthermore, we strongly encourage your client to continue preservation of the other three “private” oaks (#1, #2, & #17) in close proximity to the property line. In closing, I would like to reiterate that staff will continue to support the incorporation of a sidewalk that accommodates these trees through allowances for flexibility of design standards. We also recommend the use of alternative products that are more accommodating to trees, such as rubber sidewalk pavers (www.paversearch.com/sidewalk-pavers-rubber.htm). However, the City has a long-standing commitment to the protection of healthy mature trees which make up a vibrant urban forest that affords our community so many benefits.
