AGENDA ITEM: Request from LA | Fitness for an exception to the height limit to accommodate an architectural element that exceeds the thirty-five (35) foot maximum height standard by three (3) feet, on a property located within the Commercial General Zoning District at 985 Atlantic Boulevard.

BACKGROUND: LA | Fitness has signed a lease to occupy the commercial space vacated by
Publix SuperMarkets at 985 Atlantic Boulevard in the Atlantic Village Shopping Center. Staff has met with consultants and contractors for the new tenant and plans for renovation are currently being
prepared. One issue requires address by the Commission, though.
According to Section 59 of the City Charter, and as provided by
Section 24-156 of the Land Development Regulations, certain architectural design elements may exceed the maximum height
of a building within a non-residential development, upon
approval by the City Commission. As can be seen on the
attached rendering, the new
parapet is twenty-eight (28) feet above finished floor
elevation. However, there is
an architectural crown that extends to thirty-eight (38) feet above
finished floor elevation. There is no habitable or storage space
associated with this element; rather it is a signature design element typical to most LA Fitness structures, as depicted in the
included images.
The Commission similarly approved an architectural element incorporated into the front façade of the
North Beach Center, also located in the Commercial General Zoning District just one block east at 725 Atlantic Boulevard, on July 8, 2002. That design element is forty-six (46) feet in height,
extending eleven (11) feet beyond the maximum height allowed for the structure.
RECOMMENDATION: Approve the requested exception to the thirty-five (35) foot maximum
building height to allow the proposed architectural design element which would exceed the standard by three (3) feet, finding the projection is consistent with the conditions stated in Section 59 of the
City Charter and provided in Section 24-156 of the Land Development Regulations.
