Atlantic Beach Country Club intends to expand the existing pavilion structure located at the sixteenth tee box of the ABCC golf course to an enclosed restroom facility to be used by the Club members during golf play, similar to the restroom which currently exists at the seventh green. The location of the proposed restroom structure is located directly adjacent to the property line between ABCC and Fleet Landing, shown in Exhibit A. ABCC desires to connect its new potable water, electrical, and sanitary service for the restroom facility to an existing service located between Fleet Landing Unit 123 and Unit 124.The existing water,electrical and sanitary services are owned and controlled by Fleet Landing. Fleet Landing has agreed.to authorize ABCC to tie into the water and electrical, and sanitary services to the proposed restroom facility through the property located between Unit 123 and Unit 124. It is mutually recognized by the parties to this MOU that: Fleet Landing grants ABCC access to the property between Unit 123 and Unit 124 for the sole purpose of constructing and maintaining the proposed utilities for a twenty (20) year period from the date of this agreement. Fleet Landing agrees to maintain a minimum % inch potable water service and electrical and sanitary services,in good working order,up to the point of connection for ABCC.ABCC agrees to maintain their extended utilities beyond their point of connection. Fleet Landing agrees to maintain a minimum 3/ inch potable water service and electrical and sanitary services,in good working order, up to the point of connection for ABCC.ABCC agrees to maintain their extended utilities beyond their point of connection. ABCC will be responsible for all repairs to the utilities, as well as any property damaged as part of construction or maintenance of the utilities. ABCC shall only be responsible for meeting the current site condition of the property as part of a repair. Additional improvements including upgraded landscaping, etc. shall not be included as part of this agreement. ABCC shall contract with JEA to provide a meter for electricity and COAB a meter for water, and pay JEA and COAB directly for those utilities. ABCC agrees to provide Fleet Landing three (3) Complimentary Golf Tournaments, for up to 120 people each tournament, including lunch, dinner and/or breakfast.The dates of the tournament shall be coordinated and mutually agreed to at a future date. ABCC also will consider requests for future tournaments based on mutual agreements to be determined.
