Please be advised, the City of Atlantic Beach Code of Ordinances includes rules and regulations governing
construction activities and also maintenance standards for property within the City. These standards are set forth
in the International Property Maintenance Code and the Florida Building Code and were adopted as part of the
City of Atlantic Beach Code of Ordinances in Chapter 6,Article II, Section 6-16.
A code enforcement inspection at 1937 BEACH AVE was conducted on 7/1/2020. The City of Atlantic Beach
Code Enforcement has found your property to be in violation of the City of Atlantic Beach Code of Ordinances
Section 24 were adopted on July 8,2019 and may be viewed www.coab.us
VIOLATION CODE: Section 24-68 states in part,"Stormwater,drainage, storage and treatment requirements.
(a)Topography and grading.All lots and development sites shall be constructed and graded insuch a manner so
that the stormwater drains to the adjacent street,an existing natural element used to convey stormwater(see
section 22-3-3,definitions: Stormwater management system),or a city drainage structure after meeting onsite
storage requirements, as set forth within this section."
NATURE OF VIOLATION: It appears the stormwater drainage on your lot has been altered. A black pipe runs
from your downspouts,through the retaining wall depositing water onto your neighbor's property. Stormwater
may not be diverted onto neighboring properties.
This letter requests that the noted violation(s) be corrected by relocate the drainage pipes so that
stormwater is not diverted onto neighboring properties within ten(10)days of the receipt of this notice.
Thank you for your cooperation in this matter. Failure to correct the violation by the required date may result in
this case being referred to the Code Enforcement Special Magistrate resulting in fines up to two hundred fifty
dollars ($250.00) per day. Upon completion of the action required, it is your responsibility to contact me and
arrange for an inspection to verify compliance. Please contact Atlantic Beach Code Enforcement at (904) 247-

Dear Ms. Irizarry:
As per our telephone call of 8/20, I received your letter of July 2, 2020 and took steps to
remedy the problem. Unfortunately, some folks that I hired to fix a wooden retaining wall to an
existing flower box which had worn away created a new problem when a drainage line was
routed outside the existing barrier and onto the neighbor's property. I have since had that
problem fixed and the water no longer drains onto any property belonging to anyone else.
You can certainly come and inspect. I think that we did a good job.
