ORDER AFFIRMING THE DENIAL OF VARIANCE ZVAR19-0002
BY THE COMMUNITY DEVELOPMENT BOARD
This matter came to be heard upon the appeal of the decision of the Community
Development Board, dated February 19, 2019, to deny variance application #ZVAR19-0002 for a
structural projection at 574 N. Nautical Boulevard (the “Subject Parcel”), timely filed pursuant to
Section 24-49 of the City of Atlantic Beach’s Land Development Regulations by the applicant,
Gregory Carr (“Applicant”) on behalf of himself, dated March 1, 2019.
Having duly considered the record documents transmitted to this Commission, as well as
both testimonial and documentary evidence presented at the appeal hearing on March 25, 2019,
the City Commission of the City of Atlantic Beach hereby,
FINDS AND DETERMINES:
A. That the Applicant requested a variance to increase the maximum structural projection
permitted into required rear yards from 4 feet to 7 feet; and
B. That the requested variance at the Subject Parcel at 574 N. Nautical Boulevard would
materially adverse impact upon light and air to adjacent properties;
C. That such documentary evidence is competent and substantial and meets the
requirements and criteria contained in Section 24-64(c)(1) of the City of Atlantic
Beach’s Land Development Regulations, “grounds for denial, light and air to adjacent
properties”; and
D. That an error was not made in the Community Development Board’s decision to deny
variance application, ZVAR19-0002.

NOW, THEREFORE, based upon the foregoing, it is ORDERED by the City
Commission:
1. The appeal of the Community Development Board’s Order denying variance
#ZVAR19-0002, taken by the Applicant, is hereby DENIED.
2. The denial of variance application #ZVAR19-0002 is hereby AFFIRMED.
Denied by the City Commission on March 25, 2019.
