730 Plaza ZVAR19-0013 PresentationRequest for a variance as permitted by Section 24-65, to reduce the side yard setback from 7.5 feet to 5 feet within the Residential, Single Family (RS-1) zoning district at 730 Plaza (Lot 17, Block 8, Royal Palms Unit 2) in order to build an addition to the east side of the house. ZVAR19-0013 Site Context and Detail Residential Single Family (RS-1) Zoning Located mid-block with similar size homes on similar size lots Lot is 80.65 feet wide by 93 feet deep Proposed Addition Proposed Plan Request to construct an addition (garage/carport) which will look like a garage from the front and side but open in the back. Addition would encroach in the required side yard setback. Need for a Variance Section 24-105 (e) requires 7.5 foot side yard setback on each side The proposed addition would encroach 2.5’ into the required setback leaving a 5 foot side yard 7.5’ required 5’ proposed Proposed Addition Analysis and Concerns Purpose of the variance “large tree in front does not allow a wider drive and addition will not give space for a 2 car carport, it will give enough space for extra storage.” Property as 15.3 feet of buildable area on the east side (width) Grounds for Decision APPROVAL-existence of one or more of the following (Section 24-64 (c) DENIAL-adverse impact on one or more of the following 1.Exceptional topographic conditions of or near the property. 2.Surrounding conditions or circumstances impacting the property disparately from nearby properties. 3.Exceptional circumstances preventing the reasonable use of the property as compared to other properties in the area. 4.Onerous effect of regulations enacted after platting or after development of the property or after construction of improvement upon the property. 5.Irregular shape of the property warranting special consideration. 6.Substandard size of a lot of record warranting a variance in order to provide for the reasonable use of the property. The CDB may consider a denial upon finding that none of the requirements in 24-65 (c) exist.
