During the inspection,the undersigned Code Enforcement Officer observed that the property was in violation of the section listed above in the City of Atlantic Beach Code of Ordinances. The nature of the violation included: On 5/14/2020 a Stop Work Order was posted on your property for construction of a garage structure without a permit. The structure was built on an existing slab using three existing free standing walls. The work included a new roof system, additional walls and a garage door. An incomplete permit application was received on 9/21/2020 which did not cover the full scope of the project and did not include any engineering as previously discussed. At the December 3, 2020 special magistrate hearing, an order was isssued requireing either a construction or demolition permit to be obtained by the January 7, 2021 hearing. On May 14, 2020 the City of Atlantic Beach posted a stop work order on Respondent's property due to Respondent's construction of an enclosed garage attached to the main structure without any permitting and with electrical service running to the garage. 5. Respondent appeared at previous hearings on December 3, 2020 and January 7, 2021. On January 7, 2021, the Respondent stated that only preexisting walls would remain after demolition, and the entire roof structure would be removed. Also, that electrical service had been disconnected and there no longer was service to the garage. 6. A one-time fine of$200.00 was previously imposed. Imposition of any further fines is delayed due to Respondent's assurance of the progress of demolition or obtaining a permit and assurance of compliance. 7. The Respondent stated he had complied with a demolition permit within the allotted time frame and the City confirmed. CONCLUSIONS OF LAW 8. The demolition has been completed accordingly to code and the Respondent is in compliance. ORDER Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority granted in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach, Florida it is ORDERED: THAT the Respondent is in compliance and no fines will be assessed.
