FL 32233 Re: Property of the Dagley Family Dear Sonya: This letter is a formal request to seek forrnal recognition of a previous agreement in 1986 between the City of Atlantic Beach and the Dagley family. I represent the Dagley family in this matter. By way of background, the Dagley family has operated a salvage junkyard in the City of Atlantic Beach for quite sometime. In 1986, a SP special use district was established for their property pursuant to Ordinance 00-86-100. T nis special use district is reflected today as Section 24-113. During the passage of that Ordinance, an agreement was made between the City of Atlantic Beach and the Dagleys, as to the use of certain streets. It was agreed upon and the parties have used the property that way since 1986. Specifically, the City of Atlantic Beach and the Dagleys agreed that the City would close Begonia Street from West 6th Street, South and Tulip Street from West 6th Street, North. In exchange, the Dagley's agreed to restrict the use of their operation to that property. There has become an interest in formalizing this agreement after recent right of way issues and zoning issues which the zoning department can address. The bottom line is to request formal recognition of the 1986 agreement that no right of way would be operated on Begonia Street to the South and Tulip Street to the North. Please inform me when I may address the City of Atlantic Beach on this issue. I would prefer the date of October 27, 2003, if possible. Thank you for your help and coop- tion in this matter. Sinc-rel S'o :. Parks JpaC C' CHRONOLOGY OF EVENTS IN THE DAGLEY CASE 1. In March 1985 a complaint was received regarding junk cars at three locations in Section H, including property south of Sixth Street, and at the westerly end of Sixth Street. 2. November 14, 1985, Mr. Dagley was brought before the Code Enforcement Board because of junk cars on lots 5 and 6, Block 162, Section H - the matter was continued to the Code Enforcement Board meeting of January 9, 1996. 3. On January 9, 1986, the Code Enforcement Board determined that Mr. Dagley's property was used in conjunction with his business prior to the zoning ordinance of 1959, of which he was being charged with violating. It was determined that he was not in violation of the ordinance and that his business was "grandfathered in." 4. March 24, 1986, the Mayor was authorized to appoint a committee to discuss the Dagley case with Mr. Dagley's attorney. 5. April 14, 1986, the Mayor reported to the City Commission that the committee recommendations had been forwarded to the Advisory Planning Board. (The committee recommended a "pulling-in" of Mr. Dagley's operations, and that he be given a Use-by-Exception to operate in a specific area near the marsh where most of his property was located. They recommended a swap of some of his lots for some of the city's right-of-way on Begonia Street to further consolidate his operation). 6. April 15, 1986, the Advisory Planning board voted to create a Special use District for a junk yard, consisting of blocks 111, 117, 118, 119, 139, 140, 141, 142, and 143. The board recommended that Mr. Dagley deed block 110 to the City in exchange for closing Begonia Street from West 6th Street to the marsh; that Mr. Dagley remove all cars from lots 5 and 6',"block 162, and restrict all future activity to property then owned by Mr. Dagley. (There is no evidence to indicate that block 110 was ever deeded to the city, or that the city ever abandoned or closed the portion of West 6th Street referred to above.) 7. May 20, 1986, a public hearing was held at the meeting of the Advisory Planning Board. The board identified the blocks to be included in the Special Use District and approved a motion indicating that if any lot or parcel within the Special Use District ceased to be used for Mr. Dagley's business, that parcel would not again be a part of the Special Use District. 8. November 10, 1986, the City Commission adopted Ordinance No. 90-86-103, establishing a Special Use District for salvage/junk yards consisting of Lots 111, 112, 113, 117, 118, 119, 140, 141, and 142, Section H. 9. November 18, 1986, Mr. Dagley's attorney (Alan Jensen) sent a letter to the city setting forth the actions which would be taken by Mr. Dagley: (a) Remove all junk vehicles from Lots 5 and 6, Block 162, and cease using those lots for his business (b) Remove all junk items from blocks 110, 139 and 143, and cease using those blocks for his business (c) Construct approximately 2.00 feet of privacy fence on the south side of West 6th Street with approximately 100 feet going east from Begonia Street and approximately 100 feet going west of Begonia Street -2- ...0. 7\i,.., . Mayor Howell announced the following changes incorporated at the last meeting: Blocks 139 and 143 which abutted Tulip fit. on the west were originally included in the Ordinance, and they had been withdrawn. Anything on those lots would have to be pulled back to the west side of Tulip St. Everything would be cleared from Block 110 and that block would revert back to residential zoning. Nothing would be on Block 120 (not owned by Mr. Dagley) . Mr. Dagley would construct a privacy fence on West 6th St. which would encompass Blocks 117 and 118 along West 6th St. 1• Motion: Passage of Ordinance No. 90-86-103 on final reading Edwards x Morris x Commissioner Gulliford commented he was going to vote in opposition to the motion, not anything to do with the personalities involved, not any recognition of one person's privilege or position over another, but felt it was a poor way to attempt to settle a condition that existed now that was brought about years ago by individual/s irresponsible to a condition that existed. He said the Commission was establishing a precedence for some type of exception for a sin that was committed some years back, and he was very opposed to the approach. Action by the City Commission to adopt Personnel Rules and Regu- lations of the City of Atlantic Beach amended and modified as of October 1, 1986. Item 11 deferred until the next meeting. 12.Discussion by the City Commission on the desirability and feasibility of authorizing the Cloisters Condominiums to close off the entrance to the complex on Tenth Street, and open the entrance to the complex on Club Drive. Marsha Dorsey, Treasurer of the Cloister Condominium complex, informed the Commission there were several reasons why they wanted to change the entrance, . 1) Tenth St. was a traffic safety hazard; 2. )Tenth St. was a public access to the beach, and uninvited people use their property for parking and also swim in their pool. 3.) They had to pay a lot for security to try and prevent the situation. They planned major modifi- cations in landscaping soon and planned to install a wooden gate with a lock for emergency use at Tenth St. Following discussion, the Commission 'lad no objections as long as they did not close 10th St. permanently. Miscellaneous Commissioner Cook asked the City Attorney to prepare an Ordinance ORDINANCE NO. 90-86-103 AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF.ATLANTIC BEACH, FLORIDA; AMENDING CHAPTER 24, ARTICLE III, DIVISION 5, TO ESTABLISH A SINGLE USE DISTRICT; PROVIDING AN EFFECTIVE DATE BE IT ORDAINED by the City Commission of the City of Atlantic Beach, Florida: Section 1 . Chapter 24, Article III, Division 5 is hereby amended to create Section 24-113, Special Use District, which said section shall read as follows: 1• CHAPTER 24 ARTICLE III - ZONING REGULATIONS DIVISION 5 - ESTABLISHMENT OF DISTRICTS Section 24-113. Special Use District (a) Intent. The SP district is intended for a limited single use. (b) Permitted Use. The use permitted in this district is as follows: (1) Salvage yard/junk yard restricted to automobiles, trucks, motor- cycles, mobile homes, other vehicles, boats, septic tanks, and other metal • scrap. (c) Uses by exception. None (d) Minimum lot or site requirements. The site requirement in this district is as follows: (1) Lot or site area: The site aria shall not exceed that covered by the following Blocks or portions thereof located in Section H, to wit: All of Blocks 111, 112, 113, 117, 118, 119, 140, 141, and 142. (e) Minimum yard requirements. None. • • (f) Building restrictions. The building restriction in this district is as follows: (1) No buildings of any kind will be allowed in the district except single family residence for the owner/operator and members of their immediate families, and in addition thereto necessary repair/work shops use in the connection with the Permitted Use as described above. (g) Special requirements. The operation of this Special Use District will require the following: (1) If any lot or parcel within the blocks herein above referred cease to be used for the purposes specified herein, then and in that case, that particular lot or parcel shall not _again be allowed the Special Use Exception and the autos, boats, parts, etc. shall be removed at the owner's expense within six (6) months after receiving written notice from the City of Atlantic Beach. Section 2. The Ordinance shall take effect upon its adoption. Present: W. Gregg McCaulie, Chairman Guy Jennings Ruth Gregg Candace Nordan And: Richard C. Fellows, City Manager Hilary Thompson, Recording Secretary And: Fred Mills Russ Kahoe/Ron Schiebler Charles Crum/ George Reinhart /Mr. Ellis Absent: Ron Gray Chairman McCaulie called the meeting to order at 7:05p.m. He asked for a motion on the minutes of the meeting of March 18, 1986. Guy Jennings motioned to approve the minutes as presented. There being no changes to the minutes and no objections the motion carried unanimously. NEW BUSINESS A. Request for Use By Exception for Fred W. Mills; Lots 1,2 $ 3, Block 4, Donner's Replat, Currently zoned CG, (Grandfathered). Mr. Fred Mills told the board that he was requesting a blanket Use By Exception on the property. When he purchased it, he purchased it for the zoning and then after it was developed the city came in and rezoned it. He had purchased the property and was planning on it being his source of income for retirement. The Board expressed concern over issuing a blanket Use By Exception because of the lack of control over tenants renting the property. Mr. Fellows pointed out that the Board would only be allowing Mr. Mills to rent to tenants that were allowed as permitted uses or Uses By Exception and no others. Mr. Mills agreed that all Use By Exceptions would be allowed except for item number four (4) On premise consumption of liquor, beer and wine. Guy Jennings motioned that the Use By Exception be granted, Candace Nordan seconded the motion. The motion carried unanimously. B. Request for Use By Exception for Charles W. Crum; Lots 1 € 2, Block 25, Section H, Currently zoned CG. (Grandfathered) . The Board asked Mr. Crum and his tenant is there were any problems between themselves and their neighbors. They stated that their only problem was over the neighbors dumping garbage in their dumpster and they were known to have one of the best records of any of the beer Advisory Planning Board April 15, 1986 Page 2 bars on Mayport Road. Gregg McCaulie motioned to approve the request for Use By Exception, Ruth Gregg seconded the motion. Three of the five members present voted for the motion. Guy Jennings voted against. The motion passed by a majority. C. Request for Use By Exception by Farin and Edith Kahoe; 1075 Atlantic Blvd., Atlantic Beach, Currently zoned CG. (Grandfathered). The chairman addressed the fact that the Board needs to look into the problem of work being performed outside of the garages, fencing, storage of materials, junked cars and a number of other items to be discussed at a later date. These items are not necessarily pertaining to this one garage but to auto service garages in general. There being no discussion on the request Ruth Gregg motioned to approve the Kahoes' request for Use By Exception, Gregg McCaulie seconded the motion. The motion passed unanimously. MISCELLANEOUS D. Chairman McCaulie presented a copy of the committee minutes of March 31, 1986 for the Boards information and asked for a motion to create a ordinance for the creation of a Special Use District for a junk yard for blocks 111,117,118,119,139,140,141,142,143. Chairman McCaulie and Mr. Fellows briefed the Board about the situation with the Dagley's junk yard and the current actions by the City. It has been proposed that the Dagley's would deed over block 110 to the City in exchange for closing Begonia Street from West Sixth Street south to the marsh and Tulip Street north from West Sixth Street to the Marsh. Mr. Dagley would also agree to restrict operations to property that he currently owns including blocks 111, 119, 118 and 117, Block 139, 140, 142 and 143. He is also conducting business on block 141 but that property is being leased from another individual. Part of the proposal would have the Dagley's remove all cars from lots 5 $ 6 in block 162 and restrict all future activity to properties now currently owned by Mr. Dagley. The owner of Block 141 would have to apply for a Special Use Exception as a separate piece of property. All of this would be done as well as creating a Special Use District and by granting the Dagley's a Use By Exception for this district. The City Commission referred this proposal to the Advisory Planning Board for their input and comments. The Board was concerned with the visual effects of having a junk yard in section H and the fact that there was a master plan being worked up that would hopefully create a very nice future development in that area. The suggestion was made that a buffer fence be placed around the property. Gregg McCaulie made a motion that would have the city attorney create a one time only Special Use District for the purpose of accomplishing the intent expressed in the meeting of the committee appointed by the Mayor. Ruth Gregg seconded the motion. Candace Nordan requested an amendment to the motion requiring an opaque buffering fence. Guy Jenning asked about the legality of the operation by the Dagley's. Mr. Fellows stated that a determination had never been made but that the City felt it would be too costly to find out Advisory Planning Board April 15, 1986 Page 3 and therefore the proposal to settle as stated above. Guy Jennings asked for an amendment to the motion saying that if any portion is changed then the whole special exemption would be lost. Gregg McCaulie asked for the vote on the motion. There being no objections the motion passed unanimously. E. Hilary Thompson presented the final plat approval from the City Commission on the Ocean Walk project.for the Boards approval. Taking into account that the City Commission has already reviewed the plans and that the plans are in accordance with everything the Board had previously approved and recommended, Gregg McCaulie motioned to approve the plat as presented, Guy Jennings seconded the motion. Guy Jennings asked about the responsibility of the maintenance of the lake in the subdivision. Mr. Fellows stated that it would be the responsibility of the Homeowners Association. A question about the breakout of property taxes and fire and police protection also came up. Property taxes will probably be broken out on a prorata share by the tax collectors office. There was no immediate answer to the question on police and fire protection. Hearing no further discussion Chairman McCaulie called for the vote and there being no objections the motion passed unanimously. F. Ruth Gregg brought up the question of missing house numbers. There are several houses with missing numbers and in case of an emergency has caused problems. The City Manager stated that he would take up the question with the Building Department. There being no further business before the Board, Chairman McCaulie adjourned the meeting at 8:45 p.m, vidiegii.
