Exh 8KSK NOVEMBER 13, 2000 CITY OF ATLANTIC BEACH CITY COMMISSION MEETING STAFF REPORT AGENDA ITEM: 3TAIMayport Road Retention SUBMITTED BY: Jim .DATE: November ~, 2000 BACI{GROUND: The Jacksonville Transportation Authority (JTA) first made the City awaze of a proposed new retention pond to be located adjacent to Mayport Road in June of this year. The JTA had already chosen the location on the east side of Mayport Road directly north of the Hess station and south of the new Best Western Hotel under construction. This proposed pond has been brought to the City Commission's attention on several occasions since then and City representatives have met with the JTA on two occasions (September 12'" and October 2'7"') as well as written letters and had numerous phone conversations to convey the City's concerns about the way the pond would look on completion and to propose/discuss various alternatives. One of the most promising alternatives was to extend the pond behind the Hess station into vacant property which is also adjacent to the City's water plant. The JTA's engineers have considered the alternatives proposed by the City and have determined that most of them are not feasible. The option extending the pond behind the Hess property was eliminated because of a state law limiting the proximity of retention ponds to wells for public drinking systems. The City's well restricts the construction of a pond on the Hess property and the cost to relocate the City's well was prohibitive. While most of the alternatives would not work, the 7TA was able to "swap" some of the capacity needed in this new retention pond with other ponds being constructed as part of the Wonderwood project. Because the 7TA has been able to reduce the volume needed for this pond, the slope of the pond could be reduced 4: I and the proposed fence has therefore been eliminated from the plans. 8K NOVEMBER 13, 2000 While the fence has been eliminated, the "footprint" of the pond remains essentially the same and utilizes almost all of the property, leaving only enough for a maintenance berm around the outside perimeter. It is clear that almost all of the trees will have to be removed from the site and that there will be very little room for replanting. The 3TA will not be able to meet the City's tree mitigation requirements on site. JTA officials have indicated they believe there is a legal problem with TTA paying money into the City's Tree Mitigation Fund and have offered instead to provide for the equivalent amount of mitigation needed on other publicly owned property along the Mayport Road corridor. One possibility that has been discussed is the possible creation of landscaped medians on Mayport Road much like those that exist along Atlantic Boulevard. The TI'A is preparing a proposed interlocal agreement between the City and the JTA wherein they will commit to tree mitigation along other portions of the Mayport corridor. Final plans have not yeYbeen submitted to the City's Tree Board and it is appropriate for the Commission to hear their recommendation prior to taking any action on an interlocal agreement.
