WHEREAS, Thomas and Donnalea Goelz , owners of above described property, have applied to the Community Development Board for a Variance to the zoning regulations to allow an addition to an existing nonconforming building, and WHEREAS, the Community Development Board has considered the application and rendered a decision, and WHEREAS, It is the finding of the Community Development Board that the granting of such Variance will not be contrary to the public interest and owing to special conditions , a literal enforcement of the provisions of the zoning code will result in unnecessary and undue hardship not of the applicants creation , NOW THEREFORE, BE IT ORDAINED BY THE COMMUNITY DEVELOPMENT BOARD OF THE CITY OF ATLANTIC BEACH THAT: 1 . The requested Variance is granted subject to provisions and conditions described below. 2 . The Owner of the real property described below is hereby granted a zoning Variance from the provisions of Chapter 24 , Section 24-85( 1 ) of the Code of Ordinances of the City of Atlantic Beach, specifically to allow construction of an exterior open stair to the north side of the nonconforming garage apartment within the existing 3 . 4 foot setback.
