DATE: May 17 , 1993 BACKGROUND: Applicant has requested that the mini storage business that he operates at 2383 Mayport Road be re-zoned from CG commercial general to ILW industrial , light warehousing to permit him to provide the service of outside storage of automobiles in conjunction with his mini storage business . The CG zoning does not permit outside storage of automobiles although he has been conducting that service for some time unaware that he was in violation of the permitted zoning uses . 1 RECOMMENDATION: The Community Development Board unanimously concluded that , although there have been no direct complaints about Pan Am' s operation, the rezoning would open up considerable potential for heavier uses to encroach upon Mayport Road . The change of zoning from CG to ILW would allow outside storage of automobiles but would also allow bulk storage ,yards , heavy equipment sales and repair yards and even the possibility of concrete batching plants . Because of the potential problems created by such zoning on a busy road like Mayport Road the Board unanimously recommends denial of the requested re-zoning. Our intent was to provide covered storage for boats and recreational vehiclesbut the possibility of servicing the eight foot pipe arose and Pan Am Mini Storage, Inc. decided to forgo sinking steel pilings into the DOT easement. Pan Am Mini Storage, Inc. submitted detailed blueprints highlighting an outside open storage and rental parking area ` Which was signed and sealed by the City of Atlantic Beach. On the blueprints there are signatures, seals and dates indicating "In accordance with use by exception stipulations" . The letter received by Pan Am Mini Storage, Inc. on March 9, 1993 from Mr. Karl W. Grunewald, Code Enforcement Officer regarding violation of Section 24-111 concerned us and discussions with Mr. George Worley, II and Mr. Don C. Page 8 LOCATION OF PROPERTY AND GENERAL DESCRIPTION PAN AM MINI STORAGE is located at 2383 Mayport Road, Atlantic Beach, Florida. The property consists of slightly less than 4 1/2 acres of land upon which is situated a mini storage warehouse complex of several storage buildings, some of which are climate controlled year around, facility office and designated parking areas. The property is fully secured against intrusion by chainlink fence and is further protected Page 1 by an exterior lighting system. Management is resident on site. Ingress and Egress to and from the property is controlled through an entrance gate located at its Mayport Road access. A Florida Department of Transportation right of way runs in a general east-west direction within but parallel to the northerly boundary of the property. Parking is located within the above right of way. SURROUNDING PROPERTIES The property is bounded on the South by Atlantic Beach Water Treatment Plant No. 2, on the East by Sherman Creek and a barrier of trees (to the East of which lies the Fleet Landing development), on the North by a thickly wooded vacant lot (to the North of which lies the Waffle House property) and on the West by Mayport Road and the easterly boundary of the City of Jacksonville. The property is generally visible only from the Atlantic Beach Water Treatment Plant, to the South, and the City of Jacksonville, to the West. PROPERTY DEVELOPMENT The property was purchased as vacant land on October 9, 1987 by its current owner, Pan Am Mini Storage, Inc., a Florida corporation. Previously and in August 1987, the City of Atlantic Beach granted the existing ownership an exception to the property's zoning classification of Commercial General in order to construct and operate a mini warehouse storage facility. Subsequently and on December 16, 1987, the City of Atlantic Beach issued its Permit No. 9360 for the construction of mini storage facility with on site security on the property based on engineering and other drawings which, among other things, described a parking area within the area of the Florida D.O.T. right of way which at the time was basically an open ditch. This Permit reflected a valuation of $850,820.00 for the improvements to be made to the property. The Permit was issued subject to the approval of the St. Johns River Water Management District Page 2 which was obtained from the District pursuant to its issuance of Permit No. 42-031- 071ON on January 7, 1988. Approximately six weeks later, the Florida Department of Transportation issued its Drainage Connection Permit No. 2-JD-5986-2JDR (on February 18, 1988) which permitted Pan Am to construct and operate a 48 inch wide drainage pipe connection running 272 feet along the northerly interior boundary of the property and within the Florida Department of Transportation right of way. The DOT also permitted Pan Am to use its right of way for parking purposes. On March 22, 1988, the City of Atlantic Beach issued its Permit No. 9595 for the construction of a mini storage addition on the property. This Permit reflected an improvement valuation of$45,500.00 for the additional improvements to be made to the property. By August 1988 construction was completed. On August 22, 1988, the City of Atlantic Beach issued its Certificate of Occupancy for the property following which Pan Am commenced its mini storage business which included the storage of vehicles within the parking area described in the approved plans. VALUATION AND PROPERTY TAXES The property has a current valuation of $1,407,700.00 according to the tax collector. Last year, property taxes amounted to $33,308.59 including $3,747.86 to Atlantic Beach, $13,120.75 to Duval County, $12,376.50 for public schools, $503.96 to the Water Management District, $1,618.86 to Independent Special Districts, $1,866.05 for voter approved debt payments and $74.61 for F.I.N.D. Ownership anticipates little or no change in taxes for the current year. PROPERTY USAGES The property is fully built out as a mini warehouse storage facility. No additional improvements are anticipated on site and because of its great value and use as a mini warehouse facility no change in operations is considered likely. Page 3 ATTACHMENTS AND EXHIBITS Copies of the permits, certificates and other documents supporting the above narrative, including a site plan and photographs of the property, commence at Tab "A" hereto. CURRENT ZONING The property is currently zoned CG commercial general under Section 24-111 of the Atlantic Beach Ordinances. The City of Atlantic Beach granted Pan Am an exception to zoning under Section 24-111(c)(7) of the Atlantic Beach Ordinances permitting Pan Am to use the property for its mini warehouse storage business. REQUESTED ZONING Pan Am seeks to have the property rezoned ILW industrial light and warehousing under Section 24-112 of the Atlantic Beach Ordinances to permit Pan Am to store vehicles outdoors. Local and secure vehicle storage is very important to RV owners in Atlantic Beach who can no longer park them at home as well as to vehicle owners who must leave home for extended periods of time. The latter category, of course, significantly includes Navy personnel assigned to Mayport who have nop lace else to store their cars when their ships depart. ILW INDUSTRIAL LIGHT AND WAREHOUSING DISTRICT According to Section 24-112(a) of the Atlantic Beach Ordinances, ILW industrial light and warehousing districts: are intended for light manufacturing, storage and warehousing, processing or fabrication of nonobjectionable products, not involving the use of materials, processes or machinery likely to cause undesirable effects upon nearby or adjacent residential or commercial activities related to the character of the district." Page 4 Short-term parking of vehicles on the property, as well as other properties all along Mayport Road, is already authorized. Pan Am merely seeks to extend the authorization to longer term parking - vehicle storage - which certainly creates no additional burdens upon nearby or adjacent residential or commercial activities as precluded by the above Ordinance. NO ADVERSE EFFECT ON ADJOINING PROPERTIES There are no protected residential or commercial activities adjacent to two sides of the property; on the West is Mayport Road and the City of Jacksonville and on the South is Atlantic Beach Water Treatment Plant No. 2. In fact, the Water Treatment Plant itself would probably fall within the requested zoning classification if it were in private hands. Lying east of the property (separated by Sherman Creek and barriers of trees) lies Fleet Landing. The parking area is simply not visible from Fleet Landing and has no other potentially undesirable effects - no noise, no pollution, no impact whatsover. Finally, an unimproved and heavily wooded parcel lies on the north side of the property. This is the only adjacent property in Atlantic Beach from which any portion of the parking area could be observed - provided the barrier of trees separating the properties were first removed. Since permitted parking of vehicles already occurs, Pan Am submits no increased burden is placed on this adjoining property by authorization of parking in the nature of storage. PAN AM'S LOSS IF PROPERTY IS NOT REZONED Pan Am has a very significant investment in its property and business which it would never risk by engaging in a business practice inimical to its business interests including provision of what it believes to be the finest, cleanest and safest storage service around. Allowance of longer term parking simply enhances the service Pan Am provides its customers. Loss of this service means a dramatic loss of income for Pan Am. Moreover, the service relieves the pressure on Atlantic Beach residents and others Page 5 to locate an outdoor vehicle storage facility as well as the worry about damage or loss of stored vehicles since Pan Am's facility is state of the art, incorporating electronically controlled access, resident management, security service and controlled lighting, and designed to withstand a medium level hurricane. If the City of Atlantic Beach chose not to rezone the property, a potentially catastrophic result would occur. The great majority of both inside storage space and vehicle storage space is taken up by naval personnel assigned to Mayport. If they were required to move their vehicles to another facility (such as across Mayport Road in the City of Jacksonville), they would logically move their belongings stored in an enclosed unit as well. A mass exodus of storage customers means great, and until the ships return to Mayport, likely irreplaceable loss of income. As it stands, the revenue derived from vehicle storage in many months means the difference between being able to pay and not being able to pay the mortgage on the property. ■ CONCLUSION ■ The City of Atlantic Beach should grant the rezoning request submitted by Pan Am and rezone the property ILW to permit the continuation of vehicle storage on the property. It is both fair and reasonable to do so; Pan Am has described the parking area in every drawing submitted to the City for approval; has described the vehicle storage plan in the early meetings with the City and its various officials leading up to initial permitting and construction of the facility; and went to great expense to install the piping in the open ditch situate in the Florida D.O.T. right of way and then cover and pave it to complete the vehicle storage improvements (which expense Pan Am would not have incurred if vehicle storage was not to be permitted). Moreover, storage of vehicles on Pan.Am's property imposes no burden on any adjoining property nor does it detrimentally or adversely affect any nearby commercial activity which, of course, is the only activity along Mayport Road. Since outdoor vehicle storage is permitted for mini warehouse facilities located across Mayport Road Page 6 in the City of Jacksonville, refusing to authorize Pan Am vehicle storage by failure to adopt the requested rezoning for the property simply enhances a like business across the street (but out of town) at the expense of an Atlantic Beach business and significant taxpayer. 0 Respectfully submitted, PAN AM MINI STORAGE, INC. The City cited Pan Am for outside storage of automobiles which is not listed as a permitted use in the CG district. Outside storage ( of an undefined nature) is permitted in the ILW district. The applicants request for rezoning has been entirely attributed to the desire to continue the storage of automobiles, they have expressed no intention of undertaking any other use permitted under ILW zoning . RECOMMENDATION: The request was heard by the Community Development Board and after a thorough discussion a recommendation for denial was made and approved. The Board expressed strong concern that the potential existed for much more intensive uses to develop on this property in the future if the zoning were changed. The ownership and use of this property in the future cannot be guaranteed and the rezoning would legitimize the encroachment of Atlantic Beaches highest intensity zoning district on to Mayport Road. In the years 1988 and 1989, Pan Am Mini Storage, Inc. obtained permits from the Department of Transportation to ,begin piping, filling and paving several hundred feet for the benefit of the state and community at a cost exceeding one hundred thousand dollars to be incurred by Pan Am Mini Storage, ilnc. for the use of open storage. Our intent was to provide covered storage for boats and recreational vehiclesbut the possibility of servicing the eight foot pipe arose and Pan Am Mini Storage, Inc. decided to forgo sinking steel pilings into the DOT easement. Pan Am Mini Storage, Inc. submitted detailed blueprints highlighting an outside open storage and rental parking area which was signed and sealed by the City of Atlantic Beach. On the blueprints there are signatures, seals and dates indicating "In accordance with use by exception stipulations" . The letter received by Pan Am Mini Storage, Inc. on March 9, 1993 from Mr. Karl W. Grunewald, Code Enforcement Officer regarding violation of Section 24-111 concerned us and- discussions with Mr. George Worley, II and Mr. Don C. Two of the lots ( 1 & 2 , Block 80 ) contain grandfathered in storage units but are actually zoned RG-1 . The other lot and one half are vacant but adjoining existing storage units . RECOMMENDATION: The Community Development Board found during its deliberations that granting the proposed re-zoning would not further the comprehensive plan of the City in that the existing zoning was intended to become a buffer zone between existing commercial development along Mayport Road and the anticipated low density residential development to the west . Extending the commercial zoning would reduce the buffer and encourage further encroachment . The Board found that the existing use of lots 1 & 2 , Block 80 , pre-dated the zoning change , they are grandfathered in as long as they continue . Should that use cease , all future use of that property must be residential . Lot 1 and the east 20 feet of lot 2 , Block 79 are vacant and the Board determined that the existing RG-1 zoning is appropriate . Recommendation of the Community Development Board is to DENY the requested re-zoning . CITY OF ATLANTIC BEACH CITY COMMISSION MEETING STAFF REPORT AGENDA ITEM: Use-by-Exception for Pan AM Mini Storage SUBMITTED BY: George Worley, City Planner % DATE: October 4 , 1993 BACKGROUND: Pan Am Mini Storage desires to store operable automobiles outside of structures at their business on Mayport Road. The vehicles would be parked in designated parking spaces and stored both short term and long term. The Community Development Board heard this request and upon finding that the use would not be incompatible with adjoining uses recommended that the requested Use-by-Exception be granted with the following conditions attached: The exception be granted to Pan Am as owner and not to run with the land; That no storage of inoperable vehicles be permitted; That the Use-by-Exception be automatically revoked upon Pan Am' s second conviction by the Code Enforcement Board for storage of RECOMMENDATION: Approval with the above stipulations. Upon motion duly made and seconded the minutes were approved. OLD BUSINESS: I . Application for Use-by-Exception filed by Pan Am Mini Storage , Inc . to allow outside, on-site storage of vehicles at property located at 2383 Mayport Road. Terence P. Kane introduced himself to the board and explained that they filed the application to be included in their existing use by exception and that there were no additions or deletions fro7, t`_..e document previously submitted. After discussion, Mr . Frohwein moved to recommend to the City Commission that the use by exception be granted with the provision that upon the second conviction by the Code Enforcement Board for storage of junk, abandoned, and/or inoperable vehicles as defined by Atlantic Beach Ordinance and the Florida Statutes , the exception will be revoked. Pat Pillmore seconded the motion. Ruth Gregg suggested that the motion include the provision that the City check for violations at least once a year and/or that the use by exception be granted to the owner and not the property . After discussion, Mr . Frohwein amended his motion to include that the use. by exception be granted ,solely to the owner of the property. Mrs . Gregg seconded 'the amended motion and it passed unanimously . i I NEW BUSINESS I . Application for Variance filed by PBD, Inc. , to construct a home which would encroach the front yard setback at 2209 Alicia Lane . Safa Mansouri , representing PBD, Inc . , and Dr . W . Fleming , the owner of the property, introduced himself to the board and stated the variance was requested to construct a residence on an existing foundation which was originally constructed for a spec home . He stated that the additional space was to accommodate a three-car garage in place of the original two-car garage . After discussion Mr . Frohwein moved to grant the variance as requested and Mrs . Gregg seconded the motion. After discussion the chairman called for a vote on the motion and the motion failed on a vote of 2 - 5 . II . Application for Variance filed by Gloria Vaughn to construct. an addition to a non-conforming structure located at 1290 Ocean Boulevard. John Moore , architect for the owner , introduced himself to the board and presented pictures of the existing residenc_ as well as architectural renderings of the proposed construction . He stated the driveway would be eliminated in front of the property and the proposed construction would only require a small addition to the rear of the structure. After discussion Mrs . Gregg moved to grant the variance and Mr . McGowan seconded the motion. Mr. Frohwein asked if the bay window depicted on the drawing presented at the meeting was part of the application as i-11- projected tprojected another two feet into the requested setback and after discussion the applicant requested the board vete on the application as presented without the bay window . A vote was called and the variance was unanimously granted . III . Application for Variance filed by Al Mansour to construct an addition for restroom facilities to a nonconforming structure at 303 Atlantic Boulevard . Al Mansour introduced himself to the Board and explained that the existingcarwash would be remodeled and he would lease the property to open a pizza restaurant . i There was a discussion regarding the parking problems in the area and adjoining properties . The board was also concerne3 abcu` t;,e absence of the owner ' s consent to the variance . After discussion the application was deferred until the next meeting during which Lime the applicant could obtain the owner ' s consent and submit amended drawings . IV . Application for use-by--exception filed by Bahrairr Venus to operate a used car sales business at 1420 Mayport Road . Mr . Venus introduced himself to the board and stated that he would have approximately eight cars at a time for sale at the location_ and there would be no storage of inoperable cars . After discussion Mrs . Pillmore moved to recommend to the City Commission that the use by exception be granted. Mrs . Walker seconded the motion and it passed by a vote of 5 - 1 . Gregg McCaulie told the board that he had tendered his resignation and suggested the board elect a new chairman at the next meeting . Mr . Wolfson suggested that the board name a representative to attend the meetings of the City Commission wherein denied vc�.riance_ were appealed. One file (pertaining to phase I) contains the City's Plans Review Checklist which among other entries describes Section 24.161 Offstreet Parking as requiring 5 spaces with 55 spaces actually provided followed by issuing permit #355 for construction. This file also contains a Site Plan which shows 10 "boat spaces" as well as area described as "future parking" and an Atlantic Beach approval date of 01/11/89 stamped on the drawing. The second file (pertaining to phase II) also contains a Plans Review Checklist which describes Section 24-161 offstreet parking as requiring 2 spaces with the notation "3+ (boat storage)" in the spaces provided line. Conrad Cowart and Mr. Terence P. Kane, Principals of Pan Am Mini Storage, Inc. , appeared before The Atlantic Beach Community Development Board in July, 1987 after submitting a application for "Use by Exception" for a mini storage on Mayport Road. Also at this Community Development Board meeting were Mr. Lewis C. Medlin, Architect and Mr. William E. Tully III, P.E. of St. Johns Engineering, Inc. on behalf of Pan Am Mini Storage, Inc. to submit blueprints and documentation for the construction of mini storage buildings with outdoor storage for boats and vehicles. Following the Community Development Board's recommedation for approval of a mini storage facility which included rental offices and outside storage the City of Atlantic Beach Commision on August 10, 1987 after due public notice and hearing granted Pan Am Mini Storage "Use by Exception" with the understanding there would be no spaces rented out for offices or other retail shops or businesses. The enclosures that were submitted to the City of Atlantic Beach, City of Atlantic Beach Community Develop- ment Board, City of Atlantic Beach Commission, Florida Department of Transportation and the St. Johns River Water Management District all included outside storage. Pan Am Mini Storage, Inc. obtained permits from the city and state with the understanding that outside storage was to be included in and be a necessary part of storage operations which was clearly outlined in submitted documentation and presentations. Application for Variance filed by Robert and Leona Lowther to enclose a porch that will encroach the rear yard setback at property located at 251 Ocean; Forest Drive North. THE PAN AM PROPERTY SHOULD BE REZONED FROM CG TO ILW While the property has been placed in a CG zone, the City of Atlantic Beach has long recognized that the property is used for light industrial purposes. Reference is made to the City's Comprehensive Plan adopted in 1990 and approved by the State in 1991 which recognizes in its existing land use map which is pan of the Plan that the property is used for light industrial purposes. The City map is consistent with relevant portions of the Plan's narrative at page I-13 where the City affirms that: "With the development and expansion of the Mayport Naval Base, the City has also seen development of support services, heavy commercial and industrial land uses" and "The economic base of the City is derived largely from year-round residents the employment opportunities offered in the commercial/industrial corridors along Mayport Road and Atlantic Boulevard." The primary corridor along Mayport Road reflecting industrial uses on the City's "Existing Use Map" encompasses the Pan Am property. This certainly makes sense in light of the property's location immediately north of and adjacent to the City's Water Treatment Plant Page 1 No. 2. If that Plant were in private hands, it could only exist in an industrial or less restrictive zone. The Pan Am property should be rezoned ILW to bring it in line with the City's Comprehensive Plan. II. THE USE BY EXCEPTION TO CG ZONING PERMITTING "MINIWAREHOUSES" INCLUDES OUTDOOR, ON SITE STORAGE OF OPERABLE VEHICLES Section 24-160 of the Code defines the term "Miniwarehouses" as follows: "The business commonly known as miniwarehouses shall be utilized for the sole purpose of storage of tangible personal property. The above Code section was adopted by the City as Ordinance No. 95-79-18 at its Commission meeting on October 8, 1979 and was entitled "An Ordinance Regulating Mini- Warehouses The Conduct And Use Thereof: Providing An Effective Date." During the discussion of the Ordinance, Mayor Howell advised that the decision had been made not to include fencing and control of hours and that new rentals would be strictly dead storage only - not for purposes of conducting ongoing businesses. Certainly, vehicles are tangible personal property which may be stored in the business commonly known as miniwarehouses. The question, however, is not whether the ordinance term "Miniwarehouses" encompasses outside storage of vehicles but whether the process of granting an exception itself authorizes outside storage, or parking, of operable vehicles. First, it is clear that the City makes no distinction between the term "parking" and "storage" pertaining to vehicles and is not concerned about whether parking or storage is for a fee or free. The terms are used interchangeably in Section 24-163(a) of the Code Page 2 prohibiting commercial vehicles from being "parked or stored" in residential districts; interchangeably in Section 24-17 of the Code describing "Parking lot" as "an open area used exclusively for the storage of motor vehicles, whether or not a fee is charged". Finally, Section 24-162 of the Code describes off street parking lots (meaning open places where one stores motor vehicles) as a "permissible use by exception in all districts where such lots are within 400 feet of a premises requiring off street parking." By definition, parking IS storage of vehicles. Second, it is also clear that the City includes off street parking as one of the matters which it must evaluate and approve in its grant of exception process, per Section 24-63 (4)(b) of the Code. Accordingly, once an exception for miniwarehouses is granted, provision for off-street, outside parking (or storage) of vehicles is likewise permitted as part of the approval process, subject to issuance of the building permit based upon plans providing, among other things, off street parking. In Pan Am's case, the off street parking area was shown and described as an open area within the bounds of the property to be used exclusively for the storage of motor vehicles - a parking lot. Pan Am's property files maintained by the City include, as to phase I of its construction, the City's Plans Review Checklist requiring 5 off street parking spaces but reflecting 55 spaces and a City approved Site Plan showing 10 "boat spaces" as well as a "future parking area". Pan Am's building permit for this phase was issued following the City's approval of the site plan and Checklist. The City's file on phase II of Pan Am's construction also includes the City's Plans Review Checklist requiring 2 off street parking spaces with the notation "3+ (boat storage)" as actually being provided. The attached and City-approved Site Plan reflects "10 Boat storage spaces" in this phase. It is the above spaces that are used by Pan Am to store vehicles for a fee. Given the City's interchangeable use of the terms "parking" and "storage" of vehicles (without regard to whether parking or storage is free or for a fee); its consideration (and approval) of off street parking as an adjunct to granting an exception for miniwarehouse use; and its own definition of such use as simply meaning "storage of tangible personal property" Page 3 without any limitation upon hours of operation; it is clear that the holder of such an exception, Pan Am in this case, is entitled to park or store operable motor vehicles on its property for a fee up to the approved storage limit reflected in the permitted documents and plans. Moreover, it is also clear that the City has recognized, implicitly or explicitly, Pan Am's outside storage of vehicles as being within the scope of approval pertaining to the City's grant of exception to Pan Am to operate a miniwarehouse business on its property. Pan Am advised appropriate City officials of its intended outside storage of vehicles including boats during the runup period leading to the City's grant of exception and that the parking or storage area was to be laid over the area of the drainage ditch running across the northerly side of its property once D.O.T. approval to install the culvert in place of the ditch and pave over the culvert area had been obtained. Pan Am bore the cost of these improvements to the extent of some $100,000.00 which certainly would not have been spent if outside parking in the area of the former culvert was not permitted. Additionally, Pan Am's approved plans for the property specifically reflected its outside parking. Pan Am has consistently used this area for outside parking since commencement of operations in the middle or latter part of 1988, all with the knowledge and at least tacit approval of the City. It has only been within the last few months that any question concerning Pan Am's outside parking has arisen in the context of a claimed Code violation. Pan Am submits that its previous 4 1/2 years experience in operations with the City since inception of its business is a far better indicator of the City's interpretation of the exception granted to Pan Am than the City's claimed Code violations respecting Pan Am's parking which has occurred only within the last few months. Finally, examination of other use exceptions to CG zoning reveals the City's awareness that vehicle parking or storage will occur. For example, Section 24-111 (c)(12) authorizes the sale of new and used automobiles and boats. Section 24-111 (b)(7) permits without exception an auto service station, minor repairs and a car wash. Certainly, vehicles will be Page 4 parked at an auto service station, some inside and some outside, pending completion of repair jobs. III. ALTERNATIVELY, ATLANTIC BEACH SHOULD AMEND SECTION 24-111 (C)(7) TO INCLUDE OUTDOOR STORAGE OF OPERABLE MOTOR VEHICLES WITHIN THE USE BY EXCEPTION PERTAINING TO MINIWAREHOUSES Since outside storage or parking of vehicles is at least an accessory use and within the approval process of the City in determining whether or not to grant an exception, the City retains the right to control the development of outside storage under this approach including the amount and type of such storage. Therefore, the City can make a case by case determination of limitations as to outside storage in its grant of exception. "The business commonly known as miniwarehouses shall be utilized for the sole purpose of storage of tangible personal property." II. Parking. Section 21-23. "No person shall park a motor vehicle on any street or right of way for a period of time in excess of seventy-two (72) hours." Section 24-162 "Off street parking lots shall be a permissible use by exception in all districts where such lots are within 400 feet of a premises requiring off street parking." Section 24-163(x) "Commercial vehicles of less than eighteen thousand five hundred (18,500) gross vehicle weight, and trailers of all types, including travel, boat, camping and hauling, shall not be parked or stored on any lot occupied by a dwelling or any lot in any residential district, except in accordance with the following requirements [ommitted as inapplicable]." Section 24-17 "Parking lot shall mean an open area used exclusively for the storage of motor vehicles, whether or not a fee is charged." Section 12-1(b)(7) "For any person, either as the owner or occupant of a building, structure or property to utilize the premises of the property for the open storage of any abandoned motor vehicle. . . ." [Declared unlawful as a nuisance] MEMORANDUM TO: FILE FROM: RAS DATE: July 16, 1993 RE: ATLANTIC BEACH COMPREHENSIVE PLAN --------------------------- The City of Atlantic Beach Comprehensive Plan was adopted by the City in 1990 and approved by the State of Florida in 1991. At page I-13 of the Plan, 1st paragraph, it is stated: "With the development and expansion of the Mayport Naval Base, the City has also seen the development of support services, heavy commercial and limited industrial land uses." Continuing in the 2d paragraph of page I-13 of the Plan: "The economic base of the City is derived largely from year-round residents the employment opportunities offered in the commercial/industrial corridors along Mayport Road and Atlantic Boulevard." The Plan recites at page II-10 that "The Naval Base is the single largest employer in Duval County." The "Existing Land Use" map which is pan of the Plan reflects that the Pan Am property is located within a light industrial area. The Map is dated 12/01/89.
