The property had no zoning restrictions at the time, but was legally a part of the Atlantic Beach Hotel Reservation. James Wagner, then City Manager, agreed that the placement of the structure was in accordance with any and all existing setback and zoning ordinances for single family residences and that these would be met even though they did not actually apply. He further agreed that, since this was a corner lot, the eastern boundary would be considered as a "side yard. " Under those terms, the structure was to be held back from 7th Street to conform with the front setback of 700 Beach Avenue (which actually fronts on 7th Street. ) The front door of 711 Ocean Boulevard, incidentally, also faces 7th Street. We have recently been notified that the building is no longer in compliance with the zoning rules which have been enacted since the original structure was built; and that a variance is required to add to the floor plan, even though that addition does not alter or interfere with any setback rules.
