Kosoy, Director of Public Works `~/ DATE: December 5, 2000 BACKGROUND: On October 9, 2000 the City Commission approved a 1=final Design Contract with Aikenhead and Odom, Inc. for the Stormwater Improvements in the Core City area. At that time, no Subconsultant Agreements were made part of the contract due to the City's desire to review the scope of these agreements further with Aikenhead & Odom and, thereby, minimize the cost to the City. By directly contracting with the subconsultants, the City saves administrative costs usually paid to the prime consultant, i.e., Aikenhead & Odom. After many weeks of discussion and negotiation, in a letter dated 11/28/00 Aikenhead & Odom has summarized the necessary Subconsultant Agreements to be approved by the City. The four Subconsultant Agreements include: Environmental Resource Solutions. Inc. (ERS) proposes to perform an environmental assessment of the effects on wetlands of lowering the normal water level in the Selva Marina Canal. Their proposal is dated 11!22/00 and is not-to-exceed $9,900.00. 2. Enoineering, Methods & Applications proposes to perform an assessment of the pollutant loadings on the lagoon to analyze the effect of the proposed improvements. Their effort will satisfy the St. Johns River Water Management District's concerns that no degradation of the lagoon system occur by the improvements to be constructed. Their proposal is dated 11/15/00 and is not-to exceed $10,000.00. 3. Robert M. Ancyas Associates. Inc. proposes to create a digital terrain model (DTM) accurate to 0.1 foot-. This firm purchased Sunshine State, Inc., who performed the original survey for England, Thims and Miller (ETM). A DTM was not needed at that time because the ETM design involved a full reconstruction of the streets with completely piped systems. Aikenhead & Odom's design will incorporate the full right-of--way and partial piping. Their proposal is dated 11/29/00 and is not-to-exceed $42,800.00. AGENDA #8D DECEMBEli 11, 2000 4. Ghiotto and Associates Inc proposes to provide new surveys for the following locations: Sherry Drive, Sherman Creek Canal, proposed Pump Station Site and Outfall at Water Treatment Plant No. 2, the Selva Marina Golf Course, Lagoon from the golf course to Plaza, City Hall, Howell Park, Seminole Road, and the ditch running north of 19th Street. in addition, Ghiotto proposes to provide control survey mapping for the lagoon/canal from Plaza to Mayport Road, right-of-way maps and legal descriptions for the south end of the golf course to the City right-of-way at State Road A-1-A. Their proposal is dated 11/20.00 and is not-to-exceed $31,065.00 for the additional vrork recommended at this time. The not-to-exceed total for the four Subconsultant Agreements is $93,765.00. BUDGET: Funding far these Subcontultant Agreements is budgeted in FY 2000-01, Utilities Funds. RECOMMENDATfON: City Commission authorize City Manager to sign the four Subconsultant Agreements. This is a predominantly hourly proposal with aNot-To-Exceed amount of $9,900. We agree with the content of this proposal and recommend proceeding with a PO for this amount. 2. You are in receipt of the sediment transport and pollutant loading assessment proposal from Engineering Methods. This is a predominantly hourly proposal with aNot-To- Exceed amount of X10,000. We agree with the content of this proposal and recommend proceeding with a PO for this amount. 3. You are in receipt of a survey proposal from Robert M. Angas Surveyors for "Supplemental Topography". This is a lump-sum proposal for survey updates and development of a deftni*ave digital,t~.. model of all the Core City streets. I offer comments on this effort as follows: a. Part of this surveying effort involves updating the base survey done for the ET&M design by determining what changes have been made in above-ground facilities since that survey was done in 1997. Since the original survey was accomplished by the predecessor survey firm to Angas, they aze in a much better legal position to accomplish this "update" than Ghiotto. b. More importantly, and in accordance with agreements made during our detailed engineering design scope review some time back, this effort involves obtaining a higher level of detail within the Core City street right-of--way's than had been required for the previous design. The current proposal utilizes the streets, and in some cases the entire right-of--way, for drainage conveyance. While this will save significant construction cost and will substantially reduce impacts to the community, it also requires a much higher level of analysis and detailed information to adequately design a workable system. We concur with this proposal, and recommend proceeding with a PO in the amount of $42,800. 4. You are in receipt of a survey proposal from Ghiotto (dated November 20) for the remainder of the currently anticipated survey effort. Development of the scope and fee for this effort has been a long and arduous process, and even at this point there are items within this proposal which need to be postponed or eliminated. I offer the following comments and recommendations: a. Items A through I inclusive total $30,650. These are al] required efforts, the fees for each item are well within anticipated ranges, and we recommend proceeding with all of these items. b. Item J, Control Survey Mapping, is a $25,600 item which will obtain all the .record and field information on existing plats and properties which lie along the entire length of the Selva Lagoon and Sherman Canal outfall systems from City Hall to A-1-A at Puckett Creek. You and I have reviewed this item in explicit detail with Mr. Ghiotto, and we have both come to the conclusion that this is a substantial and necessary effort, and that the fee is warranted. We therefore recommend proceeding with this item. a Item K, Right-of--Way Maps, will develop all the existing inforrsiation gathered in Item J above into individual property and/or easement acquisition maps to obtain the necessary right-of--way or easements over the lagoon and canal system. This item has been separated into two sub-groups at your and my request, as follows: i. Item K-1 applies to all the properties adiacent.to the canal/lagoon from the. north right-of--way of Plaza north to the south limits of the Selva Marina Golf Course. This area of the lagoon is much wider than the northern portion, and sedimentation is not as significant a hydraulic concern in this azea. It is also possible that acquisition of easements with no acquisition costs other than recording of documents may prove more difficult in this area. For this reason, we are recommending postponing a decision on this item until a determination is made about the ability to obtain easements for the cost of recording of documents. This item is $10,000, and if it is determined at a later date to be advisable, we have no objection to the fee amount for tlae level of effort required. Obviously there will need to be some reasonable time period for this determination, and associated expectation of this same fee, which can be discussed in the neaz future. Item K-2 applies to all the properties adjacent to the canalllagoon from the south limits of the Selva Marina Golf Course north to the canal outfall at A-1-A at Puckett Creek. We are all in agreement that this portion of the drainage system will certainly require some form of maintenance dredging efforts to accomplish the required drainage objectives ofthe entire system. This item is for $14,000, we consider this to be an acceptable amount for the proposed effort, and we recommend proceeding with this item. d. Item L, Optional Services, includes an array of items which I discuss as follows: i. L-1 is an initial field investigation to allow Ghiotto to develop a hard value for the work required which we are proposing to be accomplished by Angas per above Item 3 of this letter.. This item is $8,500, and we do not recommend proceeding with this effort. ii. L-2 is to develop a digital terrain mode] of gaps in the minimal existing berm on the west side of the Lagoon along the interface between the lagoon and the wetlands and extending from Plaza to the south limits of the Selva Marina Golf Course. This effort may be required, but a determination of the need for this will depend on the environmental assessment, and a subsequent geotech assessment, all of which will be developed in the neaz future. For this reason, we are recommending postponing a decision on this item until these necessary determinations are made. This item is $10,450, and if it is determined at a later date to be advisable, we have no objection to the fee amount for the level of effort required. It is possible that only a portion of this effort will be required, and this will be negotiated at the future date when all required information is available. iii. L-3 is Ghiotto's "start-from-scratch" alternative solution to the problems associated with using another survey firm's old base survey information. This is $64,500, and we do not recommend proceeding with this effort. Overall, we are recommending a total effort at this time of $70,250, Items A thru 7 and K-2. Ghiotto has a current balance of $39,185 remaining from our initial survey anticipated efforts which was never used. We therefore recommend either increasing the existing PO, or issuing a second PO, in the amount of $31.065. If all other survey work, which we are currently recommending be postponed pending further investigation, is ultimately determined to be necessary, there would need to be a future additional PO in a maximum amount of $20,450. The additional geotech services agreement with Ellis has not been developed at this time. This is not needed yet and is waiting on further environmental, survey, and design development before we know what we will need from tltem. They have utilized all their previous Purchase Order (PO) amount, so a new PO will be required. We currently do not anticipate that this will be a significant effort, hopefully not exceeding $5,000. The proposed system should enhance the existing chazacteristics of the Selva Lagoon by dredging existing sediments, providing for maintenance removal of fixture sediments, and developing a "treatment surge capacity" within the lagoon. It is anticipated that four large baffle boxes will be installed around Howell Pazk. These will be placed so that a large portion of the core city streets will drain to them including an area where no improvements aze planned. The WMD has indicated that we will need to assess the pollutant loading and provide documentation that after construction, less pollutants will be discharged to waters of the state than is presently being discharged. WMD personnell have indicated that they especially want documentation concerning increased pollutant loading due to street improvements. Proposed streets improvements will increase the pavement area and allow water to drain more quickly, however, a lazge percentage of the flow will be routed through baffle boxes. EPA has requested that two CDS units be placed in smaller basins, and another two "standard" baffle boxes be placed in similar basins to allow them to obtain compazative operational data. To answer the questions from the WMD we propose the following: Conduct a Literature review of all the latest research on baffle boxes (including 3560 CARDINAL POINT DRIVE, SUITE 103 J ACKSONVtLLE, FLORLDA 32257 TEL: 9 0 4/ 2 6 8- 3 2 0 5 AGENDA #8D DECEMBER 11, 2000 Mr. Jim Hanson November 15.2000 - Pase 2 CDS units) and their sediment removal rates. We will also look at recent reseazch on pollutants that are usually removed along with the sediment. 2. Estimate the square footage of additional pavement proposed in the plan and estimate the volume of additional pollutants to be expected to runoff in these areas. Subtract. the increased pollutants due to roaad improvements from the volume of pollutants expected to be removed by the baffle boxes. If the baffle boxes, as expected, have the capacity to remove more than the additional pollutants from the roads, overall water quality will be improved with this project. 3. Prepaze a brief letter report addressing the WMD concerns. 4. Answer questions that the WMD might have concerning our analysis. If questions are posed that require additional analysis such as a computer model, we will discuss the options with you and Mr. Aikenhead before proceeding. We will complete tasks 1 through 3 within three weeks after receipt of a signed copy of this letter and your notice to proceed. We believe it would be to your advantage to conduct this work on a time and cost basis; if the literature review and letter report aze accepted with no additional questions, the cost will be less than if a model has to be construcl:ed to prove that the water quality is being improved. The cost for Items 1 through 5 will not exceed $10,000 (ten thousand). Our hours will be billed at the fotiowing rates: TITLE HOURLY RATE Chief Engineer $115 Senior Engineer $85 Engineer $60. These fees represent a one time execution of each task and are based on estimates of Inan hours. Should these estimates prove in [he field to be significantly in error due to unforseen circumstances, adjustments to these fees may be necessary. Additional services may be done on an per hour basis. GENERAL CONDITIONS PAYMENT TERMS -Payment is due upon receipt of our invoice. If payment is not received within thirty days from the invoice date, Client agrees to pay a finance charge on the principal amount of the past due account of one and one-half percent per month. If one and one-half gercent per month exceeds the maximum allowed by law, the charge shall automatically be reduced to the maximum legally allowable. In the event Client requests termination of the services prior to completion, the Client shall pay all charges incurred through the date services are stopped..If during the execution of the services, Robert M. Angas Associates, Inc. is required to stop operations as a result of changes in the scope of services such as requests by the Client or requirements of third parties, additional charges will be applicable. Clientagrees to pay mobilization charges for any work ordered when, upon arrival of survey crew, job site is not prepared for crew to properly perform scope of services. LIMITATION OF LIABILITY -Client agrees that Robert M. Angas Associates, Inc. liability for any damage on account of any error, omission or other professional negligence will be limited to a sum not to exceed $10,000 or Robert M. Angas Associates, Ines £ee, which ever is greater. ENVIRONMENTALLY PROTECTED LANDS - Robert M. Angas Associates, Inc, shall not be held liable or responsible for the location or lack of location of any areas within ajob site that are considered environmentally protected or are restricted by City, County, State or Federa] restrictions. Robert M. Angas Associates, Inc. will, however, at the Client's request and expense locate such areas if they have been so designated with flagging by an environmental consultant and/or governmental authority. It is further understood that the Client shalt be responsible for any permitting required in these areas and shall hold Robert. M. Angas Associates, Inc. harmless for any losses or liabilities resulting from such permitting or regulatory action. INSURANCE -Robert M. Angas Associates, Inc. maintains Workers' Compensafion and Employer's Liabiity Insurance in conformance with applicable state law. 1n addition we maintain Comprehensive General Liability Insurance and Automobile Liability Insurance with bodily injury limits of 1,000,000/$500,000 and property damage limits of $100,000. A certificate of insurance can be supplied evidencing such coverage which contains a clause providing that fifteen days written notice be given prior to cancellation. Cost of the above coverage is included in our quoted fees. If addifional coverage or increased limitsof liability aze requued, Robert M. Angas Associates, Inc. will endeavor to obtain the requested insurance and charge separately for costs associated with addifional coverage or increased lunits. STANDARD OF CARE-The only warranty or guarantee made by Robert M. Angas Associates, Inc. in connecfions withthe servicesperformed hereunder, is that we wilt use that degree of care and skill ordinarily exercised under similaz conditions by reputable members of our profession practicimg in the same or similar locality. No other warranty, expressed or implied, is made or intended by our proposal for surveying services or by our furnishing oral or written reports. RIGHT'-OF-ENTRY- Client shall be responsible for obtaining rights of entry for Robert M. Angas Associates, Inc.'s employees to any properties included in this contract for purposes of performing scope of work duties. We will take reasonable precautions to minimize damage to the property caused by ouroperations, but we have not included in our fee the cost of restoration of damage which may result. tf Client desires us to restore the property to its former condition, we will accomplish this and add the cost to our fee. CONSTRUCTION LAYOUT - It is understood by the Client that Robert M. Howell Park Provide across-section of the main channel in the same location as one previously measured by England Thims and Miller, Tnc. (ETM). This is for verification of existing survey data. 2. Provide a topographic survey and DTM of the area surrounding two foot bridges located within the park. One is crossing the main channel at the South end of park and the second one crosses a side ditch coming from 5`s Street. 3. Provide topographic survey of the area of proposed baffle box located at the South end of Howell Pazk within the Right-of--Way of Pine Street. Control Survev Manning Upon review of record plats and various legal descriptions of properties along the lagoon/canal system, easements will be required to perform dredging of the lagoon/canal area from property owners on each side of the lagoon canal from Plaza to Mayport Road. As required by Minimum Technical Standards for surveys in the State of Florida, we shall provide a survey drawing which shall show a continuos Survey Base Line for the length of the project. Beginning at the centerline of Plaza, the baseline shall run North adjacent to the lagoon through Selva Marina, Northwest adjacent to the lagoon/cana] through the golf course to Mayport Road and then Northwest along the centerline of A-I-A to Puckett Creek. 'T'his map will document the field location of all recorded subdivisions with their easements, existing Right-of--Way lines and any condominiums along the route. More importantly, the survey shall locate top of bank of the lagoon canal to enable the designer to define the extent of proposed easements. This map will serve a base for any future taking oftemporary-construction easements, permanent drainage easements or actual Right-of--Way. And it provides control .needed by any contractor who will construct any improvements.
