Forsyth Street Jacksonville,FL 32201 Re: 455-461 Atlantic Boulevard Tree Removal Mr.Langley, Staff has reviewed the 2005 Tree Removal Permit (05-00031341) at 455-461 Atlantic Boulevard and the subsequent agreement dated December 14th, 2007 and the current site conditions. It is clear that all of the trees to be removed under the permit have not been removed to this day. This would reduce the amount of outstanding mitigation agreed to by the then owner in the agreement since the permit considered the removal of trees that have not been removed to date. It should be noted that Tree Removal Permits expire 12 months after issuance,which means this permit is expired and no existing trees as of this date can be removed under this expired permit. However, the agreement clearly defines the owner's requirement to meet the mitigation under the Tree Removal Permit. Because some of the trees authorized to be removed under the permit have in fact been removed, then mitigation for those trees removed remains a requirement pursuant to the Notice and Agreement of Mitigation, dated December 14, 2007 (copy attached). As a result, staff has updated the calculations to reflect actual removal. In total, 228 inches of trees were actually removed. Required mitigation for the 228 inches of trees removed at a ratio of 1 inch for every 2 inches removed results in 114 inches of outstanding mitigation. The required mitigation must be shown in a landscape plan submitted to the City and approved by staff prior to or as part of the approval of a building permit. The Certificate of Occupancy will not be issued until landscaping has been inspected by staff for compliance with the approved landscape plan per Section 23-24(a)(3). Please be reminded that should any further tree removal be desired on this property, a new application for a tree removal permit must be submitted to the City.
