Exh 6B~, ~~~ STAFF REPORT . ~8 1-11-q`~ AGENDA ITEM: Resolution certifying Beaches Habitat's compliance with City Land Development Regulations SUBMITTED BY: George Worley II, Community Development Director DATE: January 5, 1999 BACKGROUND: Beaches Habitat has requested the City Commission of the City of Atlantic Beach adopt a resolution certifying that Habitat's home building program is in compliance with the Comprehensive Plan and the Land development regulations of the city. Certification through this Resolution will allow Beaches Habitat to become eligible for participation in the State of Florida Community Improvement Act of 1980. This Act created a tax credit program for organizations ,rte participating in, or contributing to the redevelopment of economically distressed azeas. It is the intent of this tax credit to provide incentives to private enterprise to participate in community redevelopment projects. RECOMMENDATION: Staffhas reviewed the Comprehensive Plan and the Land Development regulations of the City and believes that Habitat's building program furthers the objectives of the Comprehensive Plan and complies with the regulations and intent of the Zoning and Building regulations. Staff recommends adoption of Resolution 99-2. WHEREAS, it is necessary and in the public interest that the City of Atlantic Beach certify that the Beaches Habitat Program is consistent with local plans and regulations in order to comply with the provisions of the Community Improvement Act of 1980; and ~' WHEREAS, the Community Development Block Grant (CDBG) income eligible areas have been designated as specifically targeted neighborhoods by~the City of Atlantic Beach; and WHEREAS, the Beaches Habitat program is a specific program designed to offer home ownership to low income residents in an effort to stem further decline in CDBG income eligible areas and should receive full endorsement and support from the City of Atlantic Beach; and WHEREAS, the Community Improvement Act of 1980, requires that a resolution be passed by the local government certifying that a project applying for approval from the State of Florida under the Act is consistent with local plans and regulations; now, therefore, NOW, THEREFORE BE IT RESOLVED by the City Commission of the City of Atlantic Beach, Florida: Section 1. The Beaches Habitat Program complies with all local plans and regulations for the improvement of the CDBG income eligible areas as designated by the City Commission of City of Atlantic Beach, Florida. This resolution shall be forwarded to the State of Florida, Department of Community Affairs, to enable Beaches Habitat for Humanity to participate in the State of Florida's Community Improvement Act of 1980. Section 2. This resolution shall become effective immediately upon adoption by the City Commission of City of Atlantic Beach. The tax credit is easy for a business to receive. Corporations located anytivhere in Florida that make donations to approved community development projects may receive a tax credit equal to 50 percent of the value of the donation. Businesses may take the credit on Florida corporate income tax, franchise tax, or insurance premium tax. Before malting a donation, please be sure it will qualify. A list of eligible organizations is available from the Office of Tourism, Trade and Economic Development (OTTED). To receive approval, a business donating to an eligible sponsor need only f le a request form tivith OTTED. ';~' In order to claim the tax credit, simply attach proof of the approved donation when you file your state tax return. More details on the approval process aze contained on page 4. Non-profit organizations and units of state and local governments may apply to become eligible sponsors and solicit donations under the program. Eligibility requirements are listed on page 2.
