Below is a recap of liens that listed in the City Clerk's office as being outstanding against 387 Skate Road. As you can see, only $605 is related to code enforcement, all other assessments are for weed abatement expensed by the City. These fines have accumulated to over $5,000 including the interest that has not been paid. Your request to appeal the liens to the Code Enforcement Board is not legally possible. The Code Enforcement Board cannot waive expense incurred by the City to abate overgrown property. However, on November 12, 2003, the Code Enforcement Board heard an appeal of fines assessed against the property. The appeal was not upheld because the property was not brought into compliance as directed by the board. A copy of the board's determination was sent to Ms. Hector and is attached, the board indicated at that time "no additional requests for extensions or appeals will be considered." To date, the property remains in disrepair and is unsafe. Please take the necessary action to secure the carport roof which has been leaning and is unstable. The roof has been in this condition for over a year and the property is open to trespass by vagrants and small children. He reported no new activity was being conducted on the premises, and the property was now in full compliance. (2). Case No.: 1331-02,Mrs.Valda Hector,387 Skate Road,Atlantic Beach; Code Enforcement Officer Sherrer reported that the illegal shed had been torn down and 1 the property was in full compliance. (3). Case No.:1270-02, Mr. Yoochun Won, 1480 Mayport Road, Atlantic Beach; Code Enforcement Officer Sherrer reported that Mr. Won was in full compliance before the last hearing was held. 4. New Business: Case No.: 1331-02: Mr. Lincoln Casimir, representing Mrs.Valda Hector, requested to appeal the fine that was issued on October 15, 2003, for failure to comply with Code Enforcement Board order. Mr. Casimir claimed there were extenuating circumstances. Mr. Casimir asked the Board to consider waiving the fine of$3,750.00 imposed on Mrs. Hector due to the fact that she had been in the hospital and was currently unemployed and had no money. He said he had been trying to help her and planned on starting to remove the shed material from the property this weekend. Code Enforcement Officer Sherrer recommended that the fine be held in reserve and if the property was cleaned up by the end of the month the fine would be negated. Board Member Shea asked Mr. Casimir how long it would take him to clean up the property. Mr. Casimir said he thought it should take about a week. Board member Hurd asked Mrs. Hector to address the board. Mrs. Hector apologized and said she had been trying to resolve the matter. A motion was made by Board Member Shea, seconded by Board Member Hurd, and unanimously carried to approve the recommendation of the Code Enforcement Officer to set aside the $3,750.00 fine until December 1, 2003 pending the complete clean up of the property. If it has been cleaned up at that time the fine would not be reinstated. 5. Miscellaneous Business: Code Enforcement Officer Sherrer asked the board members to review the copy of the Code Enforcement Investigation Report for October 2003 and asked if there were any questions. Board Member Breault inquired about the increase of vegetation violations. It was explained that due to a complaint to the City Commission, the Code Enforcement Officer investigated all of the City rights-of-way for excessive growth and obstruction. 6. Case No.: 651-01, Kelly & Ruth Wilson, 615 Atlantic Blvd., the City Commission granted the Wilsons an extension until September 2003 to present engineering plans for a new sign. Code Enforcement Alex Sherrer reported that Wilson & Wilson obtained a building permit for the new sign and the plans were approved. They have a year to complete the installation of the sign, and are in compliance. 1 4. Mr. Sherrer stated that Mrs.Hector did not sign for the certified letter that the City sent to her, and he posted the property. It was also reported that notification of the hearing was sent to Mr. Hector, owner of the property, who was overseas. Code Enforcement Officer Sherrer then gave the case presentation and his recommendations, which are attached and made part of this official record as ATTACHMENT A. It was reported that all of this information had previously been discussed with Mr. Casimir. At this time Chairman Sanders asked Mr. Casimir if he had any questions. Mr.Casimir stated that his sister, Valda Hector, pleads guilty to all charges and would like to be granted two weekends from the present date to tear down the shed that is in violation and return everything to normal. Board Member Shea asked Mr. Casimir if anyone was presently living in the shed and Mr.Casimir replied"no." Chairman Sanders asked if there were any more,questions before he declared the hearing closed and there were none. A motion was made by Chairman Sanders, seconded by Board Member Shea, and unanimously carried to close the public hearing. The fine was assessed while his ex-wife owned the property, now Mr. Hector is in possession. Mr. Hector will explain to the board why they should amend the fine. I understand he was away for several years and has just taken over the property. I have spoken with Mr. Hector several times and he has indicated he will be in town to make repairs. The attached photo indicates the building remains as it did several months ago. We will need a copy of the minutes imposing the fine and a copy of the Order imposing the fine for the meeting. I will coordinate this with Susan Gorman. If anyone has questions please let me know.
