The code#(s)and nature of the violation(s) discovered are: CHAPTER 12, SECTION 12-1 (6) STRUCTURALLY UNSOUND FENCE 3.The inspection was prompted as a result of a: Complaint Routine Inspection X Other 4. A violation notice was issued to the owner/occupant on: JANUARY 14, 2005 5. Notice to the owner-occupant was achieved by: Certified Mail X Hand Delivery Posting of Property. The method of service meets with requirements of Florida Statutes 162-12. 6. I did did not X speak with the owner someone in charge of the property concerning the violations. 7. Brief description: January 7,2005,during a routine patrol,Code Enforcement Officer Sherrer identified the aforementioned property fence to be falling down. After discussing the fences condition with the City's Building Official it was determined that the fence was dilapidated and should be removed and or replaced. On January 11, 2005 a Notification of Violation was mailed Certified Return Receipt and was delivered on January 14th allowing 30 days to remove the fencing. Mr. Nedeau, has instead made some quick temporary repairs that do not add to the stability or attractiveness of the fence. 8. The latest inspection was made February 17, 2005 was a result of following up inspection. 9. The violation(s) is still present X in compliance_. PAGE 2 CODE PRESENTATION SHttr 10. In order to achieve compliance, it is necessary to correct all of the violations and maintain the property: The fencing should be removed, as there is no requirement for replacing the fence, it's replacement is at Mr. Nedeau's option. 11. I do X do not have photographs of the property and violations as they existed on the property. They represent a fair and accurate representation of the property at the time they were taken. 12. I would estimate that 14 day(s) would be sufficient time to correct the violation. 13. Further Comments: Mr. Nedeau has been notified of the fences condition on 3 other occasions; December 2,2002, October 3, 2003, April 4'2004 and each time he has just thrown together a quick patch job along with some paint. The fence is an eyesore to the community and remains dilapidated and will undoubtedly fall down again if left as is. Additionally because of its general condition, this vacant property has been a source for attracting transients and the fences removal and or replacement would make it less desirable to questionable elements. Recommendations: Mr. Nedeau be found guilty for non-compliance, and be given until April 8, 2005 to bring his property into compliance and that a fine of$250.00 a day for 30 days for every day pass due. Furthermore, I recommend that per Florida Statute 162.07 (2), Mr. Nedeau be assessed the full administrative costs of$338.96 for conducting this hearing, and be given 1 month to make payment and that failing to make said payment, a lien be placed against the property of 105 6th St W for the total assessment plus all costs incurred for the filing of the lien. All lien amounts are to be made payable with interest at a rate of ten (10) percent per annum from the date of certification until paid. (a) It shall be unlawful for any person or business, to do, perform, have, allow, suffer or permit any act, occurrence or condition within the city which constitutes a dangerous, unsafe, dilapidated or unsanitary condition, which may be injurious to the health and well-being of the community. (b) It is hereby declared to be a nuisance, the enumerations of which are merely indications of the nature and type of acts, occurrences and conditions, and shall not be deemed to be exclusive: (1) For any person to cause or allow any animal carcass or any filth or substance to be collected, deposited, or to remain in any place to the detriment of public health. (2) For any person to throw, deposit or discharge into or suffer to be collected, deposited or remain on or in any public or private property, house or building, sewer, or gutter, any filth, or rubbish of any kind. (3) For any person to allow, suffer or permit any lot, premises, or place of any kind whatsoever to become neglected so as to become a detriment to public health by the depositing of filth or rubbish of any kind. (4) For any person to allow, suffer or permit stagnant water to accumulate either above or below the ground, or to allow the propagation of mosquitoes therein. (5) For any person to keep, herd, and feed any large animals such as but not limited to hogs, horses, and goats or any small animals in any manner which may be injurious to the health and well-being of any person due to noxious odors, noise, etc. (6) For any person not to post, secure, or safeguard any hazardous condition which may prove detrimental to any human being, whether in a building, on the premises of a building, or upon an unoccupied lot. This includes any abandoned wells, shafts, basements, excavations, construction sites, as well as structurally unsound fences or structures. (7) For any person, either as the owner or occupant of a building, structure, or property to utilize the premises of the property for the open storage of any abandoned or inoperable motor vehicles, refrigerators or other appliances, household furniture, glass, building material, building rubbish, or similar items. (8) For any person to allow, suffer or permit any building or structure which, by storm damage, fire, decay or other cause to become structurally dangerous, unsafe, dilapidated, unsanitary, or vermin infested so that it creates a hazard to the health or safety of the occupants or the public. (9) For any business owning shopping carts to allow such carts to be removed from its premises unless a written policy is in place for the effective retrieval of such carts. The written policy must include provisions for retrieval of shopping carts from public rights-of-way, apartment complexes, undeveloped lots, or other areas within the city, and for retrieval of shopping carts when brought to the attention of the owner by way of complaints from the public or the city. That Mr.Joseph Nedeau is the owner of the property located at 105 W. 6th St.,Atlantic Beach, Florida. 2. That notice was served on March 1,2005 and that he was present at the hearing. 3. That notification of the violation of Chapter 12,Section 12-1(6)for the Code of Ordinances for the City of Atlantic Beach,Florida were made and served on the Property Owner as stated in the Affidavit and Notification of Violation received by the Board as evidence in this hearing. CONCLUSIONS OF LAW That Joseph Nedeau owns a fence on said property that is in violation of Chapter 12, Section 12-1 (6)of the Code of Ordinances of the City of Atlantic Beach,Florida and has failed to correct such violation as of this hearing. ORDER Based upon the foregoing Findings of Fact and Conclusions of Law,and pursuant to the authority granted in Chapter 162,Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach,it is hereby ORDERED: THAT the Respondent has 30 days from March 9,2005 to replace,repair or remove the fence in violation. The Board recommends that Code Enforcement Officer Alex Sherrer meet with the Respondent before making repairs. THAT total compliance must be achieved at the end of 30 days or a fine of$25.00 per day may commence and shall double every fifteen days not to exceed$250.00 per day. Administrative fees of $338.96 will be deferred pending satisfactory compliance within 30 days. Failure to comply with this Order with the specified time will result in the recordation of this Order Imposing Fine,which constitutes a lien upon any real or personal property owned by the violators and may be foreclosed,and your property sold to enforce this lien. If such lien is filed,you will be assessed all costs incurred in recording and satisfying this lien. The Code Enforcement Board is authorized to foreclose, collect,or settle said lien using any legal or equitable remedies available,after three(3)months from the filing of any lien, which remains unpaid. This Order becomes self-executing upon an Affidavit of Non-Compliance being filed with the City Clerk's Office and a hearing shall not be necessary.
