Exh 8ISL n SELVA MARINA STREETS REPORT Several months ago, you asked the Leadership Committee to look into the issue of the privately owned streets in the Selva Marina area. Since that time, I have discussed the issue with various members of the City staff including Bob Kosoy and George Worley, and I have reviewed the paperwork and studies that have been generated by previous committees who have been assigned to study the issue (most recently in 1992). You are aware of the history of these streets...the developer built sub-standard streets that did not meet any known engineering or safety standazds. As a result, the City has never accepted the streets. People have been buying houses and moving onto these streets, often with no understanding that they own the streets. Most believe that the streets are city property and will be maintained by the city. When citizens on these streets have problems and they want repairs made, they find out that the city does not own them. The engineering study completed in 1983 concluded that the streets needed many improvements just to make them acceptable. With about a quarter of a million dollars (1983) of work, the streets would be acceptable, but not up to the 1983 Atlantic Beach standards for new developments. The study recommended cutting down numerous trees and changing several roadways and intersections. These recommendations were not acted upon by the developer, and to my knowledge, no action was taken. More recent evaluations of the problem, including a committee appointed by Mayor Bill Gulliford in 1992, did not find any easy solutions. They obtained legal guidance from the City Attorney, and they explored a variety of options, but they never made any decisions. The options have not changed significantly since that time. In my opinion, the reason for the indecision has been due to the political fallout that will be generated from making a decision. At the current time, if a minor repair is needed, the city fixes it. This can be done in the interest of public safety, and no one complains about it. However, the major repairs that will be needed in the future are going to be controversial and expensive. According to estimates contained in a January 10, 19921etter to the City Attorney, the estimate was over a million dollars at that time. Consider a few of the options: A. Let the residents who live there pay for upgrades through assessments. B. Let the residents living there form asuper-homeowners association to pay for repairs. C. Let the rest of the residents throughout the city pay for these roadways that serve a limited population living in Selva Marina. D. Let the residents simply donate or deed the roads to the city, which would require the city to make the upgrades and repairs (basically the same as ~, «c~,). E. Use Gas Tax Money for repairs (basically the same as "c") t :~ S R' ~ 'v` ~~ All of these options are going to meet with opposition. The suggestion has been made to alter the engineering standazds that were applied to the 1982 study, and find a more realistic and acceptable approach to the problem. It is probably not necessary to cut down eighty-one (81) trees if we make some changes in the standazds which are applied to the roadways. However, if we alter the standazds, we need to: 1. Identify which standards will be altered; 2. Justify the deviation from those standazds; 3. Have a new study conducted applying the new standazds; 4. Have the new study funded; 5. Determine what changes are necessary and how much money it would cost to make the changes; And 6. Identify a funding source and determine who is going to pay for the work (the same problem that we have today). Although this may the right long termed approach, it will require money and political support to get it moving. It may also be expected to be a lengthy process and generate considerable debate and controversy. Additionally, changing the standards will not change the facts...Example: The roads aze sub- ~~ standazd relative to their construction. I doubt that any alteration of the standards will alter this conclusion. I am attaching a variety of materials for your review. Most of them are quick and easy reading, and I will be available to discuss them with you in more detail.
