Linn, City Manager City of Neptune Beach - 116 First Street Neptune Beach, FL 32266 Dear Ms. Shaugnessy and Mr. Linn: TownCenter Agency would like to sponsor the annual "Dancin' In The Street" event to be held on Saturday, May 15, 1999. TownCenter has formed a committee to put on the event and would appreciate approval from both cities to hold the event. In order for the event to be held approval from both cities is required and if approval is given, the following streets are requested to be closed: (a) Atlantic Blvd. from East'Coast Drive to the ocean; (b) ocean Blvd. from Ahern Street to Atlantic Blvd.; (c) First Street from Orange Street to Atlantic Blvd. TownCenter requests the streets to be closed- from 4:00 a.m. Saturday, May 15th through 4:00 a.m. Sunday, May 16th. The event time is scheduled for 11:00 a.m. until 10:00 p:m. Music for the event will begin at 11:00 a.m. through 10:00 p.m. Mike Shackelford, who will be handling the music, will be instructed that due to the noise ordinance, the music will have to end at precisely 10:00 p.m. Saturday, May~lSth. Beer will be served from 12:00 noon until 10:00 p.m. Instructions to the volunteers will consist of no token sales after 9:30 p.m. to insure that alcohol sales end precisely at 10:00 p.m. By copy of this letter, we are enlisting the help of both police departments to insure that security is not a factor in this event. x ~~ Suzanne Shaugnessy Richard Linn January 4, 1999 Page 2 We will work separately with the police departments to insure that proper security is hired. By copy of this letter, we are enlisting the help of both public works departments by requesting that each City provide the necessary garbage cans for the event. I am requesting that each City provide one dumpster for the event. Also, I would like to enlist the help of both public works departments to aid in the clean up of the street. I would like to have a quote in writing as to what each City would charge to provide clean up for the event. We look forward to hearing from you soon. Linn, City Manager of Neptune Beach, concerning the Dancin' in the Street `99 event. It is important to point out that your letter should be addressed to the City Manager of Atlantic n Beach when dealing with permission to have a festival in this City. For your consideration I am enclosing a copy of the ordinance which covers festivals such as Dancin' in the Street. It is important that you review this ordinance and, within the next few days, I would suggest that you contact David Thompson, Interim City Manager, to discuss the possibility of his granting a permit for your festival. I am also sending a copy of your letter to the pity Commission of the City of Atlantic Beach, as well as the City Staffthat would be involved in this process, so that they are aware of your plans. Obstructing free passage prohibited; exception. No person shall obstruct the free passage of persons or vehicles over any street, sidewalk or other public way by any means whatsoever, except pursuant to a permit issued by the city manager, and only in accordance with the terms of the permit and any conditions attached thereto. Sec. 19-2. Digging up streets prohibited; exception as to public utilities; permit required of public utilities. No person shall dig into, remove, tear up, deface or damage in any mariner tivhatsoever, except for purposes of city authorized repair, either the surfacing or shoulders on or of any , street, avenue, way, driveway, roadway or pathway on any public property of and in the city, or on any property over or upon which the city may now or hereafter be possessed of any ~"~, easement for any type of public transportation, travel or service; provided, this section shall root be construed to apply to any public utility such as electric, gas, water, etc., system which may desire to lay, remove, repair or replace pipes, wiring, or cables, place poles, conduits or meters or install any other necessary equipment requisite to the proper and efficient use of the public utility. A public utility desiring to do any such work shall first procure from the city manager a permit for such operations. (Code 1970, § 22-4) ' Sec. 19-3. CIosing of streets for various events. The city manager is authorized to close streets for various events. The city manager will discuss any such closing of streets with the police chief and notify the city commission begore authorization is given. Supp. No. 18 1107 r •~ § 19-4 ATLANTIC BEACH CODE . Sec. 19-4. Special events. All special events which are held on public property must adhere to the following rules and regulations: (1) All special events taking place on public property must have a permit from the city manager before any such events take place. The city manager may attach to the permit those requirements he may deem necessary to protect the public and city's interest. (2) All parties interested in staging a special event must provide insurance for the event in amounts set by the city manager. The [parties staging such] event may be required to take out additional insurance naming the city as the beneficiary. (3) All parties staging an event may be subject to a performance bond set by the city manager to insure [that] the City Ordinance Code and permit requirements are ' upheld by the event. (4) All requirements set by the city manager as part of his written approval of the event must be upheld by the event. Failure to do so may result in a closing of the event by the public safety director or the police chief. (5) All special events permitted by the city manager must be sponsored by a nonprofit ( corporation for a charitable purpose. Any special event to be held by a for-profit corporation must have prior approval by the city commission. (6) Before any request for a special event is permitted, those responsible for the event must fill out an application form available through the city recreation department. (?) All financial information and records which may be related to the event will be made available to the city finance director for his or her review. (S) All parties staging a special event are required to abide by the City Code and the Florida Statutes. Failure to do so will require the event to be cancelled. Lighting requirements on premises. Each vendor licensed to sell alcoholic beverages in the city, during all times his premises are open for business or in which members of the public are admitted, shall maintain not less than five (5) footcandles of light in all parts of his premises to which members of the public are admitted and where the sale ofthe beverages is made or the beverages dispensed or consumed. It shall be unlawful for any such vendor to sell, offer for sale, serve or dispense or permit to be consumed any alcoholic beverages upon part of his premises unless the same is then and there lighted with not less than five (5) footcandles of light: (Code 1970, § 3-5; Ord. No. 10-80-13, § 3-9, 4-28-80) Sec. 3-10. Consumption on vendor's premises. It shall be unlawful for any person to consume any alcoholic beverages on the premises of any licensed vendor except within: (1) The building which is the address of the licensed vendor; or (2) Within a recreation area contiguous to the building, and maintained and controlled by the licensed vendor exclusively for recreational purposes including but not limited to golf facilities, tennis facilities, swimming facilities, or other recreational purposes. Former § 3-10 was concerned with the use of sound-producing equipment outdoors, and derived from Code of 1970, § 3-6, a.nd Ord. No. 10-80-13, § 3-10, adopted April 28, 1980. ~~ Sec. 3-11. Consumption, possession of open container upon public property. (a) It shall be unlawful for any person to consume alcoholic beverages upon the public properties within the city, or for any person to be in possession of an open container of an alcoholic beverage upon the public properties t~'ithin the city. Such public property shall include, but not be limited to, roads, streets, highways, pazks and the ocean beach. (b) The city manager may, for special events, grant permits for the consumption of beer and wine and the possession of open containers of beer and wine upon public properties within the city, provided: (1) No alcohol shall be consumed out of doors in public or park areas, except [that] for up to four (4) festivals in any one (1) calendar year, beer and wine maybe consumed out of doors. (2) All public consumption of beer and wine upon city properties, as permitted hereunder, shall end no later than 11:00 p.m. " (3) The applicant agrees to comply with any reasonable conditions deemed necessary by the city manager to protect the best interests of the city and its residents.
