Thompson, City Manager BACKGROUND: The property located at 91 Donner Road has been acquired by Beaches Habitat. The property was owned by Mr. Lawrence C. Rolfe for years while Mr. Wilbur H. Ruffin lived on the property. Mr. Ruffin passed away in 1989. Although he had passed away, his utilities were still active, and we believe that the bill is largely comprised of minimum utility charges and subsequent late fees. In 1994, the property was being acquired by Habitat, and they requested that the City Commission forgive a lien in the amount of $3,840 which was for demolition on the property. Habitat purchased the property for the amount of the taxes owed on the property. The City Commission unanimously approved the forgiveness of the lien on February 14, 1994. Since that time, the City has determined that there was an outstanding water bill in the amount of $4,391 on the property, apparently dating back to the time when Mr. Ruffin was living on the property. Considering the circumstances, it is very doubtful that we will collect on the lien. Habitat would like to have the lien removed from the City books. RECOMMENDATION: We recommend that the City Commission forgive the lien on the property described above as 91 Donner Road. Habitat for Humanity has acquired the property at 91 Donner Road in Atlantic Beach, and they contacted Ms. King for a lien letter. She found an outstanding debt of $4,391 from February of 1994. The owner of the property is deceased, and the likelihood of collecting the money is slim. The City Commission previously forgave a $3,840 lien demolition lien on the property in 1994, and we anticipate that they will do the same for this lien. Before I place this on the Commission Agenda for their consideration, I would like to have your . approval that the Commission can lawfully forgive this lien under the circumstances. The lien was for a demolition and was the only lien filed with our office at the time. ~~ Beaches Habitat has now completed construction of a house on this property and have requested alien letter. For the last year or so we have been checking with the Utility Department and including any delinquent water bills on the lien letters and we have just learned that there is an outstanding water bill in the amount of $4,391.00 on this property. The bill was apparently created by Wilbur Ruffin and I don't know if he was the owner of the property, or a tenant.
