The engineering letter, from Matthew Lowe, P.E. and drawings from an unknown source cannot be
accepted for the following reasons:
1. This work was done without building permits or inspections. The work shown in the drawings
cannot be verified.
2. The engineering letter states that the embedment depth of the#5 vertical rebars, as built, is
insufficient.
3. The engineering letter does not provide design criteria, loads on the sign structure, or how the
sign structure will resist those loads.
4. The condition of the existing wood posts and depth of embedment were not verified.
5. The strength and type of concrete used were not verified.
6. This is not a typical design. If this application goes through plan review and second
submittals, calculations will be requested to show adequate embedment and encasement of
rebar and resistance to cracking from bending and twisting loads.

The sign support consisting of 6"x6"wood post encased in 12"x12"concrete is acceptable.The#5
rebar embedment, in all eight places, needs to be increased to 8" instead of the 6"embedment
submitted.Additional dowels may be added as required.See attached for comments.

BACKGROUND: The Commission heard this item at their regular meeting on May 22, 2017 where
they moved it forward to a Public Hearing on June 12, 2107.
At that meeting the Commission asked for two items at the next meeting.First the Commission asked
for engineering on the sign showing compliance with the Florida Building Code. The applicant is
working on this and expects to have the information before the next meeting.
Second the Commission asked for impacts on making the sign conforming to all codes.The applicant
is preparing a response to this as well and hopes to have before the next meeting.Staff will note that
a conforming sign will be about 4 feet shorter and will have the leading edge about where the back
edge of the existing sign is.This could also result in the loss or swapping of parking spaces as the sign
would move into the parking space to the north. This would free up space in front of the sign for
another space though.
Additional information may be available from the applicant in an amended agenda packet.
BUDGET: None.
RECOMMENDATION: To consider approval or denial of WAIV 17-0001.

BACKGROUND: The applicant, Sean Monahan, who is also the owner of 617 Atlantic Boulevard is
requesting a waiver from the sign code to allow an existing nonconforming sign to be modified at 617
Atlantic Boulevard.
The sign is currently nonconforming under a couple of code sections.Currently about half of the sign
is located in the right-of-way along Atlantic Boulevard and all signs in the right-of-way require
Commission approval as stated in Section 17-42(13).This means that sign also does not meet the
required 5 foot setback from property lines as defined in Section 17-29(c)(2)(c).The 12 foot tall sign
also exceeds the maximum 8 foot height allowed by Section 17-29(c)(1).
While this is an existing sign,modifications to the sign structure and face without a permit prompted
the City to issue a Stop Work requiring a permit.Staff informed the applicant that Section 17-51(3)(g)
requires all nonconforming signs to be brought into compliance when any change is necessary for
compliance with the Florida Building Code requirements.The addition of material to the structure
alters the engineering required to ensure that the sign can support its own weight and stand up to
wind events. Other sections of the code, including 17-51(3)(a, c and d) could also apply. Those
sections cover changes to;structural supports,height,and sign face by 25%or more.
Approval of this waiver would grant permission for the sign to remain in the right-of-way,crossing
the property line and for it to be 12 feet tall.
BUDGET: None.
RECOMMENDATION: To get Commission consensus to move item WAIV17-0001 forward to a
Public Hearing on June 12,2017.
