Dan,
This is why I am confused. To replace the bottom plate you could just
replace the bottom plate.However the design, and from what I understand
the work that was performed prior to the issuance of your permit, went
well beyond that and included adding additional wood and steel
reinforcement. I understand they were actually attempting to restore the
insufficient lateral support to the above unit. Accordingly, are you
telling them they have to remove everything beyond the new bottom plate?
Even though you and I don’t have an engineering egree, we both know
that the replacement for a bottom plate if that was really the issue is
just another piece of like wood instead of everything else that they
included.
What might resolve the lawsuit, in large part, would be if you required
their engineer to certify what post repair vertical support was created
so we could see whether that new work restores sufficient support going
forward or not.
It is really not much of an ask, and will likely put most of this
behind us. Would you please consider making such a request?

The permit, COMM20-0030, is limited to restoring the bottom
plate to its original strength, before the plate was drilled.
I have noted that on the approved plan and added a condition to
the permit (screen shot attached) noting that fact.
The repair design is signed/sealed.
I will require a statement from the engineer of record, for any
change in structural framing, that he/she has examined the other two
stories of the building and verifies that his/her design, regarding load
paths and bearing points matches the existing construction and meets the
requirements of the FBC.
I did not require that for this repair of a bottom plate with no
change in function or loads.
I understand that the Court Order includes mediation.
Can you tell me anything about that, such as the date of
mediation and who will be responsible for the design and repair of any
correction?

Dan,
To be clear, you are NOT requiring any engineer certification as
to the entire building in accordance with the policy you advised was
adopted? Are you requiring any engineer analysis of the vertical support
established by the design at to the Howell?s floor? If not why?

Atlantic Beach has issued a building permit for Cloister Unit 65, for
the repair of a wall bottom plate drilled through during a destructive
engineering investigation.
Please note that the permitted repair is only for repair
of the plate, not the correction of any other structural issue in the
building framing between units.
