The letter you describe sounds like just what is needed. If our neighbors decide to install gutters, we would be more than willing for the installers to put up scaffolding/ladders in our side yard. If they have another idea to suggest, we'll hope it's 1 a good one. When Bosco wanted access to our side yard for all the work on that home, we were perfectly willing to grant access. On the advice of our lawyer, we asked them to name us as "additional insured" on their insurance policy for the period of the work. It was a local lawyer, who assured us this is common practice here as it was in our last jurisdiction. Bosco initially didn't object to that condition,but later said that was documentation they couldn't provide us. That led to the peculiar situation of their trying to hang themselves off the neighbors' roof to avoid contact with our side yard. If there are gutter installers in our neighbor's future, we would hope the gutter company could provide some form of legal documentation protecting us against any liability issues while their people are working in our side yard. Assuming that's not an issue,we'd be delighted to have them. Regarding the light,it is a new installation that appears to have sprouted in just the last week or so. It's the silver-toned light perched on top of a pole that you see in the lower left of this photo at the very back corner of their lot. Thanks again for your attention to our problems. We plan to have the code enforcement officer write a letter to your neighbors, stating that no stormwater from any property is allowed to flow onto an adjacent property and to please rectify the situation. Gutters are the first option, but they may come back with another option. If we write that letter and they agree to install gutters,will you allow the installers to put ladders/scaffolding on your property? We've been leaving the pavers in place as is, but as the rains continue and more of them droop, that seems less and less like a good idea. The mere fact we've raised the issue of drainage from their roof(which they say they have no intention of doing anything about) seems to have inspired the Nackashis to install a new backyard light right at the NW corner of their yard-whose sole purpose seems to be to shine over the fence into our back yard. I'm very sorry I missed you and really appreciate your making the time to take a look. He said you planned to come back with someone from Public Works and I wanted to be sure you knew I spoke before I left town with Scott Williams, who said at the time he wanted to come by and take a look, though he was preoccupied with storm preparations. He may not be the person you had in mind (when I spoke with him it was clear he was seeing me because a more appropriate person was out of the office).
