In the absence of any objection from the City Commission, staff will start negotiations with the owner for the possible purchase of the property. Please find the attached correspondence regarding Donna Kaluzniak receiving an award under the Employee Recognition Program. Donna saved the City over $12,000 by determining that the City could file a Small Community Fee Waiver with FDEP. 3. Three (3) candidates for the City Manager position will be present for interviews on Saturday, July 24, 1999 starting at 10:00 A.M. The data conversion is taking place at this time, and implementation should be completed by the week of July 26, 1999. The existing software has been brought up to full Y2K compliance at this time, and it will be verified and certified by HTE after the work is completed. The contracts for Public Safety and City Hall networks have been completed with Purvis Gray and Company after a complete evaluation of the system, and installation and data conversion will probably begin within the next thirty (30) days. 7. The July 26, 1999 Shade Meeting was canceled, and it needs to be rescheduled to discuss Collective Bargaining issues. r t `" ... opinion relative to changing the Storm Water Project to a DesignBuild project, the City Attorney provided an answer the next day as directed. City Attorney Alan Jensen advised that changing the project to adesign/build project would be a substantial change in the work, and the purchasing process would require the City to go back to RFPs or bids. The City would not have the option to use the existing list determined by the City Commission under the Competitive Consultant Negotiation law. Relative to Jacksonville building water and sewer lines to areas served by Atlantic Beach, Bob Kosoy and the City Manager met with Jacksonville officials on 3uly 21, 1999 to discuss the matter. Jacksonville officials assured that they have no intention of providing service to our customers. However, they are trying to anticipate 20-50 years ahead. It is far more cost effective for them to put in lines while the bridges are being constructed, than it would be to try to add them later. They assured us, in writing, that they do not plan to provide service in competition with our utility systems. The resurfacing of Seminole Road was completed the week of July 12, 1999. However, Public Works Director Bob Kosoy advised the contractor that the work was not acceptable. After testing, the contractor agreed and had the roadway resurfaced, the week of July 19, 1999. Acceptance of the paving is still pending. 10. Please see the Staff Report from Deputy Chief John Campbell relative to the letter sent to the City Commission from Peggy Wallace. 11. The City of Atlantic Beach still owns two (2) fire trucks. Staff is planning to prepare a staff report to declare these trucks as surplus property so that they can be sold. If there are any objections from the City Commission, please notify the City Manager. Otherwise, staff will be placing this item on the City Commission agenda for August 9, 1999. 12. ~ Please see the attached letter from Lynn A. Westbrook, P.E. Chief of Jacksonville Streets and Drainage. This was in response to a letter from the City Manager to verify that Jacksonville was budgeting appropriately "for the repairing and resurfacing of Sherry Drive." Apparently, Jacksonville is not budgeting to do the complete reconstruction that is necessary on Sherry Drive. These leaves Atlantic Beach with several possible courses of action. This will be addressed in the near future through staff. 13. The landscaping plans for the lifeguard building are being reviewed by Beautification, Police, Lifeguards, the Sea Turtle, and others. When a final design is ready for approval, it will be submitted as a recommendation to the City Commission. 14. Please see the Dutton Island Construction Schedule memorandum from Public Works Director Bob Kosoy. The schedule points out that access to the island will be shut down for up to 12 weeks. This is necessary to remove the old culvert and to accommodate the sheet piling necessary to build the new one. We have contacted Landers-Atkins about this to assure coordination on the ongoing design work on the Island. As the time approaches when the island will not be accessible, we will let you know. 15. Please see the letter received from Ms. Pat Pilmore dated 7/20/99. You will also find my response to Ms. Pilmore attached. 16. Please see the attached letter and photographs to Jacksonville DOT regarding the sidewalks on Mayport Road. 1 ~ ~~ ( ~ 17. DEP Consent Order Staff is proceeding with cleaning and televising sewer lines to determine the existing condition of those lines, and to determine the best mechanisms to correct the infiltration problems. After this phase is completed, staff will be able to make repairs, upgrades, replacements, or other corrections. Most of these can be accomplished through existing contracts. Even if bids are required for some of the work, a substantial part of the work can be accomplished in compliance with the DEP consent order. Relative to the storm water projects for the rest of the City, the City Manager recommends revisiting this matter on August 9, 1999 when there will be a full City Commission. Decisions on storm water are important enough that they should be made with a full Commission if possible. When the City Commission makes a decision on storm water, staff can adjust its sanitary sewer project to integrate it as smoothly as possible into the entire project. Even if the storm water project does not proceed in the near future, the sanitary sewer and DEP work will be progressing toward an acceptable solution in compliance with the DEP order. Kaluzniak According to the guidelines in your October 8, 1998 memo regarding the Employee Bonus Program, "a contribution which results in tangible and definable benefits" to the City entitles an employee to be awarded up to 10°!° of the first year's saving with the employee that submitted the suggestion receiving 50% of the award ($2,000 maximum). l would like to submit the following for consideration: a) The Florida Department of Environmental Protection (FDEP) invoiced the City of Atlantic Beach's AB and Buccaneer Wastewater Treatment Facilities an Annual Regulatory Program Fee of $12,250 ($6,250 AB, $6,000 Buccaneer) which, in the past, we have paid on advice of the City Attorney. (Copies of invoices attached.) b) This year, with the suggestion and effort put forth by Donna Kaluzniak, we have reduced this amount to only $200 ($100 per facility) by filing for a Small Community Fee Waiver. This results in a direct savings of $12,050. c) $12,050 (total first year's savings) x 10% _ $1,205 $1,205 x 50% _ $602.50. Through Donna's perseverance in researching ways to enable the City to save this considerable amount of money, it is my recommendation that Donna be entitled to the full award of $602.50. The Employee Bonus Program is established for the purpose of improving City operations and to provide recognition through bonus awards for employee contributions through effective and beneficial suggestions or through achievements and performance. The program is based upon three premises: (1) The success of the City government depends upon the ability to create and maintain a team spirit among the staff. One of the best ways to motivate employees to become a strong and cooperative group is by recognizing and rewarding their achievements publicly and promptly. (2) Employees seek recognition and distinction regardless of their grade or status. They need to feel that the work they are doing makes an important contribution to the City. Personal recognition and awards for suggestions and special work efforts help fill this need. (3) Effective use of bonus awards can result in increased productivity, better quality work, less waste, and more efficient operation of the City Government. SCOPE. All employees of the City of Atlantic Beach are eligible for awards under this program except for the following: ' City Clerk City Manager Director of Public Safety Director of Finance Director of Public Works TYPES OF AWARDS. A bonus award is a monetary award granted to individuals or groups in recognition of a contribution which results in tangible and definable benefits. The contribution may be for one of the following: (1) Suggestions. (2) Superior achievements. (3) Special acts or services. SUGGESTIONS. (1) General. (a) A suggestion is a constructive idea submitted by an employee or a group of employees that proposes a method of doing a job better, faster, or cheaper for the City Government. A suggestion may propose ways to improve significantly: - Services to the public, quality of products, procedures, tools, machines and equipment protection of property, safety; Page 1 - Combine operations, materials, methods, records, reports, forms; - Eliminate unnecessary work, duplication, breakage, waste; - Devise new tools, equipment, machines, and new applications of old ideas; - Save manpower, material, time and space; or -Reduce costs of material and services. (b) Suggestions must present a specific area of improvement, a workable solution, and must be fully documented. ' (c) Suggestions within the suggester's job responsibilities should normally be outside of the employee's "normal" expected accomplishments so that they warrant special recognition, have City wide application, or result in significant savings. (2) Procedures. (a) Suggestions must be made in writing and submitted directly to Human Resources on the Suggestion Form. (b) Human Resources, after recording receipt of the suggestion, will forward it to the appropriate department head by use of the Suggestion Evaluation Form so they may evaluate the merits 'of the suggestion and recommend its adoption or nonadoption. A recommendation for adoption must be supported by a statement as to how, when and by whom implementation will be effected and an estimate of benefits. A recommendation for nonadoption must include detailed reasons therefore. Since comments are used by Human Resources in replying to suggestions, it is necessary that a reasonable explanation be offered that will encourage, rather than discourage, future participation. (c) Human Resources will forward suggestions to the City Manager for final approval or disapproval. (d) If approved by the City Manager,.the suggestion shall be returned to the appropriate department head who will then implement the suggestion on a trial basis. After a trial period of ninety (90) days, the department head will report to Human Resources the results of the trial, including the efficiency of the suggestion, the amounts saved to that point, the savings projected through the next nine months and a recommendation for adoption or nonadoption. (e) Based upon the information provided by the department head, Human Resources shall calculate the award and forward it, together with the responsible department head's report to the City Manager who may adopt, reject, or extend the trial period. (f) Suggestion awards are based on the estimate of the first year's savings that will be realized as the result of adoption of the suggestion. The award shall be ten percent (10%) of the savings with the maximum award of $4,000. (a) When a supervisor observes that the performance of one, or a group of employees, has been so superior that significant dollar savings to the City have resulted, they must fully document such performance and submit, in writing, full documentation including the amount, and how the savings resulted, in a recommendation through their department head to the Human Resource office. (b) Human Resources shall forward the Superior Achievement Award request to the City Manager for final approval or disapproval. (c) Superior Achievement Awards are based on the estimate of the first year's savings that will be realized. The award shall be ten percent (10%) of the savings with the maximum award of $4,000. (2) Procedures. (a) Recommendations for awards for special acts or services must be fully documented and submitted in writing through the department head to Human Resources within 30 days of the act or circumstances. (b) Human Resources shall forward the Special Act or Services Award request to the City Manager for final approval or disapproval. (c) The award for tangible, or intangible, benefits resulting from a special act or service shall be determined by the City Manager or City Commissioners. Campbell Subject: Letter from Peggy Wallace Back r~ ound• Reference the letter sent to the Mayor regarding complaints of traffic speeding on Ocean Blvd, and a request for speed bumps. In the letter Ms. Wallace mentions two incidents that happened in January of this year and one in June of this year. The first was a speeding vehicle that ran into Ms. Wallace's yard and ran over her dog. The second was an impaired driver that ran off the road, into a neighbor's yard and smashed the trashcans. Ms. Wallace stated she observed this second incident. I have checked the police records for January 18, 19, and 20 and neither of the two above incidents were reported to the police. Ms. Wallace also recounted an incident that happened on June 18, 1999. She stated that a car ran a stop sign and hit asix-year boy. searched the police records for June 17, 18, and 19 and found no record of this incident either. I contacted the mother of the boy that was reported to have been hit by the car. The mother's name is Ms. Tammy Slattery. She told me what had taken place. She said she and her son were returning from the beach at the13~' Street beach access. She said her son saw an ice cream truck and asked her to buy him some ice cream. She told her son she would, and her son began to run toward the ice cream truck, which was on the other side of the street. She told her son to wait for her and not run between the parked cars into the road, but he ran between the parked cars without stopping or looking into the path of a moving vehicle. She said that car had rolled through the stop sign and did not make a full and complete stop. She said that the driver stopped and told her that she should keep better control of her child, and Ms. Slattery told the driver that she had rolled through the stop sign. The driver of the vehicle then drove off. Ms. Slattery said that after her conversation with the driver, her sori was standing on the other side of the street and was yelling for her to hurry and get him his ice cream. Ms. Slattery said at that time she did not think her son had been hit by the car, she thought he made it across the street just in time. Ms. Slattery said a person came up to her and told her that her son had been hit by the car and knocked down. Ms. Slattery said that she checked her son and he had a small "road rash" on one leg and a small bruise. She said that she did not call the police and report the incident, but said that now she realizes she probably should have taken her son to the hospital to be checked out and reported the incident. (~~> We conducted aspeed/traffic analysis on Ocean Blvd, in March of this year at the request another resident in the area. We did aspeed/traffic analysis in the 800-900 block of Ocean Blvd. from March 23 through March 26, 1999. At this time we tracked 6,723 vehicles over the three days and found less than one percent (.46%) of the tracked vehicles were traveling over 10 MPH. over the posted speed limit. If you wish we can conduct another speed/traffic analysis in the 1300 block. My dog died. The same afternoon a car traveling north on Ocean Blvd, ran off the road onto the grass in my neighbor's yard and smashed their trash cans. I w.as in my driveway and saw the car drive through the stop sign at 12`~ St. and continue..•The driver was impaired. On June 18, 1999, a car ran a stop sign and hit Austin Slattery, a six year old child~who lives at Ocean and 13`~ Street. You may reach his mother,.Tammy Slattery~at 249-6995. There are 10 children that live on the 1100 block of Ocean Blvd.and approximately 25 kids that live within 3 blocks in the same area. I want to have speed bumps installed an Ocean Blvd. to make it a safe place for the kids to live. The type of speed bumps that are installed on Beach Avenue between 17`~ and 19`f' Avenues which are cut out in the center will allow bicyclists to continue biking smoothly and would accomplish the objective of slowing down the speeding cars. What is the process to get speed bumps installed? I will be glad to irritate and drive this process. I want it done before another child gets hit by a car. The engineering lab data, provided by your consultant and included in your July 7, 1999 letter, indicates an inconsistency in how the road was initially constructed. For example, asphalt surface course thicknesses that vary from 1 'h inches to 6 inches confirms this. Also, with auger borings identifying the presence of roots in the base, this fact also confirms that sound engineering or construction practices were lacking in the initial placement of this road. Our commitment is to perform repairs, but not the reconstruction that was recommended by your consultant. Our definition of repair includes restoring the road to the condition that existed prior to the utility installation, and we are prepared to meet that promise. The section of Sherry Drive under consideration is from Atlantic Blvd. north to Plaza. Our review included alt initial site visit by me. Ill the site visit, I observed several forms of distress includi;,g isolated small depressions of iiie roadway, depressions extending across the roadway at numerous locations which appear to be associated with utility crossings, acid some areas exhibiting water-related distress in tl~e forth of "alligator" cracking of tl~e asphalt and settlement of the roadway. As a result of the observations of the pavement condition, technicians from our office were dispatched to tl~e site and they performed pavement section cores at 9 locations along the above section of Sherry Drive. Tl~e results of the pavement section cores indicate the asphalt surface course generally varies in thickness from approximately 2-1/8 to 4 inches with a thickness at one location of 6-1/4 inches. There was no significant base course encountered below the asphalt surface course. Given that there is Flo base course below tl~e roadway and give~l the varying tliick~iesses of tl~e asphalt.surface course, it is our opinion there area t~vo alternates For tl~e repair of the. roadway. 1. Tlie first alternate would be to rebuild tl~e roadway wl~icli would include remoyinQ the existing asphalt, oyster shell acid soil materials below the roadway to achieve the grade below the new limerock base course. The exposed subgrade ~~•ould require stabilizatioci as well.. , • :. .. ~ .. 2. The second alternate would be to increase the thickness of tl~e asphalt surface course to create afull-depth asphalt pavement section since there is no base course. Giver tl~e minimum thickness of asphalt surface course measured in our cores af~d based oil our experie-ice, we estimate the additional asphalt thickness required for the full-depth asphalt section would be at least 3 inches. With the anticipated traffic data provided to us, tive could determine the a:tual required additional thickness of tl~e full-depth asphalt overlay for the roadway. ~Ve understand from our recent discussions t1~e area cannot tolerate increasing clip road«•ay fi~uslied grades by more than approximately 2 inches. Therefore, it is our opinion that tl~e only available alternate to repair to roadway is to rebuild the roadway with a pavement section of an asphalt surface course, a base course, and a stabilized subgrade. I know that you do not agree with my interpretation of the state law, and I can appreciate the fact that it will represent a financial cost to those citizens affected. However, it appears to me that you have misinterpreted some of the comments in the meeting. It was not my personal interpretation of the law that led to the notifications. Please recall that the, City Attorney stated repeatedly that the City was required by state law to make the notifications. If I had not sent the notifications, then I would be violating the requirements of the law. Although you may interpret my remarks as challenging you with my authority, I believe that it was clearly established that the state law was the authority upon which the action was initiated. Your suggestion about consolidating the Police Deparhnent into Jacksonville appears to be personally motivated. Please do not allow your anger with me to adversely affect the quality of life for 14,000 citizens in Atlantic Beach. At your request, I have instructed staff to send you a notification letter. If you have questions, please do not hesitate to call. I believe that there are some feasible solutions to this problem. While we realize that these needed repairs are due to the installation of gas lines by TECO/Peoples Gas, there has been no progress on the sidewalk replacements/repairs where the lines have been laid. This poses a potentially dangerous situation for pedestrians, bicyclists, etc. and several people who are confined to wheel chairs have called us to complain that they are forced to venture out onto Mayport Road to bypass these construction areas. In addition, there has been damage to the left turning lane on Rt. A-1-A to Mayport Road which has yet to be repaired. We trust these repairs will be underway in the very near future.
