Dear Mr. Padgett,
This letter serves as notification of suspected violation of Section 23-17(b) of the
Atlantic Beach Municipal Code of Ordinances, occurring on the property commonly
known as 888 Seminole Road and referenced above.
On November 13, 2007, Brien Mclnerny came to the City of Atlantic Beach and made
inquiry as to the process for obtaining a tree removal permit for the subject property,
stating the property had recently been purchased and that the new owner wished to
remove "six or so trees close to the house". In order to determine if a tree removal
permit would be required, I asked Mr. Mclnerny if there would be any renovations,
additions or other alterations to the property within six (6) months of the tree removals,
to which he replied that the owner planned to renovate the interior and repair or replace
the roof. I explained that, according to the provisions of Section 23-17(b) properties
undergoing development, redevelopment or renovation valued at $10,000.00 or more
and requiring a city -issued development permit would also require a tree removal
permit. I explained to Mr. Mclnerny the application submittal requirements and the
process by which the Tree Conservation Board would review the application.
Since that day, I have had no further communication with Mr. Mclnerny or anyone else
representing the subjection property, nor has a tree removal permit application been
submitted to the City of Atlantic Beach. However, the City has received several reports
of tree removals from the property located at 888 Seminole Road over the last seven (7)
months, and as noted below, several development permits, with a total value exceeding
$10,000.00, have been issued by the City Building Department.

Current Building Official Michael Griffin reported that you stated former Building Official
Dave Hufstetler gave you permission to remove trees without a valid permit and without
mitigation. However, I must inform you that the removal of regulated vegetation,
including trees, from properties lying within the jurisdiction of the City of Atlantic Beach
was not under the purview of Mr. Hufstetler, and thus he had no authority to waive those
requirements.
Thus, I am enclosing a tree removal permit application and requesting that you
complete and submit it for the purpose of obtaining an "after -the -fact" permit. At this
time, there is no cost associated with the permit application, however you will be
required to appear before the Tree Conservation Board to explain your actions, and
mitigation will be assessed based upon the number, location and size of trees removed.
Below you will find the dates, times and locations for upcoming Tree Conservation
Board meetings as well as submittal deadlines to be placed on the agenda for those
meetings.
