Chapter 24 -51 of City Ordinance 90 -01 -172 requires that an applicant seeking vested rights demonstrate an entitlement to such vested rights. I have no authority to exempt a project from the land development regulations of the City of Atlantic Beach, except in accordance with the terms of City law. My request for information is not intended to create any excessive burden to you, but rather to create a legally substantiated and defensible vesting determination in the event the City's vesting findings should be challenged. As I have previously stated, vesting is not a complete exemption from new regulations. In accordance with Florida law, a development project may be vested only to the extent that the vesting criteria are met and only to the extent that the proposed project does not comply with the new regulations. In other words, if your project is designed at 60% impervious coverage (and all three vesting criteria are otherwise met), then new regulations are later adopted that establish a 50% impervious limit, the proposed project would be vested for a maximum 60% impervious surface coverage. It would not be wholly exempt from any impervious surface limitation. This is why it is necessary for you to provide information which verifies the impervious surface of the projects as designed prior to November 26, 2001, the adoption date of the new regulations. Again, with regard to height limitation, the preliminary design you have provided, in drawings dated November 09, 2001, indicated that the proposed structures fully comply with the thirty-five (35) foot height limitation. There are no portions of the structures, or elements thereof, that exceed 35 feet in height. Accordingly, the City cannot find that this project is vested from compliance with this standard since height in excess of 35 -feet was not included within the preliminary drawings submitted to the City of Atlantic Beach prior to the adoption of the amended regulations. Furthermore, while Ordinance 90 -01 -173, which changed the zoning designation of these parcels from RG -1 (two - family) to RS -2 (single - family), included a provision to allow for the continued development of duplexes for a period of one year, that Ordinance specifically required that such development comply with all other applicable land development regulations. The current regulations allow only chimneys to extend above the maximum Height of Building. The third provision you have asked to be vested from relates to eaves and cornices. You have asked to be vested from the provision limiting eaves and cornices to not more than forty percent (40 %) of the width of the Page 2 of 2 February 12, 2002 COP required yard. As I noted in my earlier letter, this is not a new provision. Section 24 -84 (a) of revious zoning regulations contained the same limitation; therefore, there is no basis for vesting related to this issue. To summarize, the proposed development projects are determined to be vested as follows: 1. Construction of duplexes shall be allowed on the subject lots in accordance with the terms set forth within Section 6, Ordinance 90 -01 -173 (attached). 2. Maximum Impervious Surface shall be limited as set forth below. Lot 7, Block 3, Atlantic Beach Subdivision A: 62.17 percent Lot 9, Block 3, Atlantic Beach Subdivision A: 62.17 percent Lot 18, Block 5, Atlantic Beach Subdivision A: 54.06 percent (Proposed development also includes Lot 16 and west one -half of Lot 14; however, this proposed development complies with the Maximum Impervious Surface limit of fifty percent.) 3. The proposed development shall not be vested to construct height above thirty-five (35) feet. Height of Buildings shall be subject to regulations governing height as set forth within Ordinance 90 -01 -172, Zoning, Subdivision and Land Development Regulations for the City of Atlantic Beach. 4. Eaves and Cornices shall mean typical projections from the roof Structure of a Building. Eaves and Cornices shall not project beyond forty -eight (48) inches into Required Front and Rear Yards. Eaves and Cornices shall not project into Required Side Yards beyond twenty -four (24) inches, or forty (40) percent of the established Required Side Yard Setback, whichever distance is less. This vesting determination may be appealed to the City Commission in accordance with Section 24 -51 (c), which states: (c) Appeals of vesting determinations. An appeal of the denial of a vesting determination may be made to the City Commission by filing such appeal with the City Clerk within thirty (30) days of receipt of written notification of the denial. This section states "...Every permit issued shall become invalid unless the work authorized by such permit is commenced within 6 months after its issuance, or if the work authorized by such permit is suspended or abandoned for a period of 6 months after the time the work is commenced." The work on this project must not lapse for a 6 month period or the project will have to go through the permitting process again. This would require the project to be reviewed under the existing code, which is the 2001 Florida Building Code. The change in contractor on the project requires a letter from the owner of record stating the existing contractor and the contractor that will be replacing the existing. The new contractor will need to fill out an application to replace the original. Present were Richard Bell, Judith Jacobson, Barbara Mears, Carol Rockwood, Maureen Shaughnessy, Building Official Don Ford and Susan Dunham. 1. Call to Order The meeting was called to order at 7:10 p.m. 2. Recognition of Visitors None. 3 Approval of Minutes of Meeting of January 9, 2002: A motion was made by Board Member Mears, seconded by Board Member Rockwood and unanimously carried to approve the Minutes of the Tree Conservation Board meeting of January 9, 2002. 4. Old Business 1. 347 Third Street (East 45' of Lot 16 and the west % of Lot 14): The applicant, Mr. George Bull, Jr., withdrew this item from the agenda. 2. 347 Third Street (Lot 18 and the west 5' of Lot 16): The applicant, Mr. George Bull, Jr., withdrew t 6� from the agenda. Y l 3. 328 Second Street(Lot 7, Block 3, Plat No. 1, Subdivision "A "): Mr. George Bull, Jr., presented a letter of authorization from the owner of the property located at 328 Second Street. Mr. Bull advised that the house and pool would be removed. Mrs. Jacobson confirmed that 77" of palm tree were to be removed. �A motion was made by Board Member Mears, seconded by Board Member Rockwood and \ unanimously carried to approve the application and to direct the Building Official to issue a ermit for the removal of 77" of palm to be mitigated on site with 39" of palm. Mr. Bull stated that if he decided to install any other type of tree other than that of a palm tree, that he would brin his proposal to Building Official Ford for approval. 4. - 8-Second Street (Lot 9, Block 3, Plat No. 1, Subdivision "A "): Mr. Bell advised that there was only one tree on the lot and it was not protected. The Board approved the application. 5.A. New Business /Tree Removal Applications: 1. 1580 Beach Avenue: The applicant was not present to address the application. Mr. Bell stated that he spoke with the applicant who advised him that they would like to attempt to relocate the four cabbage palms on the property. A motion was made by Board Member Shaughnessy, seconded by Board Member Rockwood and unanimously carried to approve the application and to direct the Building Official to issue a permit for 1580 Beach Avenue to move the four existing protected cabbage palms totaling 44" to another area on the same property. Minutes of Tree Conservation Board January 23, 2002 Page 2 1055 Ocean Boulevard: Mr. Craig Seeley approached the Board to address his application at 1055 Ocean Boulevard. The Board advised Mr. Seeley that his application was not on the Agenda. After discussion with Building Official Ford, the Board determined that they would address this application. Mr. Seeley advised the Board that he would like to remove a 15.5" sabal palm. He stated that he would plant four 15 -foot cabal palms in the front of the lot. A motion was made by Board Member Mears, seconded by Board Member Bell and unanimously carried to approve the application and to direct the Building Official to issue a permit for the removal of 15.5" of palm to be mitigated with 8" of palm on site. 2. 2210 Oceanwalk Drive West: Building Official Ford advised that Mr. Beckenbach advised that he could not make the meeting and requested that the board address his application. The Board determined that the applicant was requesting removal of 22" of oak. A motion was made by Board Member Shaughnessy, seconded by Board Member Bell and unanimously carried to approve the application and to direct the Building Official to issue a permit for the removal of 22" oak to be mitigated on site with an existing 12" oak. 3. 3416 Ih Street: Building Official Ford advised that Mr. Hammill called from out of town yesterday to request that the Board review his application. A motion was made by Board Member Rockwood, seconded by Board Member Shaughnessy and unanimously carried to approve the application and to direct the Building Official to issue a permit for the removal of 24" of palm to be mitigated on site with the two existing palm trees behind the twenty -foot setback at the front of the property. 6. Reports and Announcements Board Member Mears stated that the City has done a nice job in cleaning up the "Marvin's Gardens" area. She requested that someone take a look at the condition of the Magnolia tree with the two jagged branches. Building Official Ford stated that he would have an arborist look at the tree. Board Member Bell addressed the property located at 715 Seminole Road. He reminded the Board that the applicant had assured the Board that he would not plant the oak trees under the power lines but that the trees were in fact planted directly under the power lines. Building Official Ford advised that a Certificate of Occupancy has not been issued at this point in time so he would review this issue. Building Official Ford advised Board Members Bell and Jacobson that it had been a pleasure serving with them on the Board. He further stated that he hoped that they would consider serving on the Board in the future. Board Member Jacobson stated that she had learned a great deal from Building Official Ford and that he is the "ideal" City staff person. Board Member Bell stated that it had been a pleasure working with the Tree Conservation Board and Building Official Ford. Discussion was held with regard to the rights of property owners. Persons present: Mr. Greg Birdsong Mr. Don Ford Mr. Jim Demings George Bull Jr. Comments: Due to the change from a concrete driveway and concrete sidewalk, on-site elevations were adjusted regarding the brick pavers. The edge of the sidewalks was designed at elevation 10.67 and sloped inward to 10.50 creating an interior swale for sheet drainage to the street. Accomplishing this design with the brick pavers would have caused the bricks to be inconsistent in elevation at the swale. This inconsistency could cause a person to stumble within the swale area. To eliminate this problem, the pavers were installed level to slightly sloped away to the edge. This installation has caused some of the sheet drainage to shed on to the adjacent properties to the East and West. Mr. Ford and Mr. Carper visited our site, observed the problem, and directed us to cease with disposing any of our storm water runoff to the adjoining properties. During the on -site meeting on August 26, 2004, it was agreed, by those present, that the following solution would be a positive approach to correct the existing condition. 1. Increase the width of the retention areas 6 inches beyond the south downspouts. 2. Increase the depth of the retention area to 18 inches and completely fill this area with gravel. Provide splash blocks at each downspout. 3. Increase the length or the retention area to the property line fence. 4. Provide a 2 X 8 pressure treated dam around the retention area, one inch higher than the edge of the pavers, and continue this dam to the North terminus of the sidewalk. S. Create a shallow swale between the dam and sidewalk edge and fill this swale with gravel. 6. If there are no fence posts for attachment of the 2 X 8, provide pressure 2 X 4 stakes at 48" inches on centers to secure the dam to the grade. 7. See enclosed Drawings.
