343-345 2nd St (vault) AGENDA ITEM # 8A MARCH 12, 2007 CITY OF ATLANTIC BEACH CITY COMMISSION MEETING STAFF REPORT AGENDA ITEM: Request from Ruth M. Thomas for a waiver from Section 24 -255 (a) of the Subdivision Regulations seeking approval to create two lots that are less than 75 -feet in width and less than 7,500 square feet in Lot Area and that are also less than the 75 -foot width and 7,500 square feet requirements of the RS -2 Zoning District for property at 343/345 Second Street. SUBMITTED BY: Sonya Doerr, AICP ' Community Development Director DATE: February 22, 2007 BACKGROUND: Section 24 -255 (a) of the Subdivision regulations requires newly created residential lots to have a width of not less than 75 -feet and lot area of not less than 7,500 square feet. The RS -2 Zoning District also requires a minimum Lot Width of 75 -feet and minimum Lot Area of 7500 square feet. The applicant owns one 50 -foot wide by 140 -foot deep lot on the north side of the 300 block of Second Street and also one -half of each of the two adjacent 50 -foot wide lots. The owner wishes to reconfigure the existing property to create two 50 -foot wide by 140 -feet deep lots. The property is currently occupied by an older single -story duplex. Prior to 2001, this area was zoned RG -1 (Two - family, Residential.) The site contains a significant number of very large oak trees and palms, which canopy over the property. Any action that would serve to support destruction of this tree canopy would be inconsistent with stated objectives of the City. This property, as it now exists, could be redeveloped with a duplex in accordance with Section 24 -86 or with a single - family residence. Redevelopment would be subject to the Residential Development Standards. The subject property is located within the RM (Residential, Medium Density) Comprehensive Plan land use category. At 7000 square feet, the proposed lot sizes would comply with the Density limitations of the Comprehensive Plan, but the reconfigured lots would not meet the minimum width or size requirements of the RS -2 district or as set forth in the Subdivision regulations. Staff recognizes that the original platting pattern of this area consisted of 50 -foot wide lots; however, as indicated by the attached Property Appraiser's map, many lots within this area have been reconfigured such that the 50 -foot wide lot is no longer the typical lot width. BUDGET: No budget issues involved in this request. RECOMMENDATION: Motion to deny request to create two lots that are less than 75 -feet in width and less than 7,500 square feet in Lot Area and that are also less than the 75 -foot width and 7,500 square feet requirements of the RS -2 Zoning District for property at 343/345 Second Street. (No similar requests have been approved over the previous four years.) ATTACHMENTS: Photos, maps, application and operty owner's supporting information. It has been owned and used continuously since 1964 by the current owner's family. Deaths in the family now leave as the sole owner a 76 year old widow in declining health unable to properly maintain her home any longer. 2. The owner recently had the home appraised in anticipation of selling the property, and indications are that the existing structure on the parcel is functionally obsolete, in part because of the small dimensions and layout. The structure has little insulation in the attic and none in the walls, and has many non - functioning, inefficient jalousie -type windows, and a roof that will need replacing in less than 5 years. It is not in compliance with current hurricane and /or other building codes, and it does not have a firewall between the common wall of the structure. The building has no historic value or architecturally interesting features. 3. The sale of the home was to have been the owner's main source of retirement funding. Costs to bring the existing structure into compliance for resale as an existing duplex are prohibitive for her, thus leaving her having to sell the home in an "as is" condition and leaving the cost of renovation to a buyer, reducing significantly the potential selling price. A buyer could also purchase the home, tear it down and either a) rebuild a new duplex home, keeping the existing RS -2 zoning designation; or b) tear down the existing duplex and build one potentially enormous "McMansion" home on the 14,000 square feet that comprise the lot as it currently exists. 4. A rebuilding of another RS -2 duplex does not serve the public interest in the best manner possible for what the Community Development Board (CDB) now seeks; that is, to improve the quality of family life in Atlantic Beach and to keep the size and height requirements of any new structures built within reason to accomplish the feel of the unique seaside community that Atlantic Beach is. Second Street is in an area that is predominately single family RS -1 homes built on 50 X 100 to 120 foot lots. This lot is even larger. 5. The appraisal suggests the best and most valuable use of the property is single family homes on single lots. This alternative better suits the needs of the owner AND the City of Atlantic Beach AND the Community, but the only way to do this is for the CDB to permit a subdivision waiver that would allow the construction of two new single family RS -1 structures on 2 lots taken from the single lot designation that is large enough to accommodate homes of a design that is in keeping with the CDB's Community Comprehensive Plan. The owner can expect a better return on the sale of the land; the Community gets two new fully Code - compliant family dwellings that would be built to community- enhancing design; AND the City coffers benefit when this now old homesteaded "one unit" is replaced by 2 single family homes that will generate immediately upon completion property tax revenue nearly triple what is being paid now. Two new structures AND the individual lots to go with them are simply worth more to all parties involved. AGENDA ITEM # SA MARCH 12, 2007 6. Further, Section 24- 106(d) of the Zoning and Subdivision and Land Development Regulations states that... "Existing legally established Lots of Record may exist which do not meet the above requirements. These Lots may be developed subject to all applicable Land Development Regulations... ". The lot size BUT FOR the current way the lines of this pieced- together lot created originally from 3 other lots is easily large enough for 2 homes, and it would not be inconsistent with the character of this neighborhood to permit the construction of 2 fully compliant single family dwellings, each having a lot size of 50 X 140, both of which more than meet the square footage requirements of a single family lot as originally drawn and platted. The owner and her real estate agent met with Sonya Doerr, Atlantic Beach Community Development Director, on Monday, February 5, 2007. Ms. Doerr researched and confirmed the standards to comply with minimum density requirements as mandated by the Community Comprehensive Plan. 7. Originally, a variance of some sort was created when the original plat allowed the homeowner to take portions of 3 lots to make one large lot in the middle of smaller lots. The same result occurred then —the exact same dirt was moved around with the stroke of a pen to accommodate an individual and community need at that point in time —a variance for a duplex — perhaps back in those days as a way to own one side and rent the other to tourists or the military. Or, a way to have both a city house in nearby Jacksonville and a beach house for the weekends. Whatever the reason the original variance was granted, there was a request made and reasonable minds saw fit to grant that request without damaging the rights of others. Now, some 55+ years later, a family seeks to return the very same dirt by the stroke of a pen to 2 lots to further its value when sold, without damaging the rights of adjacent property owners and with the added bonus of helping the CDB obtain what is still most beneficial to our community all these years later— character, individuality and the right of a homeowner to own completely the land upon which his home is situated. Townhomes and duplexes can negatively impact areas designed and created for families. They are intrinsically perceived as "transitory housing" whether true or not, in a neighborhood striving for stability. There are other parts of the community better suited to rental or duplex housing. This location, with Atlantic Beach Elementary School at one end of the block and the Atlantic Ocean a few steps further in the other direction, will clearly not be impacted in a negative way by the granting of this subdivision waiver. 8. The homes on either side of 343/345 Second Street will not be negatively impacted. The newly remodeled home to the east of the property is on an oversized lot that has an oversized 2 story home and garage building spanning nearly the width of the 125 foot lot. The home to the west of 343/345 Second Street is also a duplex, that is to say 2 rental units on a 75 foot lot. Police activity over the 43 years the owner has lived in her home is quite high at that rental duplex with police call -outs for such things as drug trafficking, drunk and disorderly conduct, nuisance animals, loud and late noise violations at often -held parties, and so forth. For all these reasons, the owner seeks the subdivision waiver from the reasonable minds now tending to the future needs of our community. We ask that the CDB grant the request for the subdivision waiver. 2 Doc # 2005197208, OR BK 12514 Page 690, 1 of 1 Filed & Recorded 05/27/2005 at 02:45 PM, JIM FULLER CLERK CIRCUIT COURT DUVAL COUNTY RECORDING $10.00 AGENDA ITEM #8A MARCH 12, 2007 This instrument was prepared by and is to be returned to: Arnold H. (This request was denied by failed motion at the March 12th meeting. The property owner has requested to again be heard at this meeting.) SUBMITTED BY: Sonya Doerr, AICP dv Community Development Director DATE: March 14, 2007 BACKGROUND: Section 24 -255 (a) of the Subdivision regulations requires newly created residential lots to have a width of not less than 75 -feet and lot area of not less than 7,500 square feet. (No similar requests have been approved over the previous four years.) ATTACHMENTS: Section 24 -191 and Section 24 -255 (a) of the Subdivision Regulations Photos, maps, application and property owner's supporting information. REVIEWED BY CITY MANAGER: March 26, 2007 regular meeting AGENDA ITEM # 8B MARCH 26, 2007 ARTICLE IV. SUBDIVISION REGULATIONS Sec. 24 -191. Waiver. (a) General. Where the City Commission finds that undue hardship due to unreasonable practical difficulties may result from strict compliance with this Article, the City Commission mayqpprove a waiver to the requirements of this Article if the waiver serves the public interest (b) Conditions of waiver. An Applicant seeking a waiver shall submit to the City Commission a written request for the waiver stating the reasons for the waiver and the facts, which support the waiver. The City Commission shall not approve a waiver unless it determines as follows. (1) The particular physical conditions, shape or topography of the specific property involved causes an undue hardship to the Applicant if the strict letter of the Article is carried out. (2) The granting of the waiver will not be injurious to the other adjacent property. (3) The conditions, upon which a request for waiver are based, are peculiar to the property for which the waiver is sought, are not generally applicable to other property and do not result from actions of the Applicant. (4) The waiver is consistent with the intent and purpose of this Chapter, the Comprehensive Plan and the requirements of this Article. If the City Commission approves a waiver, the City Commission may attach such conditions to the waiver as will ensure that the waiver will comply with the intent and purpose of this Article. Sec. 24 -255. Lots. (a) General. Lot size, width, depth, shape and orientation, and the minimum Building Setback lines shall be appropriate for the location of the Development and for the type of development and Use proposed. Lot arrangement and design shall be such that all Lots shall provide satisfactory and desirable Building sites. Minimum sizes for Lots shall be as set forth within the applicable Zoning District requirements. As you know, last night the Commission said we could reapply to do this, and they waived the $250.00 application fee in our particular case. Must we file a completely new Application for Subdivision Waiver or can you /we use the original currently on file for the next hearing? The information and documents in it are, of course, the same; the issues remain unchanged, save for stressing even more the uniqueness of THIS application and no other, past or present that is exactly like it, but that can be done during the oral part of the hearing. If a completely new Application must be filed, please let me know the deadline ASAP to make the agenda for the NEXT full Commission hearing. We also need to know, of course, and as soon as possible, the date and time of the hearing. We thank you for all the assistance with the paperwork that you have provided to date. We see that you have a most demanding job and all on the Commission, regardless of their personal points of view, demonstrate a desire to have as the end result a better Atlantic Beach. That is our goal also. It is devastating to Mom that she has to leave her beloved Atlantic Beach, but neither she nor I can afford her house any more. It has been valued beyond her reach at this point in her life. You might have noticed she is wearing a heart monitor, and she must get proper medical care now, not later, and that is yet one more reason our request is so urgent to us. We can only hope that the review the Commission wanted to do of past denials will reveal what we already suspect —OUR waiver request IS unique and different from ANY other previous denial; it will not harm any rights of the adjacent neighbors (a DUPLEX on a 75 foot lot on the west side and a lovely newly remodeled home on the East side); but in fact will enhance the overall neighborhood community character of the OLD (not newly platted or new land) neighborhood of Second Street, Atlantic Beach, where 50 foot wide lots are not at all unusual, meet the density requirements of RS -2, etc., etc. You know all too well what we seek after last night, and we don't want to miss any deadline that might delay our request for this waiver. Please call me if there is anything else you need. Thank you again. The owner can expect a better return on the sale of the land; the Community gets two new fully Code - compliant family dwellings that would be built to community - enhancing design; AND the City coffers benefit when this now old homesteaded "one unit" is replaced by 2 single family homes that will generate immediately upon completion property tax revenue nearly triple what is being paid now. Two new structures AND the individual lots to go with them are simply worth more to all parties involved. AGENDA ITEM # 813 MARCH 26, 2007 6. Further, Section 24- 106(d) of the Zoning and Subdivision and Land Development Regulations states that... "Existing legally established Lots of Record may exist which do not meet the above requirements. These Lots may be developed subject to all applicable Land Development Regulations... ". The lot size BUT FOR the current way the lines of this pieced - together lot created originally from 3 other lots is easily large enough for 2 homes, and it would not be inconsistent with the character of this neighborhood to permit the construction of 2 fully compliant single family dwellings, each having a lot size of 50 X 140, both of which more than meet the square footage requirements of a single family lot as originally drawn and platted. Now, some 55+ years later, a family seeks to return the very same dirt by the stroke of a pen to 2 lots to further its value when sold, without damaging the rights of adjacent property owners and with the added bonus of helping the CDB obtain what is still most beneficial to our community all these years later — character, individuality and the right of a homeowner to own completely the land upon which his home is situated. 2 Doc # 2005197208, OR BK 12514 Page 690, 1 of 1 Filed & Recorded 05/27/2005 at 02:45 PM, JIM FULLER CLERK CIRCUIT COURT DUVAL COUNTY RECORDING $10.00 AGENDA ITEM # 813 MARCH 26, 2007 This instrument was prepared by and is to be returned to: Arnold H. A humane solution to feral car over- population. The City of Jacksonville has partnered with First Coast No More Homeless Pets to solve this issue. TNR is the only viable solution as Trap and Kill has been proven not to work. Why doesn't trap and kill or removal work? Feral cats are territorial. The presence of feral cats in an area typically means there is a food source and good quality of life nearby. Ferals locate a territory and stay there. When cats are removed, the gap that is left is not only filled by new cats, but the reduced numbers cause cats to become super virile, reproducing much more rapidly to rebuild. Removing the food source does not work as cats will remain in the territory, scavenge for new food sources, and suffer in the interim. What is TNR? Trap Neuter Return. Cats are trapped, sterilized and returned to their territory allowing that the conditions are appropriate. By returning the cats, the numbers stay, yet the breeding does not, since ferals tend to live much shorter lives the numbers dwindle. The sterilized cats lose most of the "nuisance" tendencies within less than a week so they also become better neighbors. What is a feral cat? A feral cat should really be considered "urban wildlife ". These cats have become feral either by owner abandonment or by being born into the environment. The lack of human contact makes them more wild and leery of people. These cats have the ability to survive on their own similar to a raccoon. Step By Step Process: • When Jacksonville ACC receives cats that have been trapped they are set aside at the shelter. ACC staff provides paperwork for each cat with details on exactly where the cat was trapped, and any other pertinent facts. • These cats are screened by ACC staff to insure they are in fact feral (have been and currently have the ability to survive on their own) and that they are not noticeably sick or injured. • FCNMHP staffers pick up cats twice daily at ACC. Our staff does a second screening. Cats that fit the program are loaded into our transport van and taken to our clinic. • Clinic staff inspects the cats a third time. Cats are lined up for surgery. • Each cat is given tests for known diseases (and euthanized if positive), then sterilized, given outdoor cat vaccinations, ear tipped (to notate fixed feral), treated if there are any minor injuries or problems, microchipped, and entered into the feral database. • The day after surgery if the cat is responding well, it is returned to it's territory. Returns are done in the FCNMHP Transport vehicle that is clearly marked. Our staff are always willing to stop an answer any questions. • Part of the return process is to deliver feral cat information and help to the surrounding neighborhood within the cat's range of territory. This is done upon release. • Questions, complaints and concerns go to the FCNMHP hotline where our knowledgeable staff can help with tips and answers. • In the event a cat is still displaying nuisance behaviors, FCNMHP has various products to assist the situation. • Repeatedly trapped cats are handled by ACC officers as the situation merits. • FCNMHP also has a dedicated page on our web site to answer commonly asked questions or provide resources to those who request information. • In known problem areas, FCNMHP will do public education drops - delivering our information to those in the area. Ways you can make the program more effective: • Provide full details when transferring ferals to ACC. • Tell us about problem areas for advance education. • Add a link www.fcnmhp.org to your web site. • Make sure all those who answer calls have the FCNMHP hotline number to give out 904 - 425 -0005. • Realize that every thriving feral cat dos have a caregiver in some capacity and that a nuisance call is only half of the equation. • Know some of the easy ways to curb nuisance problems or be ready to give out the hotline number. Other important points: • The vast majority of nuisance callers, once aware of the options desire to have these cats live and return rather than be killed. • A thriving feral cat does not have to live in a colony. Very often small numbers of ferals live in a neighborhood are often are fed by multiple caregivers. • FCNMHP would NEVER release a young kitten, or a domestic cat, regardless of how the cat was acquired. These cats do not have the means to survive and would therefore not fit the program requirements. • There are many success stories across the nation for TNR, and there have already been several in Atlantic Beach. FCNMHP resources: • No part of the program is paid for by taxpayers. FCNMHP and a grant from Best Friends cover the costs of the program. • FCNMHP owns over 300 traps, a transports van, staff to manage the program, and we operate a spay neuter clinic. • In early 2009 the new 16,000 SF Spay Neuter clinic will open, allowing us to do close to 250 surgeries EVERY DAY. About FCNMHP: At First Coast No More Homeless Pets we have been providing Free to Low Cost Spay /Neuter surgeries since 2003. We have a number of different programs to serve our community, low income clients, feral and stray caretakers, and pet owners who would not otherwise have their animals altered. We have facilitated over 28,000 surgeries in the First Coast area, and have seen an overall reduction in shelter intake of pets by 31 %, and reductions in puppy and kitten intake by 44% and 52 %, respectively. We operate a small temporary clinic currently that provides surgeries for cats. We recently added a Saturday weekly low cost vaccination clinic. We have two full time veterinarians on staff.
