THIS CAUSE came for public hearing before the Code Enforcement Board on January
14, 2014, and the Board having heard testimony under oath, received evidence, and heard
arguments respective to all appropriate matters, and thereupon issues the Findings of Fact,
Conclusions of Law and Order as follows:
FINDINGS OF FACT
1. That the Respondent Thomas J. Bennett,Jr., owns the property located at 131
Belvedere Street, Atlantic Beach, Florida.
2. That notice was sent by certified mail and that Beverly Clark,Attorney with Choice
Legal Group, representing JP Morgan Chase Bank was present at the hearing.
3. That notification of the violations of the City of Atlantic Beach, were made and
served on the Respondent as evidenced in this hearing.
IPMC Sec. 301.3 Vacant Structures and Land
All vacant structures and premises thereof or vacant land
shall be maintained in a clean, safe, secure and sanitary
condition as provided herein so as not to cause a blighting
problem or adversely affect the public health or safety.
(Substandard, abandoned single family dwelling)
IPMC Sec 304.2 Protective treatment.
All exterior surfaces including but not limited to, doors
and window frames, cornices,porches,trim, balconies, decks
and fences, shall be maintained in good condition. Exterior
wood surfaces, other than decay-resistant woods, shall be
protected from the elements and decay by painting or other
protective covering or treatment. Peeling,flaking and
chipped paint shall be eliminated and surfaces repainted.
All siding and masonry joints, as well as those between the
building envelope and the perimeter of windows, doors and
skylights, shall be maintained weather resistant and water
tight. All metal surfaces subject to rust or corrosion
shall be coated to inhibit such rust and corrosions and
all surface with rust or corrosion and shall be stabilized
and coated to inhibit future rust and corrosion. Oxidation
stains shall be removed from exterior surfaces. Surfaces
designed for stabilization by oxidation are exempt from
this requirement.
IPMC Sec. 304.4 Structural members.
All structural members shall be maintained free from
deterioration, and shall be capable of safely supporting
the imposed dead and live loads.
IPMC Sec. 304.6 Exterior walls.
All exterior walls shall be free from holes, breaks,and
loose or rotting materials;and maintained weatherproof and
properly surface coated where required to prevent
deterioration.
304.7 Roofs and drainage.
The roof and flashing shall be sound, tight and not have
defects that admit rain.Roof drainage shall be adequate to
prevent dampness or deterioration in the walls or interior
portion of the structure. Roof drains, gutters and
downspouts shall be maintained in good repair and free from
obstructions.Roof water shall not be discharged in a
manner that creates a public nuisance.
4. The aforementioned property shall be corrected by achieving full compliance with all
noted violations.
CONCLUSIONS OF LAW
THAT Thomas J. Bennett, Jr. is not in compliance and has failed to correct such violation as of
this hearing date.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority
granted in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic
Beach, Florida it is Ordered:
THAT the Respondent is found in violation for non-compliance and must obtain
compliance on or,before March 14, 2014. Failure to comply will result in fines of$100.00 for
the first day and $100.00 for every day thereafter while the violation continues to exist. In
addition, any fine shall also include the administrative costs to the City incurred in prosecuting
this case.
THAT the Respondent is responsible for contacting the City of Atlantic Beach Code
Enforcement Officer and obtaining an inspection of compliance.
THAT failure to pay all accumulated fines will result in a lien being placed against the
property at 131 Belvedere St for the total assessment plus costs incurred for the filing of the lien.
All lien amounts are to be made payable at an interest rate of ten (10) percent per annum from
date of certification until paid.
This Order becomes self-executing upon an Affidavit of Non-Compliance being filed with the
City Clerk's Office.

IPMC Sec 304.2 Protective treatment.
All exterior surfaces including but not limited to, doors
and window frames,cornices,porches,trim,balcon' s,decks
and fences, shall be maintained in good condition. Exterior
wood surfaces, other than decay-resistant woods, shall be
protected from the elements and decay by painting or other
protective covering or treatment. Peeling, flaking and
chipped paint shall be eliminated and surfaces rep 'nted.
All siding and masonry joints, as well as those between the
building envelope and the perimeter of windows, doors and
skylights, shall be maintained weather resistant and water
tight. All metal surfaces subject to rust or or corrosion
shall be coated to inhibit such rust and corrosions d

and coated to inhibit future rust and corrosion. Oxidation
stains shall be removed from exterior surfaces. Surfaces

The Code Enforcement Board may levy fines up to $250.00 per day for the first violation
and $500.00 per day for a repeat violation. If the violation is corrected and then recurs or if the
violation is not corrected by the time specified for correction by the Code Enforcement Officer,
the case could be presented to the Code Enforcement B and even if the violation has been
corrected prior to the Board hearing. Upon completing the corrective action required, it is your
responsibility to contact Atlantic Beach Code Enforcement and arrange for an inspection to
verify compliance at(904) 247-5855.
You have the right to obtain an attorney at your own expense and to present witnesses in
your behalf. If you desire to have witnesses subpoenaed or if you have questions regarding the

Good Morning, Last night Beverly Thomas the attorney for Chase Bank
appeared at a Code Enforcement Board hearing on property at 131 Belvedere
Street. Chase Bank has adjacent properties at 132 Belvedere Street, which
has been determined unfit for occupancy because of the unsafe wood deck in
the rear. In addition, 133-135 Belvedere along with the other two parcels
had cases heard based on the conditions of the structures and property.
The tenant in 132 and tenant in 133 (131 and 135 are vacant) (135 is the
unit that the tenant busted the door and all the windows) have been
notified and continue to get notices on their door from Chase with an 800
number to call . I will forward you copies of the orders as soon as they
are typed and signed maybe the orders can possibly move the process
along.

THIS CAUSE came for public hearing before the Code Enforcement Board on January
14, 2014 and the Board having heard testimony under oath, received evidence, and heard

2. That notice was sent by certified mail and that Beverly Clarke, Attorney with Choice
Legal Group, representing JP Morgan Chase Bank, was present at the hearing.
3. That notification of the violations of the City of Atlantic Beach, were made and
served on the Respondent as evidenced in this hearing.
IPMC Sec. 301.3 Vacant Structures and Land
All vacant structures and premises thereof or vacant land
shall be maintained in a clean, safe, secure and sanitary
condition as provided herein so as not to cause a blighting
problem or adversely affect the public health or safety.
SUBSTANDARD, ABAN SFR
IPMC Sec 304.2 Protective treatment.
All exterior surfaces including but not limited to, doors
and window frames, cornices,porches, trim, balconies, decks
and fences, shall be maintained in good condition. Exterior
wood surfaces, other than decay-resistant woods, shall be
protected from the elements and decay by painting or other
protective covering or treatment. Peeling, flaking and
chipped paint shall be eliminated and surfaces repainted.
All siding and masonry joints, as well as those between the
building envelope and the perimeter of windows, doors and
skylights, shall be maintained weather resistant and water
tight. All metal surfaces subject to rust or corrosio
shall be coated to inhibit such rust and corrosions and
all surface with rust or corrosion and shall be stabilized
and coated to inhibit future rust and corrosion. Oxidation
stains shall be removed from exterior surfaces. Surfaces
designed for stabilization by oxidation are exempt f rom
this requirement.
IPMC Sec. 304.4 Structural members.
All structural members shall be maintained free f rom
deterioration, and shall be capable of safely support ng
the imposed dead and live loads.
IPMC Sec. 304.6 Exterior walls.
All exterior walls shall be free from holes, breaks, and
loose or rotting materials; and maintained weatherproof and
properly surface coated where required to prevent
deterioration.
304.7 Roofs and drainage.
The roof and flashing shall be sound,tight and not have
defects that admit rain. Roof drainage shall be adequate to
prevent dampness or deterioration in the walls or interior
portion of the structure. Roof drains, gutters and
downspouts shall be maintained in good repair and free from
obstructions.Roof water shall not be discharged in a
manner that creates a public nuisance.
4. The aforemention x :property shall be corrected by achieving full compliance with all
noted violations.
CONCLUSIONS OF LA
THAT Thomas J. Bennett, Jr. is not in compliance and has failed to correct such violations as of
this hearing date.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority
granted in Chapter 162, Florida Statutes and the Code of Ordinances of the City of Atlantic
Beach, Florida it is Ordered:
THAT the Respondent is found in violation for non-compliance and must obtain
compliance on or before March 14, 2014. Failure to compl will result in fines of$100.00 for
the first day and $100.00 for every day thereafter while the violation continues to exist. In
addition, any fine shall also include the administrative costs to the City incurred in prosecuting
this case.
THAT the Respondent is responsible for contacting the City of Atlantic Beach Code
Enforcement Officer and obtaining an inspection of compliance.
THAT failure to pay all accumulated fines will result in a lien being placed against the
property at 131 Belvedere St for the total assessment plus costs incurred for the filing of the lien.
All lien amounts are to be made payable at an interest rate of ten (10) percent per annum from
date of certification until paid.
This Order becomes self-executing upon an Affidavit of Non-Compliance being filed with the
City Clerk's Office.

General. All plumbing fixtures shall be properly inst fled and maintained in working
order, and shall be kept free from obstructions, leaks and def is and be capable of performing
the function for which such plumbing fixtures are designed. 11 plumbing fixtures shall be

This letter requests that the noted violations be corrected by in intaining abandoned structure and

properly frame around window and replace rotted window fra es, replace rear unsafe collapsing
wood deck and stairs and repair and secure the shed within fo five(45)days from receipt of this
notice. (Permits required from State of Florida licensed contra tors for wall repairs,deck/stairs,
window frames,front door and roof)
To avoid having this case be referred to the Code Enforcement Board,all listed violations on this notice
must be in compliance on or before the date established by Atlantic Beach Code Enforcement. The Board
may impose fines up to two hundred fifty($250.00)per day for cot tinuing violations.

Please be advised,Atlantic Beach Code Enforcement has found the property referenced above to be in
violation of City of Atlantic Beach,Code or Ordinances, Sec. 6-16 International Property Maintenance
Code adopted to wit:
VIOLATIONS EXTERIOR ONLY
INTERNATIONAL PROPERTY MAINTENANCE CODE
Sec. 301.3 Vacant structures and land. All vacant structures and prd,mises thereof or vacant land shall
be maintained in a clean,safe, secure and sanitary condition as provided herein so as not to cause a
blighting problem or adversely affect the public health or safety.
Sec. 304.6 Exterior Walls. All exterior walls shall be free from,holes, breaks and loose or
rotting materials and maintained weatherproof and properly surface coated where required to
prevent deterioration. (Rotted exterior walls,missing shingles etc.)
Sec. 304.7—Roofs and Drainage. The roof and flashing shall be sound, tight and not have
defects that admit rain. Roof drainage shall be adequate to prevent dampness or deterioration in
the walls or interior portion of the structure. Roof drains, gutters and downspouts shall be
maintained in good repair and free from obstructions. Roof water shall not be discharged in a
manner that creates a public nuisance. (rotted roof)
Sec. 304.2 Protective treatment. All Exterior surfaces, including but not limited to, doors,
door and window frames, cornices,porches,trim, balconies, decks and fences shall be
maintained in good condition. Exterior wood surfaces,other than decay resistant woods, shall be
protected from the elements and decay by painting or other protective covering or treatment.

Peeling, flaking and chipped paint shall be eliminated and surfaces repainted. All siding and
masonry joints as well as those between the building envelope and the perimeter of windows,
doors, and skylights shall be maintained weather resistant and water tight. All metal surfaces
subject to rust and corrosion and all surfaces with rust or corrosion shall be stabilized and coated
to inhibit future rust and corrosion. Oxidation stains shall be removed from exterior surfaces.
Surfaces designed for stabilization by oxidation are exempt from this requirement. (structure
needs to be painted)
304.13 Windows, skylight and door frames. Every window, skylight, door and frame shall be
kept in sound condition, good repair and weather tight. (rotted window frames, busted front
door)
Sec. 302.7 Accessory Structures. All accessory structures, including detached garages, fences
and walls, shall be maintained structurally sound and in good repair. (Rear wood deck is
collapsing and stairs are missing and dilapidated, unsecured;wood shed in rear yard)
Sec. 504.1 Plumbing systems and fixtures.
General. All plumbing fixtures shall be properly installed and maintained in working
order, and shall be kept free from obstructions, leaks and defects and be capable of performing
the function for which such plumbing fixtures are designed. All plumbing fixtures shall be
maintained in a safe, sanitary and functional condition. (broken clean out cap)
This letter requests that the noted violations be corrected by maintaining abandoned structure and
premises, repair exterior walls and replace where needed,paint,repair/replace busted front door,
properly frame around window and replace rotted window frames,replace rear unsafe collapsing
wood deck and stairs and repair and secure the shed within forty five(45)days from receipt of this
notice.(Permits required from State of Florida licensed contractors for wall repairs,deck/stairs,
window frames,front door and roof)
To avoid having this case be referred to the Code Enforcement Board, all listed violations on this notice
must be in compliance on or before the date established by Atlantic Beach Code Enforcement. The Board
may impose fines up to two hundred fifty($250.00)per day for continuing violations.

safety and welfare of the City,and accordingly,your cooperation in this matter is greatly appreciated.

(b) It is hereby declared to be a nuisance,the
enumerations of which are merely indications of the lature
of the type of acts, occurrences and conditions, ands all
not be deemed to be exclusive:
(1 l) For any person or business to allow vegetatic n
other than cultivated plants, shrubs or trees to excee a
height of more than twelve(12) inches on any develo ed lot,
or within twenty (20) feet of any occupied residentia
property, business property or city right of way.

Sec. 24-173. Neighborhood preservation and property
maintenance standards.
(b) Appropriate maintenance and upkeep. All areas of
a lot and structures that are visible from the street or
neighboring property shall be maintained in an accep able

manner, which shall be defined by the following
characteristics:
1. Lots are maintained free from litter, trash,
debris, discarded belongings, automotive parts, old tires,
construction materials, and broken and abandoned items.

IPMC 302.4 Weeds.
All premises and exterior property shall be
maintained free from weeds or plant growth in excess of
twelve (12) inches. All noxious weeds shall be prohibited.
Weeds shall be defined as all grasses, annual plants and
vegetation, other than trees or shrubs provided; however,
this term shall not include cultivated flowers and gardens.

I forget who you said that worked the property preservation issues on the foreclosure properties (I might have been
Eric Nelson) but we have been contacted by the local Code Enforcement Officer for this property and it needs to be
secured ASAP.
Above is the property address,your loan number,etc for the subject property. It was an active foreclosure status
account when it was service released to your firm as of 8/1/2013.
Please get this in the correct hand as SPS, have them order the property to be secured and contact Ms.White at the
City of Atlantic Beach Code Enforcement office letting her know when the property will be secured.
