leaning prior to construction. You can clearly see in the picture the
tree has started to uproot. We discussed this with you during our tree
removal stage and you said the tree was not leaning.

You can remove the tree whenever you'd like and I will update
the tree permit. We went out yesterday to look at it and saw a large
root was cut during construction which is likely causing the tree to
lean. As such, the tree will need to be mitigated before CO inspections
either through additional plantings or payment unless your arborist can
verify that the cut root or that the construction in general is not the
cause of the lean or that the tree has other defects, etc.
