Fleet Landing Letter 10.05.2006City of Atlantic Beach 800 Seminole Road Atlantic Beach, Florida 32233 Telephone (904) 247-5800 Fax (904) 247-5805 www.coab.us MEMORANDUM TO: Jim Hanson, City Manager FROM: Sonya Doerr, AICP Community Development Director DATE: October 5, 2006 SUBJECT: Fleet Landing Expansion within COJ (The Palms at Fleet Landing) Jim, I have again reviewed the Fleet Landing files in entirety, and have located no additional information on specific development criteria that were included in the original PUD. The Fleet Landing PUD ordinance, which was adopted on January 11, 1989 had no attachments or Exhibits related to the detailed plan of development. (This was typical of PUDs adopted by the COAB in the mid -late 1980s.) It is clear from the related documents, that the PUD was intended to approve the development plan as contained within the Comprehensive Plan amendment, which was adopted simultaneously with the PUD. No specific site development criteria, other than as included within the Comp Plan amendment were specifically adopted. The adopted Plan amendment and the rezoning materials included a number of drawings and renderings that included a mix of two, three and four-story buildings. Construction Plans later approved by the COAB contain notation referencing a 55 -foot height limit, but other than the drawings and Exhibits to the adopted PUD and Comprehensive Plan amendment, I cannot find any other reference to maximum height in the Fleet Landing files. While the Fleet Landing expansion is within the City of Jacksonville, the intent of the Interlocal Agreement, which was executed between the COJ and COAB, was to assign permitting, zoning and building code review to the COAB, with the objective of ensuring that the project continued to develop as a unified project in accordance with the original PUD and Comprehensive Plan amendment. This process continues to work efficiently. With respect to the specific question of height, it appears that 55 -feet was the maximum height provided for in the PUD. The existing "O" Club contains features that exceed 35 -feet. Like the original portion of the PUD, the new residential estate and two -unit "villa homes" homes will be below 35 -feet. These are now in review and permitting and are all single -story buildings. The apartments only will be constructed to a maximum of 55 -feet to accommodate parking on the lower level. As proposed the Fleet Landing expansion is consistent with the approved PUD and Comprehensive Plan amendment with no height that will exceed 55 -feet and with that height being utilized only within the apartments. cc: Alan Jensen, City Attorney
