Public Works staff researched your concerns on 53 Oceanside Drive. As
originally constructed in 1999, this property was over 50% impervious
coverage. Oceanside Court/Drive are private streets located on easements
from the adjacent properties, such that half of the street width along
the lot frontage in this neighborhood is included in each lot's
impervious surface coverage. However, the 50% impervious surface limit
for residential lots did not go into effect until Jan. 1, 2002, so the
original construction was not subject to an impervious limit. In 2005,
the residents applied for and received a city building permit to
construct a swimming pool with sand-set paver deck. Per City Code,
swimming pools are not counted as impervious area. While there are no
notes in the permit file, our assumption is that the City required the
sand-set paver deck on order to provide a semi-pervious surface for the
pool decking. The deck size approved in 2005 appears to be consistent
with the surface coverage visible in the 2008 aerial pictures available
to Staff. Provided that the pavers continue to be set on a sand base,
this is consistent with the original permit, and there is no further
City action required or planned on this concern.
