As you are aware, the City of Atlantic Beach hired an independent arborist, Early Piety,
to assess the condition of the 31 inch Laurel Oak at 396 11th Street. Mr. Piety stated in his formal
review that he recommended the removal of the tree as it is in its declining phase. He also stated
that this is expected to take place in the "next several years". The letter from Mr. Piety is
attached for your review.
Based on Mr. Piety's professional opinion that the tree will live on for several more years
before a significant hazard is posed, staff has determined that the removal of this tree does not
qualify for an exemption from a permit as allowed by Section 23-22. Specifically, the claim that
the tree posed a safety hazard is covered by Section 23-22(3) which requires the tree pose an
imminent danger to public health safety and welfare. It was determined that the expected several
years of remaining life does not constitute an imminent threat.
As result of this determination, mitigation is required for the removal of the 31 inch
Laurel Oak. Section 23-33(b) requires the removal of trees from private property to be mitigated
at a rate of inch planted or preserved for every 2 inches removed. This results in 15.5 inches of
required mitigation. Mitigation can be accomplished through the planting of new trees or
payment into the Tree Fund. A third option of preservation is possible but no other existing trees
on the property qualify for this. Section 23-33(f)(2)(a) requires that oaks be replaced with oaks.
Credit will only be given for new oak trees planted. Section 23-33(f)(1)(a) requires oaks to have
a minimum 4 inch caliper and 12 feet of height at the time of planting.
At a minimum, one 4 inch caliper oak must be planted in the front yard as required by
Section 24-172(c)(4). The remainder of the required mitigation can be provided in the form of
payment into the Tree Fund. A recent code change allows for the planting of trees on
neighboring properties with the owners consent when plantings cannot be planted on the
property of the removed tree. Any trees planted on a neighboring property would not count
towards any required mitigation on the neighboring property.
Please provide a landscape plan showing the location of the minimum 4 inch oak tree as
well as any other trees to be planted. Payment into the Tree Fund is $113.00 per inch if that
option is selected.

At your request I have inspected the large Laurel Oak in the front of 396
11th Street, Atlantic Beach. The tree is getting toward the end of its life
span. There is a cavity in the main crotch of the tree and several of the limbs
are in decline. As the next several years go by this will worsen, causing a
hazard for traffic and pedestrians. I would recommend removal of the tree.
