Minutes / 10-11-99- MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD IN CITY HALL, 800 SEMINOLE ROAD AT 7:15 PM ON MONDAY, OCTOBER 11, 1999 PRESENT: Suzanne Shaughnessy, Mayor Richard Beaver Mike Borno John Meserve Theo Mitchelson, Commissioners AND: Maureen King, City Clerk Alan C. Jensen, City Attorney James Hanson, City Manager The meeting was called to order by Mayor Shaughnessy at 7:15 p.m. The Invocation was offered by Commissioner Beaver followed by the Pledge of Allegiance to the Flag. 1. Approval of the minutes of the Regular Meetings held September 27, 1999 and October 5, 1999 The Mayor asked for corrections or amendments to the minutes. There were no corrections or amendments and the minutes were unanimously approved as prepared. 2. Courtesy of the Floor to Visitors: Mayor Shaugnessy recognized Commissioner - Elect Dezmond Waters who was present in the audience. Mayor Shaughnessy recognized the attendance of Scott Perry's Civics Class from Fletcher High School and welcomed them to the meeting. Kay Friedemann of 1898 Selva Marina Drive inquired concerning the placement of "No Parking" signs in the medians of the 1800 and 1900 blocks of Selva Marina Drive. Public Safety Director Thompson stated that the signs had been phased-in over a period of time in response to citizen complaints of parking and damage to the medians. Mrs. Friedemann requested that the city review the need for the signs in the 1800 and 1900 blocks of Selva Marina Drive since the street is narrow in that area and cars cannot park on the street. Former Interim City Manager Thompson indicated that Waste Management had eliminated the backlog caused by the storm and was now operating on schedule. 3. Unfinished Business From Previous Meeting A. Award contract to Petticoat Contracting, Inc., in the total amount of $422,599.72 for the base bid and Additive Alternates No. 1, 2 and 3, for Stormwater System Improvements pursuant to the specifications of Bid No. 9899-25 (City Manager) Motion: Award contract to Petticoat Contracting, Inc., in the total amount of $422,599.72 for the base bid and Additive Alternates No.1, 2 and 3, for Stormwater System Improvements pursuant to the specifications of Bid No. 9899-25. Using an overhead projector, Public Works Director Kosoy explained the Base Bid and Additive Alternates 1, 2 and 3 of the Stormwater System Improvements. Mr. Kosoy indicated that the project was funded in the 1998/1999 budget, complied with the city's consent order and had negligible affect on the core city project. The staff recommendation for the project is attached and made part of this official record as Attachment A. Commissioner Mitchelson confirmed that all three alternates were included in the project cost. Commissioner Borno inquired as to the tide gate for the Aquatic Drive culvert improvements. Public Works Director Kosoy explained that it would be a manually operated five panel gate, which may be used once or twice a year to prevent adverse backwater conditions. There being no further discussion, the motion carried unanimously. Mayor Shaughnessy stated that she would like to act on Item 7A at this time since it provided funding for the stormwater improvements. 7. Action on Ordinances: A. The public hearing and final reading of the ordinance will take place on October 25, 1999. There was no discussion and the motion carried unanimously. 4. Consent Agenda: A. Acknowledge Receipt of Monthly Reports from Building, Code Enforcement, Occupational License and Recreation Departments (City Manager) B. Award contract to Golden Rule Services in the amount of $39,180 for lawn maintenance pursuant to the specifications of Bid No. 9899-32 (City Manager) Consent agenda Items A and B were received and acknowledged as presented and Mayor Shaughnessy requested that they be filed. C. Approve, subject to review by the City Attorney, a contract with D&A Inspections in the amount of $32,000, for building inspections (City Manager) Mayor Shaughnessy stated that the City Manager recommended that the wording "in an amount not to exceed $32,000" should be included as part of the recommendation. Motion: Approve, subject to review by the City Attorney, a contract with D & A Inspections in an amount not to exceed $32,000 for building inspections. Resolution No. 99-36 A RESOLUTION RECOGNIZING THE SERVICE OF LOU ETTA WATERS ON THE CITY'S CODE ENFORCEMENT BOARD (Mayor) Motion: Adopt Resolution 99-36. Mayor Shaughnessy read the resolution in its entirety and presented the framed document to Mrs. Waters. The Mayor and Commissioner Mitchelson, both of whom served with Mrs. on the Code Enforcement Board, commended Mrs. Waters for her spirit of public service. Mr. Waters thanked the Commission for the recognition. There was no discussion and the motion carried unanimously. B. Resolution No. 99-32 A RESOLUTION HONORING GLENDA DEDENBACH FOR HER TWENTY-FIVE YEARS OF SERVICE AS AN OUTSTANDING EMERGENCY COMMUNICATIONS OPERATOR FOR THE CITY AND CITIZENS OF ATLANTIC BEACH, FLORIDA (City Manager) Mayor Shaughnessy explained that Ms. Dedenbach was unable to attend the meeting and requested that this item be deferred to the next Commission Meeting. C. Resolution No. 99-33 A RESOLUTION HONORING LT. JAMES CHRISTMAN FOR HIS TWENTY-FIVE YEARS OF SERVICE AS AN OUTSTANDING POLICE LIEUTENANT FOR THE CITY AND CITIZENS OF ATLANTIC BEACH, FLORIDA (City Manager) Motion: Adopt Resolution No. 99-33. Mayor Shaughnessy read the resolution in its entirety and presented the framed document to Lt. and Mrs. Christman. On behalf of the Commission and citizens of Atlantic Beach, the Mayor thanked Lt. Christman for his dedication and outstanding service. Lt. Christman thanked the Commission and related how much he enjoyed working in Atlantic Beach. Mayor Shaughnessy read the resolution in its entirety and presented the framed document to Mr. Williams. The Mayor praised Mr. Williams for his thirty years of dedicated service to the city. Mr. Williams thanked the Commission for the honor and related that those thirty years were some of the happiest in his life. There was no discussion and the motion carried unanimously. E. Resolution No. 99-35 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, RECOGNIZING CITY GOVERNMENT WEEK, OCTOBER 17-23, 1999, AND ENCOURAGING ALL CITIZENS TO SUPPORT THE CELEBRATION AND CORRESPONDING ACTIVITIES (City Manager) Motion: Adopt Resolution No. 99-35. Commissioner Borno noted that staff recommended that the final reading of the ordinance not take place until the actuarial cost impact statement had been received and the State of Florida Division of Retirement had reviewed and approved the changes to the current ordinance. Commissioner Mitchelson pointed out that a recent change in Florida law required separation of the general employee and public safety (police) pension plans. There being no further discussion, the motion carried unanimously. 8. Miscellaneous Business: A. Public Hearing and action on an application for aUse-by- Exception filed by D.W. Henry to operate a cabinet shop in a metal structure to be built on property described as Lots 1 - 7, Block 32, Section H, Atlantic Beach (City Manager) Motion: Grant Use-by-Exception filed by D.W. Henry to operate a cabinet shop in a metal structure to be built on property described as Lots 1-7, Block 32, Section H, Atlantic Beach as recommended by the Community Development Board. (The Community Development Board recommended approval of the request with the following stipulations: no outside storage be permitted, no loud equipment to be operated after 9:00 p.m. or before 7:00 a.m., and that the exception be granted to the applicant only and for this location only). Mayor Shaughnessy opened the public hearing and no one spoke in favor of or in opposition to the request. The public hearing was closed. There was no discussion and'the motion carried unanimously. B. Authorize the Mayor to sign DUI Enforcement Grant application (City Manager) Motion: Authorize the Mayor to sign the DUI Enforcement Grant application. Discussion and possible action regarding the Interim City Manager's Bonus (City Manager) City Manager Hanson indicated that this item had been placed on the agenda for informational purposes concerning the actual net amount of the bonus received by the Interim City Manager. Motion: Reconsider, review and approve of this after taxes, not before taxes. Commissioner Mitchelson confirmed that Commissioner Borno was recommending that Mr. Thompson actually receive a check in the amount of 10% of his gross wages. Commissioner Mitchelson stated that the city owed Interim City Manager Thompson a debt of gratitude for his work and felt that even 10% was a pittance compared to the benefits derived by the city. There being no further discussion, the motion carried unanimously. D. Approve the creation of a General Employee Pension Board and Police Employee Pension Board to operate in tandem, and appoint current Board Members Cindy Anderson and Tony Downing to both boards (City Manager) Motion: Approve the creation of a General Employee Pension Board and Police Employee Pension Board to operate in tandem, and appoint current Board Members Cindy Anderson and Tony Downing to both boards. Commissioner Mitchelson inquired if it was appropriate for the two current Board Members to serve on both boards. City Manager Hanson stated that there was no conflict and that many small cities handle their Pension Boards in the this manner. There was no more discussion and the motion carried unanimously. E. There was no discussion and the motion carried unanimously. F. Select a name for the park referred to as "Tresca Property" Mayor Shaughnessy announced that the ribbon cutting ceremony for the opening of the park would be held at 10:00 a.m. on Saturday, October 30, 1999. It was reported that staff had suggested naming the park for Carl Walker, the city's longtime Beautification Coordinator who passed away last year. Mayor Shaughnessy stated that she favored naming the park after Mr. Walker. Dezmond Waters suggested the use of "nature preserve" instead of "park" and that no more parks be named after individuals. Commissioner Mitchelson stated the preferred Osceola Park citing the Native American influence in the area. The following park names were suggested: Mayor Shaughnessy - Walker Waterway Park Commissioner Mitchelson - Osceola Nature Preserve Commissioner Meserve - Tide Views Nature Preserve Discussion ensued and by a show of hands, the Commission unanimously approved Tide Views Preserve as the name for the park, and suggested the park be named in Memory of Carl Walker. 9. City Manager Reports: Former Interim City Manager Thompson: • Reported on a meeting held at the Holiday Inn on Saturday, October 11, 1999 attended by representatives from the Department of Health, the Center for Disease Control in Atlanta and numerous scientists who were present to study the effects of the Red Tide being experienced here at the beach. Mr. Thompson confirmed that the phenomenon was Red Tide and there was no indication on how long it would last. Commissioner Mitchelson inquired if a follow-up report would be provided. Mr. Thompson assured the Commission that the follow up information would be received. 10. Reports and/or requests from City Commissioners and City Attorney Commissioner Borno • Commented that it was not practical to expect yard trash to be cleaned up in 24 - 48 hours after a storm. He felt that the cleanup was quick and systematic and that 10 - 14 days was reasonable considering the volume of debris generated by the storm. Commissioner Mitchelson • Stated that he and Dezmond Waters had been appointed to a committee to review Pension Board recommendations and it was his understanding that the other committee members could not serve. He then inquired if other appointments would be made to the committee. Mayor Shaughnessy indicated that John Fletcher and Dorothy Kerber would not be able to serve on the committee and she would make additional appointments and circulate a letter as soon as the appointees agree to serve. Kosoy, P.E., Director of Public Works '~~~ DATE: October 6, 1999 BACKGROUND: This project is to construct drainage improvements and provide Best Management Practices (BMPs) at various locations throughout the City. The overall project includes drainage improvements on Pine Street, Seminole Road, Palm Avenue, Donner Road, Aquatic Drive, and the Public Works Yard. Construction of at least the base bid items will allow us to "no later than November 15, 1999, begin implementation of the Stormwater Master Plan," as required by Paragraph 16 of the Consent Order OGC 95-2971. Bid invitations were sent to nineteen contractors. Four contractors submitted prequalificationpackagw or letters, and two were prequalified. Several contractors, including one that submitted a prequalificatron package and later withdrew, stated they would like to bid on the project but were too busy. Bids were received by the Awards Committee on September 8, 1999 from the following companies: Bidder Base Bid Add. Alt. 1 Add. Alt. 2 Add. All bidders submitted the required documents with the bid packages, including a 5% Bnd Bond. Monies totaling $350,000 were available for this project in the Stormwater Utility Fund account number 470-0000-538- 6300 and the Streets/Drainage Fund 001-5002-541-6300 during the 1998/1999 Fiscal Year. Because award of the project was deferred during the Commission Meeting of September 27, 1999, there was insufficient time to add this project to the budget for Fiscal Yeaz 1999/2000. Therefore, all funds for the project will have to come from reserves, which were increased by monies not spent in Fiscal Year 1998/1999. In accordance with the specifications, the contract shall be awarded on the basis of the lowest Total Base Bid and any selected Additive Alternate Bid Items. RECOMMENDATION:, Award the low base bid to Petticoat Contracting, Inc. in the amount of $315,878.42. It is further recommended that Additive Alternates 1, 2 and 3, for $58,413.30, $10,395.00 and $37,873.00 respectively be awarded, as these items have been designed in response to numerous citizen requests. Funding from General Fund Reserves in the amount of $122,600 and Stormwater Utility Reserves in the amount of $300,000 is included in Budget Ordinance No. 2099-44, which is also on the Commission agenda for approval. Paragraph 16 does not state that implementation must begin with the core city. Therefore, implementing stormwater projects outside the core city area that reduces the impacts to the sanitary sewer system would also meet the intent of this paragraph. Paragraph 14 of the Consent Order states that improvements shall be made to the core city area beginning with televising and cleaning of the sewer lines. It is the Department's understanding that this has already been ir?itiated. ,, Any improvement to the stormwater system that re-directs stormwater and prevents inflow into the sanitary sewer system is seen as improvement to and meeting the requirements of Paragraph 16 of the Consent Order.
