The lot in question is platted as a 50' deep lot with 71' wide dimension. It is our intention to construct a garage not to exceed 600sft of the lot coverage, not to exceed 25' in height with a 10' rear yard setback, a 5'side yard setback on the north side of the property line, and a 20'front yard setback. The structure will be designed to park two cars, storage space, upstairs climate controlled rooms that will include a bathroom and multipurpose rooms. You recently provided a survey of your property to me, dated August 4, 2017, showing two structures on the portion of your property located easterly of Beach Avenue. No structures are shown to exist on the portion westerly of Beach Avenue. From my discussions and review of the City's Code requirements,two issues have come to bear on your inquiry. First,do the two portions of your property, lying on either side of Beach Avenue,qualify as one lot;and second,does the smaller existing structure shown on the survey,meet the City's Code definition of a"private garage"? If the answer to both of these can be answered affirmatively,then it appears likely that a detached garage located on the westerly portion of your property would be permitted. Two provisions in the City Code weigh heavily in our analysis. First, Section 24-82(b)permits up to a maximum of three structures on any single residential lot. Second, in accordance with Section 24- 151(b)(1)(d), only one detached garage is allowed. Thus, if the small portion of your property located on the west side of Beach Avenue can be considered a part of your residential lot, then you can have up to three structures in total. Second, only one of these three structures may be a detached garage. Thus, the existing smaller structure cannot be considered a detached garage. As I recall from my discussion with you, you stated this second structure was a garage apartment. If both of these can be established, your property would then be considered one residential lot with one detached garage(located westerly of Beach Avenue), one garage apartment and one primary residential structure (both located easterly of Beach Avenue),and the detached garage on the west side of Beach could be permitted. As a result, it will be necessary for two things to occur in order to meet the Code requirements to permit a detached garage on the portion of your property lying westerly on Beach Avenue. First, a deed restriction"tying"the two parts of your property together as one residential lot in perpetuity would need to be signed by you and Mrs. Wolfson and recorded in the Duval County public records. In addition, we would need written confirmation from you that the second smaller structure currently existing on your property meets the definition of a "garage apartment" set forth in the Atlantic Beach Land Development Code. To that end,I have attached a copy of the definition from the Code. Please let me know if you have any questions or need any further information from me.
