Kosoy, P.E. ~~ V DATE: November 3, 1999 AGENDA ITEM NO.~ DATE: /t - D~-9~ Change Order BACKGROUND: On October 26, 1999 the contractor on the 1999 Water Systems Improvements Project, Mr. Gordon Gruhn, advised the City Inspector and Director of Public Works, Messrs. Ernie Beadle and Robert Kosoy, that he encountered very unusual groundwater conditions on East Coast Drive, from 12`h to 15`h Street. These conditions were very unusual to Mr. Gruhn, who has been performing point repairs for the City since 1991 and has been the City's annual point repair contractor since 1996, and is very familiar with most subsurface conditions in the City. He was directed verbally to discontinue work in this area, proceed to another area to avoid any delay in the total project time, and was advised to to submit a letter outlining his request for additional payment. On October 28, 1999 we received a letter from Gordon Gruhn outlining his request, discussed his request with the design engineer, Smith and Gillespie, and on November 2, 1999 received a letter from Gordon Gruhn further substantiating his request. On November 3, 1999 we received a letter from Mr. Doug Layton, P.E. supporting Mr. Gruhn's request for additional payment. BUDGET: Funds are available in the contingency for this project in the amount of $58,118 under Account No. 400-4001-533-6300. RECOMMENDATION: Approve the proposed Change Order in the amount of $14,375.00. FL. 32233-4381 RE: 1999 Water System Improvements, Cit<~ Bid No. 9899-26 Dear Mr. Kosov: This letter is a follow up of our phone conversation on Oct. 26, 1999, regarding thc; need to install wellpoints to allow fot th.e ins±alIation of the new h~elz~e inch water line on East Coast Dr. and Fourteenth Street. The following cost breakdown is based on the assumption that we will have to wellpoint the portion along East Coast Drive from Twelfth St. to Fifteenth St. and from East Coast Dr. down Fourteenth St. to just east of Ocean Blvd. This assumption is based on our field obsen~ation from the test holes eve dug on Oct. 26, 1999. From these observations I feel this would be the worst case scenario. The cost for the wellpointing is inclusive of the additior_al asphalt and other right of wav restoration such as, grassing and landscaping needed to restore the site to original condition. The folio«zng estimate is based on w~ellpointing the entire length discussed above, however if conditions allow the installation of the pipe without the need for wellpoints, our final invoice will reflect the actual quantity installed. Estimated QuantitS~ 1250 lineal feet ~! $11.16 per lineal foot =51-1,37.00 We have installed all the services for this portion of the work and have cut the asphalt for the installation of the main. Jacksonville, FL. 33256 November 2, 1999 Mr. Robert Kosoy Director of Public Works City of Atlantic Beach 1200 Sandpiper Lane Atlantic Beach, Florida 32233 RE: Atlantic Beach Water Line Improvements Dear Mr. Kosoy: This letter is intended to serve as further justification for the change order regarding the need for wellpointing the twelve inch water main on East Coast Drive. Gruhn May, Inc. has been the point repair contractor for the City of Atlantic Beach for the past several years and as a result we have a great deal of experience regarding the need for wellpointing in and around the area. We have also been in underground utility business for the past 27 years. Our contention regarding the need for wellpoints is that the area in questions differs substantially from the surrounding areas. We are currently laying pipe on Beach Ave. and we are excavating in excess of five feet deep and are not encountering ground water elevations as we are on East Coast Drive. Furthermore, we installed the new pipe at 15`'' & Seminole Road without the need for wellpoints. These two areas are at relatively the same elevation as East Coast Drive, however the groundwater on East Coast Drive is only 18" below the surface. It is our contention that this area on East Coast Drive has substantially differing site conditions from the other surrounding areas. In respect to differing site conditions, it would be no different to request a change order for the removal of rock or clay or any other unsuitable material that is not found in the immediate surrounding areas. We feel that the need to wellpoint the entire line section along East Coast Drive is not something any contractor should have or could have anticipated given the information and experience we compiled over the past several years. My previous letter explained that we have included the cost of wellpointing at other locations on this job, more specifically, tie-in locations, crossing under existing utilities and other areas shown on the plans that will require a increased depth of bury.
