Dear Paul:
The division of the subject property into two lots, as depicted on the attached survey
dated May 28, 2004, is hereby approved in accordance with the provisions of Section 24-
189 of the City's Land Development Regulations. As such, the two new parcels are
recognized as legal Lots of Record. The approved survey must be recorded as an
addendum to any future deed transferring title of each parcel, and any future property
owner(s) will be required to submit a copy of this approved survey along with any
application for a Building Permit.

Per our conversation on May 18th and your April 9th email to Ralph Marcello, I have had
Boatwright Land Surveyors prior a Site Plan of our parcel on Richardson Lane. The Site
Plan shows the parcel being divided into two equal lots of 7,532 square feet each..
I am in the process of preparing Building Permit Requests to construct a duplex on each
A these lots. If all goes well, construction will start in early July. As such, would you
provide us with a letter recognizing the lots as a legal division of the property. In
addition, I would really appreciate it if you could help me with a legal description of the
lots that I can use on the Building Permit Requests, architectural and engineering plans,
Notice of Commencements, etc.

Dear Mr. Marcello:
In considering the several options that might be used to address the Richardson Lane
roadway issue, the City proposes to prepare and have recorded a plat, or an amended
plat of this area, which would establish the proper right-o&way for Richardson Lane,
and also include the two new lots that Beaches Habitat has proposed to develop within
this plat. A portion of Richardson Lane is within the E.H. Donner's Subdivision, but
the property immediately north of Donner's Road and east of Richardson Lane consists
of un -platted tracts of land.
Section 95.361, Florida Statutes, establishes a presumption of dedication of this
roadway to the City, but since this is not a particularly large area, and the City has a
current survey of Richardson Lane, I believe that the recording of a plat is the clearest
way to resolve this issue. In the event that your plans to develop the two lots precede
the completion of the platting process, the City will recognize the property purchased
by Beaches Habitat, and the proposed division of this tract into two lots as a legal
division of property with each lot entitled to each be developed with a two-family
dwelling. Please feel free to contact me at 247-5817 with any questions, and I will
advise as we initiate this process.
