The property is comprised of lots 2, 4 and 6 of block 7 of the Atlantic Beach Subdivision plat where lot 2 is what you wanted to sell. The Duval County Property Appraiser's Office (PAO) shows these three lots as a single property with a single RE number. Recorded deeds show that you originally owned lot 6 and later bought lots 2 and 4 at the same time under separate deeds. It appears that the PAO then combined the three lots into a single RE number at some point. This would not have been allowable under any zoning code since the purchase of lots 2 and 4 due to the existence of two single family homes that were then on a single parcel. So the current PAO depiction of the property is not valid by City standards. At this point we needed to establish what formation of the three lots does the City recognize and could the proposed division be approved. It is possible that lots 2 and 4 should be considered as one property since they were bought at the same time from the same owner. However, in 1997, lots 4 and 6 were presented as a single property for the construction of a pool and pool house. A subsequent survey shows that lot 2 has a conforming single family structure and can stand independently as its own property. This validates the property shown in the 1997 permit and proves that lot 2 can and should be independent of lots 4 and 6. Due to these facts, the City does not object to the sale of lot 2 as this is the recognized propert y configuration for these three lots despite how the PAO represents them. This means that lot 2 is a legal lot of record that can be developed or redeveloped just like any other lot in Atlantic Beach subject to applicable codes. Sincerely, Derek W. Reeves Planner
