Exh 9~~ ~J -~ ~' 9~ City Manager Report November 8, 1999 Fire Inspection Fees; The Atlantic Beach Fire Department used to charge fees for fire inspections. Inspections are now performed by the Jacksonville Fire Department and fees for fire inspections have not been charged. Charging fees for inspections performed by others would be a cumbersome and difficult process. Atlantic Beach Staff has taken the position that the fees imposed in the Atlantic Beach Code apply only to inspecrions performed by Atlantic Beach employees. Therefore, because our employees have not done any inspections, fees have not been charged. Unless instructed differently by the City Commission, staff will continue with this interpretation. The annual value of these fees was approximately $4,000 per year prior to contracting with Jacksonville for fire services. See the attached staff report from David Thompson for more information and other options. FEMA Reimbursement for Hurricane FIoyd; Final reimbursement requests have been submitted to FEMA for expenses totaling $42,448. FEMA is expected to reimburse 75 percent of the cost or $31,836. The State is expected to reimburse another 12.5 percent or $5,094. Total reimbursements are expected at $36,930. Christmas Tree Lighting; Tentative arrangements have been made for the annual lighting of the Christmas Tree to be done at approximately the same location as last year (Town Center) on Saturday, December 4, 1999 Street Sign Repairs/Replacements; Many of the street signs (stop, no parking, and other signs) in Atlantic Beach have been defaced with stickers, discolored by natural growth, or obstructed by branches. The Police Department provided a list of sign repairs needed to Public Works and repairs, replacements, or trimming has been accomplished at 23 locations. See the attached memorandum from Bob Kosoy dated 10/27/99 for additional information. The City will continue to replace/clean the signs as needed in the future. Grant Writer; Several people have asked about the status of the $20,000 budgeted in the FY99-00 Budget for hiring a grant writer. This has been budgeted for a couple of years with no action taken. After discussion with David Thompson, we have agreed that it is unlikely that an individual could be hired to provide this service for the amount budgeted. A second alternative is to contract with a company to provide this service, although the typical cost for handling all city grants would also exceed our budget. We anticipate that other alternatives exist with grant writing companies and intend to meet with Y representatives from at least one company to explore these alternatives within the next couple of weeks. The Commission will be advised of our fmdings as soon as they are available. Utility bills to CitX accounts; As indicated in the last report, utility bills have been issued for all City uses. The attached report entitled "City Meters 10/26/99" lists each of the accounts. The "Aug..Consump" column shows the average amount of water used over the last year, or since the meter was installed. Many of these accounts are for irrigation and the volumes of water used are significant. By comparison, an average household may use 7,000 to 8,000 gallons per month without irrigation. City department heads are currently reviewing these bills. Janitorial services; While some parts of City Hall and the Police Station have been cleaned regularly, other parts have not been done and the overall appearance could be improved. Input from employees from several City departments has been consolidated into a new set of specifications for janitorial services for and bids will be solicited within the next month. Several new tasks have been added to the daily, weekly, and monthly schedules and some other tasks have been deleted for reduced in frequency. For example, the carpets will be vacuumed once a week instead of three days per week. The intent is to improve the overall appearance of city buildings through an improved maintenance schedule and better coordination with the contractor. Boil Water Notice on Sandcastle Lane; For the second time in recent weeks, contractors on the Wonderwood Connector have broken a city water main and a Boil Water Notice has been issued. This most recent notice occurred on Monday, November 1 and affected 30 homes on Sandcastle Lane. As before, notices have been hand delivered to each house and notifications will be delivered to the same as soon as testing has established that no contaminants have entered the system. Emergency pump replacement; A pump at one of the City's sewer lift stations burned out and was replaced on an emergency basis on 10/17 at a cost of approximately $8,000. Certificate of Appreciation; John Delaney, Mayor of Jacksonville, has sent a Certificate of Appreciation to the City of Atlantic Beach for assistance in activation of the Emergency Operation Center during Hurricane Floyd from September 13 to September 16, 1999. Thomp~~i- Subject: Fire Inspection Fees Date: October 15, 1999 In 1998, the City's Fire Code was changed to implement fees to be charged for Fire Inspections. This was intended to provide a funding source to offset the costs of fire inspections conducted by Atlantic Beach Firefighters. See attachment. However, since that time, Atlantic Beach has entered into a contract with the City of Jacksonville, and Atlantic Beach is no longer conducting inspections. Jacksonville does not charge for inspection work, so the business are receiving the services at no direct cost. Procedurally, the Atlantic Beach Firefighters were handling the billing and collections of the fees. When they contacted the businesses for inspections, the fire inspector(s) advised the business of the inspection fees, and to have a check ready at the time of the inspection. When the inspection was completed, the check was taken and the business was provided with a receipt. The check was then turned in to the finance department for processing. In the absence of firefighters performing this service, there is no mechanism to impose the fees. Since the contract went into effect on June 1, 1999, Atlantic Beach has not billed or collected any of the inspection fees. The contract does not address the inspection fees. It appears that we have several options: 1. Staff can interpret the code as applying to inspections performed by Atlantic Beach Firefighters, and it does not apply to inspection performed by Jacksonville. Since we are not doing inspections, we simply do not collect any fees. Jacksonville has told me that they are not interested in collecting the fees because they provide this service throughout Duval County without charging. They would have to create an administrative process to implement the fees, and they are not inclined to do so. The actual revenue generated from these fees was $4,075 in 1998, and $2,835 in 1999. However, no revenue was included in budget revenues for 1999-00. 2. Atlantic Beach could obtain the inspection information from Jacksonville, and Atlantic Beach could bill the businesses for the inspections. This is a possible solution that would generate some revenue from the businesses. However, it would require coordination with Jacksonville, who has already Mr. Jim Hanson, City Manager Page 2 October 15, 1999 indicated that they are not interested is setting up additional processes for the collection of fees. We could probably force the issue and require them to provide the inspection information, but coordinating re-inspections and various types of inspections for our jurisdiction could be cumbersome for Jacksonville and Atlantic Beach. Additionally, there could be some backlash from businesses who have been receiving the service without charge. 3. Atlantic Beach could change section 7-30 of the City Code and eliminate the fees. This would eliminate the fees and resolve the issue. Again, this would eliminate approximately $4,000 in possible revenues annually. 4. This issue could be brought to the Atlantic Beach City Commission to review and resolve. They could impose a policy statement and direct staff relative to this issue. Recommendation: After reviewing the various options, the best solution may be to implement Option #l. This is essentially how it has been interpreted since June 1, 1999. To assure that the Commission is aware of this interpretation, it may be added to a City Manager report where it does not require any action on the part of the Commission. Environmental Protection Agency (EPA) and the Florida Department of Environmental Protection (FDEP)_ Malutorizig for some contaminarns is required less often than once per year, because concentrations of these constituents are not expected to vary significantly from year to year. The monitoring requirements are determined by regulatory agencies based upon their research in the area of water quality and contamination. Testing for many substances zioted in our water duality report is requited every 3 years. Per EPA and FDEP requirements, we reported the most recent test results. The study's purpose is ~to determine levels of bacteria in the surf. Dry and wet weather conditions will be analyzed between July 1, 1999 and June 30, 2000. Bacterial data from this study will be combined with rainfall data from sampling events to develop a correlation between the amount of rainfall and increases in bacterial levels. This research is based on the amount Enterococci bacteria found per 100 ml of marine water. According to the EPA studies on bacteria, the density of the Entercocci `P bacteria as an indicator group in seawater shows the best relationship to swimming-associated gastroenteritis. Gastroenteritis illnesses were significantly associated with polluted water and did show a functional relationship to water quality treasured with this bacterial indicator.
