The consensus of the board was that no hardship exists and each member cited reasons why they opposed granting the variance. After discussion, Mrs.Walker moved to deny the variance request and Mr. Frohwein seconded the motion. After further discussion, the board voted unanimously to deny the variance. ll. Application for Use-by-Exception filed by Atiflio and Cathy Cerqueira to allow for storage of boats and recreation vehicles at property known as Lots 1 through 7, Block 32, Section H. Mr. Cerqueira introduced himself and stated that he desires to construct a sheltered area for storage of RV's and boats. He stated that the flyover that is being constructed will limit his ability to lease the property for retail usage. Mr. Worley stated that the request is unusual. He stated that the property abuts residential neighborhood to the west, however,across the street to the south JTA will build a retention pond and this property will be impacted. He stated that the applicant has been en' diligent in complying with prior variances granted on other properties. He added that the problem he sees is the large vehicle parking lot requiring much more maintenance than an occupied building, but conditions imposed by the board would help mitigate any adverse impact. Mr.Wolfson voiced concerns with the physical appearance of an open structure and signage at the site. He requested that the east and west ends be enclosed. He also questioned the sizes of the individual spaces and turn around room. Each member expressed to the applicant that more information was needed for them to make a recommendation to the City Commission and requested a clearer conception as to landscaping, buffering, ingress and egress, setbacks, building elevations, water retention, signs, lighting, and size and location of the structure on the property. The applicant stated that he is faced with a hardship and is asking for the use-by- exception because of the hardship. He stated that he has a right to put a building on the property. He added that he would have to comply with all of the city's requirements prior to the issuance of a building permit. After discussion, Mr. Burkhart moved to defer the application until the next meeting. Mr. Frohwein seconded the motion and it passed unanimously. Mr. Worley reminded the board of the workshop meeting with the City Commissioners scheduled for Monday, July 24, 2000 at 5:00 p.m. AGENDA ITEM: # 4. b. Application for Use-by-Exception to allow warehousing of boats and RV's in covered storage on Lots 1 through 7, Block 32, Section"H" in the CG, Commercial General district. The applicant desires to construct a sheltered area for storage of RV's and boats. The storage of vehicles in the CG district has been interpreted in the past as a use similar to limited warehousing, including mini-warehouses (Sec. 24-111(c)(7)). The proposed Use is to be conducted in a roofed-over area covering the center portion of the block. The proposed building will not have walls, only a roof. This request is somewhat similar to the outside storage of vehicles permitted by Exception at Pan Am Mini-storage. The vehicles will be stored for varying lengths of time in a secured and roofed area. The size, construction and setbacks for the building must meet existing building and zoning codes. The Exception is for the proposed use only. Staff believes that the proposed use could be accomplished in a manner that would not degrade the immediate neighborhood through careful placement of the structure and extensive landscaping. Accomplishing this would be no easy task and it will present an on-going maintenance problem. It is likely that the economically feasible uses of this land will be limited by the Flyover construction. However, the proposed use creates a significant visual impact, with or without the roofed structure and will also produce some vehicular traffic to and from the site. This property abuts a residential district on its eastern boundary and the storage of vehicles is rarely perceived as a compatible use adjacent to residential lots. If it is the Board's desire to recommend approval of this Use, Staff recommends the following conditions be placed upon such recommendation: 1) The structure must comply with all building and zoning codes including setback and height requirements. 2) The site must meet or exceed all landscaping code requirements including the buffer requirements between incompatible uses. 3) Parking spaces for customers vehicles and vehicles for storage must be clearly marked on the site. 4) All vehicles stored on the site must be stored under the roofed structure. After a considerable amount of discussion, the City Commission voted to defer any decision on your application until they are able to review a detailed landscaping plan. This letter is to inform you of the City Commission's decision and request that you prepare such a plan and return it to Don Ford, Acting Community Development Director with the City of Atlantic Beach at your earliest convenience. The Commission had a copy of the small drawing that was presented with your application, which gave an indication that some landscaping would be installed along the side of West 5th Street. The Commission was specifically concerned with what type of landscaping materials you would use, how tall the materials would be when they were planted, and the specific locations around your lot for those plantings. The Commission's concern was about screening the stored vehicles from the view of the public. Attached for your information is a copy of the staff report that went to the City Commission which includes a list of recommendations for approval by the Community Development Board. Your landscaping plans should, at a minimum, comply with all of the applicable recommendations.
