A code enforcement inspection at 1610 COQUINA PL was conducted on 1/14/2021. The City of Atlantic Beach Code Enforcement has found your property to be in violation of the City of Atlantic Beach Code of Ordinances: NATURE OF VIOLATION: The gate facing Coquina and enclosing your pool does not meet the requirements for pool fencing stipulated in the Florida Building code. On 1/14/2021 the gate was standing wide open, leaving your pool area open and accessible. The open gate only contained a hook and eye closure and there was no self- latching locking device on the inside of the gate as required by code. VIOLATION CODE: Sec.6-16.Adoption of Florida Building Code(FBC).There is hereby adopted,subject to any modifications,changes and amendments set forth in this article,and for the purpose of establishing rules and regulations for the construction,alteration,removal,demolition,equipment,use and occupancy, location and maintenance of buildings and structures,including permits and penalties,that certain building code known as The Florida Building Code established by Florida Statutes Chapter 553,Part VII,as amended from time to time so that the latest edition of the Florida Building Code shall apply and the International Property Maintenance Code,most recent edition. in the office of the city clerk,and the same are adopted and incorporated as fully as if set out at length in this article,and the provisions thereof shall be controlling in the construction of all buildings and other structures within the city. In accordance with FBC Section R4501.17.1.8 Access gates,when provided,shall be self-closing and shall comply with the requirements of R4501.17.1.1 through R4501.17.1.7 and shall be equipped with a self-latching locking device located on the pool side of the gate.Where the device release is located no less than 54 inches from the bottom of the gate,the device release mechanism may be located on either side of the gate and so placed that it cannot be reached by a young child over the top or through any opening or gap form the outside.Gates that provide access to the swimming pool must open outward away from the pool.The gates and barrier shall have no opening greater than 1/2 inch within 18 inches of the release mechanism. This letter requests that the noted violation(s) be corrected by immediatly assuring the gate remains closed and replacing the hook and eye latch with a self closing latch within 24 hours of the receipt of this notice. Failure to correct the violation by the required date may result in this case being referred to the Code Enforcement Special Magistrate resulting in fines up to two hundred fifty dollars ($250.00) per day.
