Dear Mr. Schneider,
In response to your recent Local Business Tax Application for Executive Auto Sport at
155 Levy Road Unit D has been approved for zoning. After discussion of the nature of your
business staff has determined that your business most closely resembles Section 24-112
permitted uses: (1) Wholesaling, warehousing, mini-warehouses and personal self-storage,
storage or distribution establishments and similar uses; (4) Contractor’s yards with outdoor
storage; and (8) minor automotive repair, and boat, trailer or surfboard repair of a minor nature.
This determination was determined based on your use description of a limited number cars stored
fully within an enclosed building that may require occasional minor repairs and a few off -site use
contracted work related trailers and trucks stored outside but within the property and that little to
no on-site customer interaction is expected.
Going forward there are a few pieces of code within the City’s Land Development
Regulations (LDR) that are expected to be maintained. As part of Section 24-112 (b)(4); required
front yards yard shall not be used for storage, and a six foot visual barrier shall be installed
around such storage areas so as to conceal view from adjacent properties and streets. In this case
the front yard of the property is along Levy Road and because you r unit is along the side of the
building that is not a concern, but it is expected that you make efforts to provide visual screening
in addition to the 6 foot fence already in place. The automotive repair portion of the business will
not go to a level considered heavy automotive repair that is defined in the City’s LDR as, “the
repair, rebuilding or reconditioning of motor vehicles or parts thereof, including collision
service, painting and steam cleaning of vehicles. Section 24-160 requires commercial dumpsters
and trash receptacles to be screened from view. Placing your trash receptacles within your fenced
area should provide adequate screening. Section 24-161 which addresses parking areas states
among other things that areas used for parking must be paved and that no business activities
occur within parking areas.
Your business is being approved for this location only and for the above described uses
