1291 Beach Avenue DEP Letter 09.16.2020 September 16, 2020 Mr, Kevin Partel 4230 Myrtle St St. Augustine, FL 32084 Re: 1291 Beach Avenue FDEP Letter Mr. Partel, The City of Atlantic Beach conducted a preliminary review of your modified plans, specifically sheets P-1 through P-4 prepared by Christopher C. Kathe, Inc., dated July 24, 2020 and August 5, 2020, regarding placement of fill excavated from the proposed swimming pool at 1291 Beach Avenue east of the existing single-family dwelling and construction of a retaining wall under the existing cantilevered deck. Fill resulting from the pool excavation that was originally intended to be placed under the pool deck has now been temporarily placed on the property east of the existing single-family dwelling. Placing fill in the locations proposed in your modified plans is in contravention to City of Atlantic Beach zoning codes, specifically Section 24-70. Our understanding is that a variance from the City’s zoning codes will be requested to authorize the permanent placement as depicted on the modified plans. If this variance request is denied, it is our understanding that the fill will then be placed on the beach berm seaward of the vegetation line shortly after the end of turtle nesting season on October 31, 2020. If a variance is granted, revised plans will need to be submitted in accordance with the approval as well as any conditions placed on the approval by the Community Development Board. Placing the fill on the beach berm seaward of the vegetation line will not contravene any local setbacks or zoning codes. This letter does not constitute an approval by the City. The project must still be submitted to the City in a permit application and be approved by all applicable departments prior to approval.
