2291 Oceanside Court DEP Letter 06.09.2015 June 9, 2015 2291 Oceanside Court DEP Letter Request Response Anthony Hicks, In response to your request for a letter to DEP stating that your project at 2291 Oceanside Court does not contravene Atlantic Beach codes, staff cannot at this time provide such a letter. There are multiple issues with the project relative the City’s code that must be resolved prior to such a letter being written. Section 24-151 requires all accessory uses and structures over 30 inches in height to be at least 5 feet from side property lines. The deck on both the north and south side are within 5 feet of the property line. Additionally, the covered portion of the deck is too close to the north property line. There are two ways to look at the covered area. The current configuration would be to consider the covered area as an extension of the house. This is because it is within 5 feet of the house and would be considered part of the house by code. However, this would mean that the covered area must meet the same setbacks as the house (i.e. 7.5 feet from the north property line). The second way to look at the covered structure is as an independent accessory structure. With an interpretation that the structure is most similar to a carport (based on size and open walls), the covered structure would have to be moved at least 5 feet from the house and 5 feet from the north property line. The problem with this plan is that the maximum height is 15 feet from grade which would likely make this option impossible for your desired outcome. Until these issues are resolved, staff cannot provide the requested letter to DEP. Once the plans are revised, staff can review the project again. Derek W.
