2337 Seminole Road 11.13.2006 (Lot Split)Sonya,
There are currently 2 single family detached homes on the parcel listed below (the zoning is multifamily). The owner proposes to add a 3rd home to the property (all 3 homes would comply
with the zoning code requirements).
Prior to building the 3rd home, the owner plans to create a land condominium with 3 units. An article briefly summarizing land condos is attached. The big difference between a traditional
condo and a land condo is that with a land condo the unit consists not just of the dwelling but also the dirt beneath and around it. Thus a unit would consist of a portion of the existing
lot and the home on it.
The land condominium form of ownership would allow the owner to sell off one or more of the units. No platting or lot split would be necessary. The land condominium would be done in
lieu of a lot split.
Do you see any issues with doing a land condo here? I would like to ensure that, once the condo is complete, there won't be problems pulling a building permit for the 3rd house.

This property is not large enough to be divided. Any new lot is required to have a minimum of 75-feet in width and 7500 square feet in lot area, except for the RS-L district which requires
100' x 100', 10,000 square foot lot area minimum. Lot division is a very contentious issue in AB. In any case, there is a moratorium on lot divisions in place now.
