The City has continued to receive complaints from nearby businesses and residents related to obstruction of traffic and driveways and the use of nearby properties by your clientele. Parking along Sturdivant Avenue also creates the potential for a public safety hazard. Parking associated with your business must be contained on your property unless a private parking agreement or lease is established with a nearby property owner. Property owners are fully within their rights to have unauthorized vehicles towed from their property, and several nearby property owners have informed the City of their intent to do so. Within the coming week, the City will be posting "No Parking" signs along Sturdivant Avenue. Please be sure to advise your clientele that they are at risk of being towed if they improperly park on private property, and that they are at risk of being ticketed if they park along Sturdivant Avenue within the public street right-of-way. Your building is a lovely addition to Atlantic Beach, and we congratulate you on your obvious success, but I must remind you that concerns about adequate parking were discussed at your Variance public hearing. You assured the Community Development Board that parking would not be a problem, noting that your clientele often came by bike or foot. I would encourage you to seek solutions that work to the benefit of your business and your neighbors. Please feel free to call me at 247-5826 if you have any questions. Sincerely, Sonya Doerr, AICP Community Development Director October 15, 2008 Joe and Paula Puopolo 1580 Beach Avenue Atlantic Beach, FL 32233 Dear Joe and Paula: When you petitioned the City of Atlantic Beach for a variance on the size of your newly constructed building located behind us the issue of parking was raised. At that time I questioned the City about the availability of parking for your project. I made the statement that people frequenting your building would be parking in my back parking lot and on the neighbor's side yard across the street from the front of your building. Of course, all of this has come true with the completion of your building. For a month now we have watched and photographed cars going to Ocean Yoga and to the other tenant's place of business parking on my property and the neighbor's property across the street from you. Not surprisingly, no one ever contacted me about using my back parking lot just like I was never contacted by you prior to your requesting your variance. On October 13, 2008 we completed the posting of towing signs on the property both at the front and back entrances of my property. On October 14, 2008 at 6:30 p.m. there were seven cars parked in my back parking lot. As a courtesy, I am letting you know that we are now towing cars from the parking lot, both front and back. COMMUNITY DEVELOPMENT DEPARTMENT STAFF REPORT January 16, 2007 Public Hearing ZVAR-2007-02, Joe and Paula Puopolo To: From: Date: Subject: Applicant: Community Development Board Planning, Zoning and Community Development Department January 8, 2007 ZVAR-2007-02 Peter Coalson (on behalf of Joe and Paula Puopolo) 1825 North Third Street Jacksonville Beach, Florida 32250 Request: Request for a two-part Variance to reduce the dimension of parking space sizes from 10 -feet by 20 -feet to 9 -feet by 18 -feet and to reduce the rear yard setback from 20 -feet to 10 -feet to serve a new professional office project to be located at the southeast corner of Sturdivant Avenue and Pi Street.! Existing Zoning:Commercial General(CG)-5C STAFF COMMENTS The subject property is a 50 x100 -foot vacant commercial parcel located at the southeast corner of Sturdivant Avenue and Pine Street. The proposed use is an approximately 3000 square foot two-story office building. The Applicant has requested this variance to reduce parking space dimensions from 10 -feet by 20 -feet to 9 -feet by 18 -feet. The Community Development Board has approved three similar requests during the last year where stormwater requirements or site characteristics constrained use of the property. Stormwater requirements have not yet been determined for this property, but this is a very small lot, and while it has always been commercially zoned, its small size limits its typical commercial use. The application also requests a reduction in the south side, rear yard setback to 10 - feet. This side of the lot faces an existing commercial building. Staff finds that a small scale office building is appropriate for this lot. Staff has no objection to this request, and finds the request consistent with prior actions of the Community Development Board and also with Section the terms of Section 24-64, specifically condition (d) (3). Gso SUGGESTED ACTION TO RECOMMEND APPROVAL The Community Development Board may consider a motion to appr v this request for a Variance to reduce the dimension of parking space sizes from 10 -feet by 20 -feet to 9 -feet by 18 -feet and a o -to - or a new building be located at the southeast corner of Sturdivant Avenue and Pine Street, provided: ❑ 1. There are exceptional topographic conditions of or near the property. 2. There are surrounding conditions or circumstances impacting the property disparately from nearby properties. ® 3. There are exceptional circumstances preventing the reasonable use of the property as compared to other properties in the area. Small size of this lot limits commercial use of property compared to other surrounding commercial properties F-14. There are regulations, which were enacted after platting or after development of the property or after construction of improvements upon the property, that have onerous effect upon current use and development of the property. F-15. The property is of irregular shape warranting special consideration. ❑ 6. The lots are of substandard size warranting a Variance in order to provide for the reasonable Use of the property. SUGGESTED ACTION TO RECOMMEND DENIAL The Community Development Board may consider a motion to deny this request for a Variance to reduce the dimension of parking space sizes from 10 -feet by 20 -feet to 9 -feet by 18 -feet and also to reduce the rear yard setback from 20 -feet to 10 -feet for a new building to be located at the southeast corner of Sturdivant Avenue and Pine Street, provided: ❑ 1. There are no exceptional topographic conditions of or near the property. F-12. There are no surrounding conditions or circumstances impacting the property disparately from nearby properties. ❑ 3. There are no exceptional circumstances preventing the reasonable use of the property as compared to other properties in the area. F-14. There are no regulations enacted after platting or after development of the property or after construction of improvements upon the property having an onerous effect upon existing use and development of the property. ❑ 5. The property is not of irregular shape warranting special consideration. ❑ 6. The lots are not of substandard size warranting a Variance in order to provide for the reasonable Use of the property.
