On, January 16, 2007, said request was considered at a public hearing by the Community
Development Board for the City of Atlantic Beach. Having considered the application, supporting
documents and comments by the Applicant, the Community Development Board, approved the
request, finding this request to be consistent with Chapter 24-64 of the Land Development
Regulations.
NOW THEREFORE, the Community Development Board hereby GRANTS this request to reduce
the dimension of parking space sizes from 10 -feet by 20 -feet to 9 -feet by 18 -feet for serve a new
development at the southeast corner of Sturdivant Avenue and Pine Street. (Saltair, section 1, Lot 800)

As I know you are aware, parking has become a routine problem during the hours surrounding
some of your class times. The City has continued to receive complaints from nearby businesses and
residents related to obstruction of traffic and driveways and the use of nearby properties by your
clientele. Parking along Sturdivant Avenue also creates the potential for a public safety hazard.
Parking associated with your business must be contained on your property unless a private parking
agreement or lease is established with a nearby property owner. Property owners are fully within
their rights to have unauthorized vehicles towed from their property, and several nearby property
owners have informed the City of their intent to do so.
Within the coming week, the City will be posting "No Parking" signs along Sturdivant Avenue.
Please be sure to advise your clientele that they are at risk of being towed if they improperly park
on private property, and that they are at risk of being ticketed if they park along Sturdivant Avenue
within the public street right-of-way.
Your building is a lovely addition to Atlantic Beach, and we congratulate you on your obvious
success, but I must remind you that concerns about adequate parking were discussed at your
Variance public hearing. You assured the Community Development Board that parking would not
be a problem, noting that your clientele often came by bike or foot. I would encourage you to seek
solutions that work to the benefit of your business and your neighbors. Please feel free to call me at

STAFF COMMENTS
The subject property is a 50 x100 -foot vacant commercial parcel located at the southeast corner of
Sturdivant Avenue and Pine Street. The proposed use is an approximately 3000 square foot two-story
office building. The Applicant has requested this variance to reduce parking space dimensions from
10 -feet by 20 -feet to 9 -feet by 18 -feet. The Community Development Board has approved three
similar requests during the last year where stormwater requirements or site characteristics constrained
use of the property. Stormwater requirements have not yet been determined for this property, but this is
a very small lot, and while it has always been commercially zoned, its small size limits its typical
commercial use. The application also requests a reduction in the south side, rear yard setback to 10 -
feet. This side of the lot faces an existing commercial building. Staff finds that a small scale office
building is appropriate for this lot. Staff has no objection to this request, and finds the request
consistent with prior actions of the Community Development Board and also with Section the terms of
Section 24-64, specifically condition (d) (3).

habitat, Protected Trees, or other significant environmental resources.
(7) the general health, welfare or beauty of the community.
Variances shall not be granted solely for personal comfort or convenience, for relief from financial
circumstances or for relief from situations created by the property owner.
The following paragraph sets forth reasons for which a Variance may
be approved. Please check the circumstances that apply to your
request and briefly describe in the space provided.
(d) Grounds for approval of a Variance. A Variance may be granted, at the discretion of the Community
Development Board, for the following reasons.

(f) Approval of Lesser Variances. The Community Development Board shall have the authority to approve a
lesser Variance than requested if a lesser Variance shall be more appropriately in accord with the terms
and provisions of this Section and with the Purpose and Intent of this Chapter.
(g) Nearby Nonconformity. Nonconforming characteristics of nearby Lands, Structures or Buildings shall
not be grounds for approval of a Variance.
(h) Waiting period for re -submittal. If an application for a Variance is denied by the Community
Development Board, no further action on another application for substantially the same request on the
same property shall be accepted for 365 days from the date of denial.
(i) Time period to implement Variance. Unless otherwise stipulated by the Community Development Board,
the work to be performed pursuant to a Variance shall begin within six (6) months from the date of
approval of the Variance. The Community Development Director, upon finding of good cause, may
authorize a one time extension not to exceed an additional six (6) months, beyond which time the
Variance shall become null and void.
(j) A Variance, which involves the Development of Land, shall be transferable and shall run with the title to
the Property unless otherwise stipulated by the Community Development Board.

will need to talk to him prior to completing the application. The variance will ask for a
