These standards are set forth in the International Property Maintenance Code and the Florida Building Code and were adopted as part of the City of Atlantic Beach Code of Ordinances in Chapter 6, Article II, Section 6-16. A code enforcement inspection at 150 ARDELLA RD was conducted on 4/2/2021. The City of Atlantic Beach Code Enforcement has found your property to be in violation of the City of Atlantic Beach Code of Ordinances: VIOLATION CODE: Sec. 23-30. -Minimum tree requirements. These minimum tree requirements shall apply to all property within the city that is subject to the provisions of this chapter. Credit will be given for trees on the Atlantic Beach Recommended Species List, but none will be given for trees on the Atlantic Beach Prohibited Species List, (1) Residential uses. For each parcel upon which a single-family,two-family or multifamily dwelling unit, or associated residential accessory unit is proposed,or where the primary activity is residential in nature: One(1)four-inch caliper tree shall be planted and/or preserved for every two thousand five hundred (2,500)square feet of development parcel area or portion thereof, excluding therefrom preserve areas and water bodies. Of the minimum required trees, one(1)tree shall be provided or preserved within the required front yard. NATURE OF VIOLATION: All three mature trees were removed from the front yard. In accordance with code, it is not permissible to clear a lot such that it does not meet the minimum tree coverage required by code. One 4" caliper tree is required for each 2.500 square feet of lot area.One of those trees must be in the front yard. Your 95 x 90 foot lot has an area of 8,550 square feet. A minimum of three 4" caliper trees is required and one of those trees needs to be planted in the front yard. Citrus trees do not meet this requirement. This letter requests that the noted violation(s) be corrected by planting three 4" caliper trees in the yard within thirty(30)days of the receipt of this notice. The City of Atlantic Beach Code Enforcement has found your property to be in violation of the City of Atlantic Beach Code of Ordinances: 1. NATURE OF VIOLATION: A stop work order was posted on this property on 2/4/2022 for installation i of a porch railing with no permit. To date, no permit has been issued for this project. APPLICABLE CODE: FBC Section 105 Permit 105.1 Required. Any owner or authorized agent who intends to construct,enlarge,alter,repair, remove,demolish, or change the occupancy of a building or structure, or to erect, install,enlarge,alter,repair, remove,convert or replace any required impact resistant coverings, electrical,gas, mechanical or plumbing system,the installation of which is regulated by this code, or to cause any such work to be done, shall first make application to the Building Official and obtain the required permit. This letter requests that the noted violation(s) be corrected by obtaining a valid permit within 10 days of the receipt of this notice. 2. NATURE OF VIOLATION: A hen coop has been installed in the back yard of the property. No Hen permit has been obtained from the City and the coop, as installed, does not meet code. There is no fence or comparable landscaping that screens the coop and pen. APPLICABLE CODES: Sec. 4-42. - Permit required. (a) Any person seeking to keep a hen on their property must first obtain a city permit authorizing such use. Sec.4-45.- Required improvements. The following improvements to a property shall be required and completed at the time of the inspection before permit issuance and throughout the duration of an active permit to keep hens on a property: (a)An enclosed pen that is: iiI (1)At least ten(10) square feet per hen; and (2)Well drained so that there is no moisture accumulation. (b)A coop that is: (1)At least three(3) square feet per hen; (2) Covered,ventilated,to allow for a wholesome exchange of air;and (3) Attached to or within an enclosed pen that allows for free movement between the coop and enclosed pen. (c) Coops and enclosed pens shall: (1)Not exceed six(6)feet in height; (2)Not exceed one hundred(100) square feet in total area; (3)Be fully enclosed and secured from predators;and (4) Be anchored in a manner acceptable to the community development director to prevent them from becoming airborne during a wind event. (d) Opaque fencing that is six (6) feet tall or comparable landscaping that screens coops and enclosed pens from view by adjoining neighbors. This letter requests that a hen permit application be submitted to the City within 10 days of receipt of this notice. Please note,that the coop cannot be approved as it exists. If installing a fence to meet code, a separate fence permit will be required prior to installation of the fence. As there is an active Stop Work Order on this property,the railing permit must be obtained before any other permits can be issued. Thank you for your cooperation in this matter.
