Shane Corbin, City Manager
Abrielle Genest, Planner
City of Atlantic Beach
Re: Tree removal at 2135 Seminole Rd
Dear Mr. Corbin and Ms. Genest,
We (Mary Beth Charles and Steev Ditamore) are the new owners of the home at 2135 Seminole Rd. We
made a deliberate decision to purchase in Atlantic Beach, as opposed to Neptune or Jax Beach, because
we wanted to live in a homey neighborhood with mature vegetation, as opposed to a concrete jungle.
Eager to beautify our property to match that of the surrounding homes, we recently undertook the
immense task of cleaning all the weeds, vines, and dead trees from the front yard. The photos below, from
Google Maps in 2018, depict our yard as seen from the road before we began the work:
Here are our own photos from last week when we began clearing brush from the front yard near the road:
As much as we love trees and nature (especially Mary Beth, who is a wildlife biologist), our yard was not
only unsightly, but unsafe for our 4-year-old to play in. So, on March 22, 2021, we removed several small
trees (under 8” diameter) that were dead and being choked out by all the vines that had been allowed to
grow unchecked for years. We followed the flowchart from the COAB website to make sure we were
complying with the guidelines for tree removal:
We received a visit the following day, March 23rd, from Abrielle and Angela Irizarry about a few trees we
cut that were over 8” in diameter. Even though they were all dead, we understand the perception that a
homeowner may have a conflict-of-interest when claiming that trees they cut down are dead; so, we had
an arborist come out, at a cost of $150, and confirm that the larger trees were, in fact, all dead trees.
However, we had another visit today from Abrielle and another inspector about the same tree removal
event on the 22nd. They told us today that the city had additional concerns that weren’t mentioned on the
23rd – specifically, that our removal included 4 trees near the road that were on the city’s right-of-way.
Please accept our apology that we didn’t consider where our property line ended and the city’s began.
The inspectors told us that, despite the fact these 4 trees were all under 8” in diameter – and even though
all 4 trees were also dead – we were not allowed to remove them because they were technically owned by
the city. But we were also told that since they were all dead, we may have a case for having removed
them, and we may be able to avoid mitigation if we explain our situation to the city manager. If need be,
we will pay to have our arborist come out again to perform another inspection on these 4 trees.
While we await your input on whether we need to have him return, please take a look at the following
photos of the 4 trees in question. We don’t want to be the new folks in town who make waves or become
a headache for the city, so we want to be sure you all know that we had no ill-intent when taking down
these dead trees, nor were we trying to pull the wool over anyone’s eyes. We simply want a usable yard
and a beautiful property we can be proud of, like the rest of our Atlantic Beach neighbors.
The two trees on the left:
The two trees on the right:
If you’ve made it this far, thank you. We appreciate your time and consideration. As a military family, we
are very much rule followers; both because it’s the right thing to do, but also because every time we go
out to work in the yard, at least one passerby decides to film what we’re doing!
I understand it’s because residents are protective of the trees here. We feel the same way, which is why
we decided to clean up the yard – we don’t want the mature hardwoods we have to be choked out by
vines and weeds like the ones we took down.
Please let us know what action we should take from here. Thank you again!
Sincerely,
Mary Beth Charles
Stephen Ditamore
