1667 Park Terrace East (Heritage Tree) FINALCITY OF ATLANTIC BEACH CITY COMMISSION MEETING STAFF REPORT AGENDA ITEM: Resolution 19-41 Heritage Tree Designation (1667 E Park Terrace) SUBMITTED BY: Brian Broedell, Planner DATE: July 23, 2019 BACKGROUND: The owners of 1667 East Park Terrace have nominated a live oak tree on their property to be designated as a heritage tree. The tree is 38 inches in diameter and approximately 70 feet tall. According to a certified arborist report, the live oak is healthy and appears to be close to 170 years in age. On private property, heritage trees are voluntarily nominated by the property owner. In accordan ce with Section 23-41 (a), the City Commission may by resolution designate individual heritage trees on private or public property. Heritage trees are defined as “any tree determined by the City Commission to be of unique or intrinsic value due to its age, size, species and/or cultural, ecological or historical significance or some other contribution to the city’s character, specifically including all cypress, live oak, and magnolia trees with diameter 30 inches or greater and in good condition, as determined by a recognized knowledgeable person or qualified professional…” A heritage tree designation does not prevent a tree from ever being removed, but it does discourage removal by increasing the required mitigation. On private parcels, the required mitigation for a heritage tree is one inch of mitigation for every inch removed (1:1). If designated, this tree will become the only heritage tree located on private property within the city. A heritage tree previously existed on private property at 391 8th Street but was removed in 2017 due to its poor and hazardous condition. BUDGET: None. RECOMMENDATION: Approve Resolution 19-41 to designate the 38 inch diameter live oak tree at 1667 East Park Terrace as a heritage tree. ATTACHMENTS: Heritage Tree Application submitted by property owner; photos of the live oak tree up for nomination; Resolution 19-41 REVIEWED BY CITY MANAGER: _____________________________________________________ RESOLUTION NO. 19-41 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA, DESIGNATING THE 38 INCH DIAMETER LIVE OAK TREE AT 1667 PARK TERRACE EAST AS A HERITAGE TREE. WHEREAS, the City Commission of the City of Atlantic Beach, Florida wishes to be a good steward of its tree canopy, and in particular specimens of physical and historical significance; and WHEREAS, the City Commission of the City of Atlantic Beach, Florida has the ability to designate individual trees as Heritage Trees according to Section 23-41 (a) of the Atlantic Beach Code of Ordinances; and WHEREAS, the Live Oak tree at 1667 Park Terrace East located in the back yard and nominated by the property owner is 38 inches in diameter and approximately 170 years old; and WHEREAS, Heritage Tree designation runs with the property and strengthens the mitigation ratio if the tree is ever removed. The current mitigation ratio for Heritage Trees is 1:1 on private property compared to 1:2 for protected trees. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA THAT: The 38 inch Live Oak tree at East Park Terrace is hereby designated as a “Heritage Tree”. This Resolution shall take effect immediately upon its final passage and adoption.
