These standards are set forth in the International Property Maintenance Code and the Florida Building Code and were adopted as part of the City of Atlantic Beach Code of Ordinances in Chapter 6,Article II, Section 6-16. A code enforcement inspection at 1132 BEACH AVE was conducted on 4/20/2021. The City of Atlantic Beach Code Enforcement has found your property to be in violation of the City of Atlantic Beach Code of Ordinances: NATURE OF VIOLATION:Two trees that were planted for mitigation on the property have died. In accordance with the code section below,trees planted for mitigation must be monitored and maintained for three years. One of the dead trees is your required front yard tree. In order to protect the canopy of Atlantic Beach, at least one shade tree is required in the front yard. VIOLATION CODE: 1. Sec.23-34.Maintenance and monitoring requirements.The applicant shall be responsible for maintaining the health of any replacement or relocation trees for three(3)years from planting.(1)Determination of success.The applicant shall determine the condition of each tree,three(3)years after the tree was relocated or planted.This determination shall be submitted to the city for approval within thirty(30)days of being made. Should any tree die or be in a state of decline within three(3)years of being planted or relocated,the applicant shall be required to replace the tree within sixty(60)days of that determination. The three-year monitoring and approval period shall begin anew whenever a tree is replaced.If that replacement tree is found not to be viable at the end of the second monitoring period,the applicant may pay the appropriate amount into the tree fund in lieu of planting a third replacement tree.If the applicant fails to replace the tree or to pay the appropriate amount into the tree fund within sixty(60)days,the applicant shall be in violation of this chapter. 2. Chapter 24. Land Development Regulations. Sec. 24-172. -Residential development standards. (c)Additional residential development standards. The following standards and requirements shall apply to that area defined in preceding subsection(b): (4)Shade trees. In order to sustain the existing tree canopy and to provide shade along the residential streets and sidewalks, one(1)shade tree shall be provided within the required front yard and an additional shade tree shall be required on the lot in a location at the property owner's discretion in accordance with the following provisions: a. The trees required in this section may be used to satisfy all or a portion of the requirements of section 23-30(1). All other requirements of chapter 23 shall be applicable. b. Such required trees shall be installed prior to issuance of a certificate of occupancy or prior to final inspections,as applicable. c. Required shade trees shall have a minimum size of four-inch caliper at the time of installation. A list of recommended tree species is available from the city. d. Credit shall be provided for the following, and an additional front yard shade tree shall not be required: 1. Where healthy canopy trees exist in the required front yard,which are listed on the recommended tree list and are at least four-inch caliper; or 2. Where an oak tree exists in the required front yard,which is at least six(6)feet tall; or 3. Where a healthy street tree exists in the adjacent right-of-way,which is listed on the city's recommended tree list and is at least four-inch caliper. e. Similarly,credit shall be given for the second required shade tree where such tree,as described above,exists elsewhere on the lot. f. Where installation of a front yard shade tree is required, such tree shall not be planted within rights- of-way or over underground utilities. This letter requests that the noted violation(s) be corrected by replacing the dead oak trees within thirty (30) days of the receipt of this notice. At least one of the dead oak trees must be replaced with a minimum 4" caliper oak tree. The other tree can be replaced with an oak, another hardwood shade tree or you may elect to pay into the tree mitigation fund.
