Patrick-The terms in your email are acceptable. As I said, when we
issue the CO, the sidewalk is the responsibility of the City of Atlantic
Beach. Let us know (usually it is the builder) when the work is
complete and we will schedule an inspection.

Good morning Mr. Gerrity and thank you for meeting with me at 278
Seminole Road on Tuesday morning to discuss the required sidewalk
repairs. My clients and I appreciate your willingness to work with us
to finalize this project. The Lagners are under a time commitment to
close on their home, so time is of the essence.
Per our discussion, I have set forth the terms of our mutual agreement
regarding the replacement sidewalk panels and the other factors that
will bring this matter to a mutually agreeable conclusion. If you see
any issues or have any questions, please let me know – we are happy to
work on the detailed language to ensure all aspects are addressed.
1. The three sidewalk panels identified in the attached pictures
will be fully replaced by the Lagners and subject to City inspection and
approval. I will inform you and Mr. Williams of the anticipated
replacement schedule as soon as we confirm with the Lagners’ contractor;
2. Please advise me of the inspection schedule that will be
required by the Public Works department and any other special
instructions or guidance on replacement criteria;
3. The Lagners will not be required to replace that portion of
cracked sidewalk that immediately surrounds the City manhole;
4. The Lagners request permission to cordon-off the right-of-way
during the entire sidewalk replacement installation process – the
Lagners have experienced the public parking vehicles in the right-of-way
given that the home is not currently occupied;
5. We request that the replaced sidewalk panels be inspected
within three (3) days of notification of completion and that within five
(5) business days of approval, the City will issue the Lagners the
requisite Certificate of Occupancy for the home;
6. The Lagners will provide the City with a copy of its invoice
for the total cost of replacing the three sidewalk panels and the City
agrees that it will pay 50% of said costs directly to the respective
vendor/contractor;
7. The Lagners and its vendor/contractor will not be held liable
for any damage to City infrastructure that may be caused by the removal
of the existing damaged sidewalk panels and/or the installation of the
replacement panels;
8. The City agrees that the sidewalks are located on dedicated
City right-of-way and, once repaired, are the responsibility of the City
going forward. As such, the City agrees to indemnify and hold harmless
the Lagners from any action, suit, claim of injury or damages, now and
in the future made by any person or entity as may be related to the
approved replaced sidewalk panels, located in the dedicated City’s
right-of-way.
